About this file

This is a Justification for Other Than Full and Open Competition (Brand Name Justification) document for a federal procurement by the United States Department of Justice, United States Marshals Service (USMS). The acquisition seeks to purchase one large transport category Boeing 737-700 or 737-800 Next Generation (NG) aircraft for the Justice Prisoner Air Transportation System (JPATS) with an estimated total value of $30 million and an anticipated award date of August 1, 2026. Delivery is expected 12 weeks after award. The requirement is being procured on a sole-source basis under RFO Part 6.103-1(d) for brand name justification, with the MIQ Request Number M-26-A37-R-000148 assigned by Contract Specialist Sheila Nimrod.

The justification demonstrates that Boeing aircraft are the only viable option based on JPATS' operational requirements and existing infrastructure investments. JPATS currently operates one Boeing 737-400, two Boeing 737-800, and one Boeing 737-700 aircraft, with pilots trained and type-rated for either Classic (737-300/400/500) or Next Generation (737-600/700/800) variants. The agency has purchased extensive documentation rights from Boeing, including Flight Manuals, Operating Manuals, Weight and Balance Programs, and Maintenance Manuals, along with a unique 737-800 MSG-3 Low Utilization Maintenance Program. Budgetary constraints and the cyclical replacement plan prevent adding aircraft from other manufacturers, as such additions would require duplicate training programs, maintenance procedures, and support contracts. Previous procurement history shows at least three firms expressed interest (AerSale Inc., AAR Aircraft Services, and Brewin Group LLC), though no alternative sources can feasibly meet JPATS' needs. Pricing is estimated between $26-30 million based on market research and historical data. All required certifications and approvals have been obtained, including Technical Representative, Contracting Officer, Supervisory Contracting Officer, General Counsel, Bureau Procurement Chief, Competition Advocate, and Head of Contracting Activity approvals.
