About this file
This is a Payment Bond form issued by the Azusa Unified School District for a Class B General Building Contractor project involving the installation of a walk-in refrigerator at Victor Hodge Elementary School, located at 700 W. 11th Street, Azusa, California 91702. The payment bond is a required document under California Public Works law, specifically California Civil Code section 9550, and must be executed by the contractor and a surety company authorized by the California Insurance Commissioner to write surety insurance. The bond guarantees that the contractor will pay all laborers, material suppliers, and other claimants entitled to payment under California Civil Code section 9100 for work performed on the project. The bond amount must equal at least 100 percent of the total contract amount payable by the District.
The surety company executing the bond must possess current California Insurance Commissioner authority and, if the project is financed with federal funds, must appear on the Treasury Department's current Circular 570 list. The bond obligates the surety to pay reasonable attorneys' fees as determined by the court in the event of litigation. The surety waives notice of any changes, extensions of time, modifications, or alterations to the contract and agrees that the bond shall be construed most strongly in favor of claimants and against the surety. A notarized power-of-attorney from the bonding company's local representative must be attached to the executed bond document.
