About this file

This document provides details for a federal construction contract opportunity issued by the U.S. Army Corps of Engineers Engineering District New York. The project involves construction of a new 136,000 square foot Cyber Engineering and Academic Center building on the campus of the United States Military Academy at West Point to provide innovative learning spaces for three academic engineering departments. The scope of work includes building construction, site work involving removal of approximately 300,000 cubic yards of granite rock, an underground parking structure with 450 parking stalls, and a pedestrian bridge connecting the new building to an existing academic building. The period of performance is approximately 1461 calendar days from notice to proceed. Offerors must be registered in the System for Award Management and proposals are due electronically as a request for proposal with a best value tradeoff source selection method. The estimated value of the construction is between $100 million and $250 million.

OFFEROR’S QUESTIONS AND GOVERNMENT REPLY:

Questions that may be of general interest to all Offerors and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s). Questions and answers are issued to the Offerors “for information only” and do not revise the solicitation, plans or specifications.

Question 1:

In the notice of offerors item 5, the variation in estimated quantity is listed to be incorporated only to items 0004 and 0006, please confirm the intent is not to items 0003 and 0004.

Government Response 1:

FAR Clause 52.211-18, Variation in Estimated Quantity, is incorporated by reference and is applicable only to item Nos. 0004 and 0006AB.

Question 2:

Will we be allowed to escalate (inflation) the dollar value of our past projects to the current dollar?

Government Response 2:

For the purposes of Evaluation Factor 1, Offerors are not allowed to escalate nor inflate construction dollar value to meet the relevancy criteria.

Question 3:

Is there a BIM model available?

Government Response 3:

The BIM model can be provided to the contractor after the contract has been awarded. The government cannot provide a BIM model prior to award of the contract.

Question 4:

Please clarify the below, does the value of general conditions staff count towards meeting the 20% requirement?

o 52.236-1 PERFORMANCE OF WORK BY THE CONTRACTOR (APR 1984) The Contractor shall perform on the site, and with its own organization, work equivalent to at least 20 percent of the total amount of work to be performed under the contract. This percentage may be reduced by a supplemental agreement to this contract if, during performing the work, the Contractor requests a reduction and the Contracting Officer determines that the reduction would be to the advantage of the Government.

Government Response 4:

Yes - everything the prime contractor self-performs, including general conditions staffing, counts toward meeting the 20% requirement.

Question 5:

Under 1. 7 CONTRACTOR's KEY MANAGEMENT PERSONNEL: The contract documents are specific about the role of each full time team member, is the ACOE willing to adjust the staffing requirements and allow reduced staffing commitments to include and allow individuals to wear a different hat?

Government Response 5:

The contractor shall meet the minimum requirements described in SECTION 01 30 00. All Key Management Personnel Qualifications are to be submitted at the Preconstruction Conference and are subject to Contracting Officer Approval. The Preconstruction Conference occurs after award of the contract but prior to commencement of any work at the site.

Question 6:

Hello, Are AutoCAD files available for this project?

Government Response 6:

The CAD files can be provided to the contractor after the contract has been awarded. The government cannot provide a CAD files prior to award of the contract.

Question 7:

In accordance with solicitation section 3, relevant past performance 5.1.2 of the solicitation, the submitted projects must have been completed no later than 10 years, please define what escalation formula, criteria, calculation, assumptions, etc. can be used by the contractor for projects completed more than 5 years ago Government Response 7:

For the purposes of Evaluation Factor 1, Offerors are not allowed to escalate nor inflate construction dollar value to meet the relevancy criteria.

Question 8:

According with the solicitation section 3, 3.3 volume 1, contractor team arrangement experience will be considered, please clarify if there is a team arrangement, will the team experience be submitted as part of the 5 projects requested under relevant past performance 5.1.2 or will the offeror be allowed more than 5 projects to demonstrate the team experience?

Government Response 8:

Contractor should demonstrate five (5) projects total. In the case of entities that have formed a contractor team arrangement, the experience and performance history of any member of the team, whether or not gained while working with the other member(s) of the currently- proposed contractor team arrangement, will be considered as a part of the evaluation of the five (5) projects.

Question 9:

Reviewing this solicitation I see that both FAR 52.225-9 and -11 are included. Since the magnitude of construction is $100MM or more, I would assume that -11 under trade agreements would apply. Can you please include an addendum clarifying which one applies?

Government Response 9:

FAR 52.225-9 does not apply and it not included. It is referenced in FAR 52.225-10, which is now removed per this Amendment.

Question 10:

Will the Owner agree to indemnify the Contractor for pre-existing hazardous materials?

Government Response 10:

Contractor shall comply with Division 02 specifications. FAR Clause 52.236-2 Differing Site Conditions is incorporated by reference.

Question 11:

Will the Owner agree to be the Generator of all pre-existing hazardous materials encountered onsite?

Government Response 11:

Comply with SECTION 02 81 00 paragraph 3.1. When accumulating hazardous waste onsite, comply with generator requirements in 40 CFR 262 and any applicable state or local law or regulations.

Question 12:

Specification section 042000 only addresses the auxiliary materials and execution of concrete masonry units relative to the masonry work. Please provide specification sections for the stone (cast, limestone, and granite) scopes of work.

Government Response 12:

Please review SECTION 04 20 00 Page 11.

Specification section 042000 is the standard USG specification for unit masonry including cast stone, limestone and granite. With the exception of the larger limestone panels indicated on the drawings all other limestone, granite and cast stone units use basic unit masonry techniques and methods for building the stone veneer walls. As indicated on the drawings the larger limestone panels anchorage is to be engineered by stone manufacturer. No additional specifications are to be provided.

Question 13:

In a case where the Offeror or one of its affiliates was a member of a joint venture that contracted for the construction of a large project, may that project be considered as relevant past performance for the purposes of 5.1 of this solicitation? If so, are there any specific parameters related to the nature of that JV or contracting arrangement for that prior project that must be met and/or detailed in the Offeror's response to this solicitation?

Government Response 13:

In the case of joint ventures, the "Prime Offeror" experience includes entities with signed agreements. In the case of affiliates, Past performance of an Offeror's "affiliate," as that term is defined in FAR 2.101, will be evaluated if the Offeror demonstrates a firm commitment that the affiliate will participate meaningfully in the performance of the contract. This commitment and meaningful participation shall be described in a document signed by authorized representatives of both the Offeror and its affiliate.

Question 14:

It appears two statements within section 5.1.2 related to relevant past performance may be in conflict with one another. The first paragraph of this section states that "A minimum of two (2) projects should be examples showing rock excavation and removal as described in this solicitation." However, the last paragraph states that "Projects do not have to meet all criteria to be considered." Is it a minimum requirement that at least two projects submitted must each have at least 80,000 CY of rock removal, or, will projects with fewer than 80,000 CY of rock removal still be considered relevant as to rock excavation scope when evaluating past performance?

Government Response 14:

Past Performance Relevancy Ratings will be assigned in accordance with Table 1, which appears on page 24 of the Solicitation dated 3-June-2020. As indicated on Table 1, past performance efforts may be rated Very Relevant, Relevant, Somewhat Relevant, or Not Relevant.
