JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
Motorola Solutions Communication Enhancement System of PN 78804 Engineering Center and
PN 78805 Parking Structure West Point, NY
Solicitation No. W912DS19R0019
CONTRACTING ACTIVITY;
Control No. 010
The U.S. Army Corps of Engineers (USACE), New York District (NAN), Contracting (CT), 26 Federal Plaza, New York, NY 10278.
2. DESCRIPTION OF ACTION:
This Justification and Approval (J&A) supports the use of brand name components in an upcoming construction project. The government will not purchase the components directly, but rather will require that offerers include the Motorola Solutions Communication Enhancement System as part of proposals submitted in response to a design-bid-build solicitation that will lead to the award of a new firm-fixed-price (FFP) construction contract. These are two MILCON projects being procured as one construction contract located at the United States Military Academy at West Point. USACE is responsible for the acquisition and administration of a new construction contract to furnish and install the new Cyber Engineering Academic Center (CEAC) and Parking Structure military construction projects (MILCON) at West Point, NY. Funding for this acquisition will be MILCON. The FFP construction contract for the new Cyber Engineering Academic Center (CEAC) and Parking Structure will be solicited and awarded as a best value trade-off procurement in accordance with FAR Part 15 under Solicitation Number
W912DS19R0019.
3. DESCRIPTION OF suppUES/SERYICES:
The requirement is to provide the Motorola Solutions Communication Enhancement System in the new Cyber Engineering Academic Center (CEAC) and Parking Structure.
The Motorola Solutions Communication Enhancement System is an interior antenna system in the building that boosts first responder radio signals within the building. This antenna system allows first responders to communicate to others in the building and to other responders outside of the building. Antennas such as these are needed due to the building construction type.
The estimated total cost for the construction portion of this project is . The estimated cost of the requested brand-name requirement for the Motorola Solutions Communication Enhancement System for the CEAC is estimated at
4. AUTHORITY CITED:
10 U.S.C. § 2304(c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1 (c), Application for Brand Name Descriptions. In accordance with FAR 6.302-1 (c), the Contracting Officer will specify that all offerers be required to procure an item peculiar to one supplier (brand-name item).
5. REASON FOR AUTHORITY CITED:
A. Background:
The first responder two-way radios used at West Point are Motorola and they need to be compatible with the booster antennas installed in the facility. Currently the installation's radios are compatible with the Motorola Solutions Communication Enhancement System.
B. Justification:
The booster antennas located in the buildings at West Point need to be compatible with the radio system that they are currently using.
C. Alternatives:
There are no viable alternatives for that will meet the mission requirement of a communication enhancement system. Due to compatibility issues of the Motorola radio system with equipment from other manufacturers, any communication enhancement system other than a Motorola Solutions Communication Enhancement System will not be able to guarantee operational effectiveness of the first responder's radios systems in the CEAC during an emergency.
The only alternative action to ensure compatibility of a different manufacturer's communication enhancement system with the Motorola radios used at USMA, West Point would be to replace the Motorola Radios systems being used by the first responders and replaced the current Motorola Solutions Communication Enhancement Systems currently installed throughout the installation with the same system used in CEAC. This would be a very cost prohibitive effort on the order of
D. Impact:
If the J&A is not approved and a different communications enhancement system is installed in the CEAC, the first responders' radios may fail to work while in the building. During an emergency situation this could lead to confusion, injury, and even loss of life that could have been avoided if the CEAC had the Motorola Solutions Communication Enhancement System that is compatible with the first responders' radios being used at USMA, West Point.
6. EFFORTS TO OBTAIN COMPETITION:
The brand name product has been published as required by FAR 5.201, a Notice of Intent (NOi) to determine sources for this system was synopsized on May 3, 2019. No responses were received for the Notice of Intent. The brand name justification and approval will be posted with the solicitation. As stated in paragraph 5 above, Motorola Solutions Communication Enhancement System is the only brand available to ensure compatibility within the West Point existing system. Motorola Solutions Communication Enhancement System is available on the open market for purchase and installation by all offerers.
7. ACTIONS TO INCREASE COMPETITION:
This J&A supports a discrete requirement that will end when the project is complete. Therefore, there are no planned actions to increase competition for the requirement covered by this J&A.
8. MARKET RESEARCH:
A Notice of Intent (NOi) to determine sources for this system was synopsized on May 3, 2019.
