BIDDER’S QUESTIONS AND GOVERNMENT REPLY
(Questions that may be of general interest of all bidders/Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or clarify and simplify the question(s). Questions and answers are issued to the Offerors/Bidders for information only.)
Q064: Drawing detail 7/C-501 which is the new to existing condition shows as the only location where tack and prime per specification 321210 Bituminous Tack and Prime Coats. Paragraph
3.4.3 clearly states for the tack coat “apply tack coat at the locations shown on the drawings”.
Others details such as 1 through 6 on C-501 and 7/C-509 do not show any tack coat or prime coat. If details such as 1 through 6 on C-501 and 7/C-509 do require tack coat and prime coat, please indicate them.
A064: Prime and tack coat will be used for all asphalt paving sections. Refer to attached revised sheets C-501 and C-509 for more information.
Q065: Specification 311100 Clearing & Grubbing paragraph 3.2 please concur that there are no trees that are to be trimmed as all trees within the boundary limits as indicated on drawing CD- 100 are coming out.
A065: Concur, no trees to be trimmed are to remain on site; all trees within the boundary limits are to be removed entirely.
Q066: The A200 series drawings indicate FWP 1, 2, 3 along with composite wall panel. The 074263 Fabricated Wall Panel Assemblies specifications have composite wall panel and only one performance spec for a FWP (Formed wall panel). We will need to know more specifically the design intent of each panel other than what is in paragraph 2.1.1, i.e. is it 2" thick foamed place or corrugated, etc. The only information provided in specification 090690 paragraph
2.2.1.3 is only the color.

Q089: On Access Control door 100B, 007A, who terminates wall mount actuators by others?
These devices would normally be integrated with the access control system. Define parameters of operation. Will a valid card read activate the push button to actuate the door?
A089: The wall mounted actuators along with all other components associated with the automated door operators are to be provided and installed by the contractor. The contractor shall make all terminations required for a fully operational system. The design intent is to inhibit the operation of the automatic door operator while the door is locked. Once the door is unlocked, pressing the wall mounted actuator shall cause the door to automatically open.
Q090: Is Remote Activation Switch noted in Door Set #19 Reception/Security room 157 by Access Control?
A090: There shall be a set of remote activation switches located in Reception/Security 157, Director’s Reception/Waiting 133, and Tech Supply 120. a. Please define the MFG/Product of CCTV system for interface compatibility.
b. Please define DVR event recording to include DVR Model and events.
c. Please define floor-plan graphical map file types to be provided.
d. Please define the number of networked PC workstations that would be concurrently connected to the ACS software.
A094: The government intends to issue its response to this question in a forthcoming amendment.
Q095.1 I see where a Safety Cover valve box is required at each tank and that the valve box is to house the tank valves and electric water heater. However no dimensions are specified. What would be the required dimensions of the " valve box"?
Drawing #C-512 shows the tank details. The drawing shows copper heat recirc. piping and PVC pump test return piping. NFPA-22 does not recognize anything but carbon steel piping. Can these items be provided as Schedule 40 carbon steel pipe?
Spec section 33 16 15, page 8, sub section 2.2.1.5 Balconies. Normally Balconies are only used on Elevated Water Towers to allow access around the perimeter of the tank 100' plus feet in the air and are not used for Ground mounted Water Tanks since there is access around the tank on the ground. Therefore, is a Balcony required?
A095.1a. Size of the enclosure should be determined by the tank manufacturer. Tank manufacturer shall size heated enclosure as necessary to house equipment and as necessary for clearances in Specification Section 33 16 15.
A095.1b. Steel pipe is allowed, but not preferred. Any steel pipe used must have appropriate corrosion protection measures.
A095.1c. A balcony is not required but is allowed. If a balcony is used by the tank manufacturer, it must conform to the requirements of paragraph 2.2.1.5.
Q095.2 Please provide a spec for the 1" thick R-5 rigid board insulation under the hangar slabs.
All we can find in the specs is for the R-10 insulation for block but not for the slab. Need to know what PSI it needs to be.
A095.2. Rigid insulation under the hangar slabs needs to be 100 psi compressive strength. Basis of design is Owens Corning Foamular 1000 Extruded Polystyrene (XPS) Rigid Foam Insulation, 1 1/2" thick, R-value of 7.8.
Q096 :Key Note 10 on Drawing A-103 specifies a mesh lid, but Key note #17 does not. Please confirm that the wire mesh partition indicated by Key Note 17 between Column lines 2 and 3 does not receive a mesh lid.
A096: The wire mesh partition indicated by Sheet Keynote 17 on drawing A-103 does not require a mesh lid.
Q097: Standard Form 1442 block 13.D requires the contractor and its subcontractors and suppliers to hold their bid for 120 days after the bid submission date. In this volatile economy and the unstable commodities market this is extremely hard to do and to predict where the pricing may go. Please consider 60 days for the Government to make their selection for the contractor on this project.
A097: At this instance the government has heard from only one entity regarding this issue and for this reason it is not inclined at this time to alter this requirement.
Q098: The State of New Jersey along with the New Jersey DOT both have acknowledged that any project in NJ is subject to the asphalt and fuel price index. Please concur that this project too is subject to the asphalt and fuel price index.
A098: The US Army Corps of Engineer neither collects nor interprets state tax codes and law; it is the responsibility of each individual Offer and his subcontractors to determine his or her tax liabilities.
Q099: Ms George we are receipt of Amendment 0001 and do not see answers to the below questions which have been sent by a potential teaming partner we are working with as well as our attached e-mail from 5/14 . Speaking with a number of other small businesses interested in this project who also sent in similar questions. Please explain why the ACOE has not responded to those questions.
a. Can an Offeror working with a Major Teaming Partner subcontractor, with a executed signed Teaming Agreement submit the qualifications of their Teaming Partner to satisfy the requirements of Factor 1 CONTRACTOR PAST RELEVANT EXPERIENCE?
b. Factor 1, paragraph 3.1.1 states that the Offeror must submit at least two (2) projects but no more than four (4) that are both at least 50,000 square feet and with a $25 million contract value. We feel that requiring a small business to submit projects of this magnitude seriously limits the number of contractors capable of submitting acceptable qualifications.
Would the USACOE consider projects that meet some but not all qualifications?
c. Can you please provide some clarification in terms of what past performance criteria can be submitted for the teaming partner subcontractors? Factor 2 mentions, “past client’s input regarding their firm’s and/or that of any past Team Association or sub-contractor’s past performance.” but there is no mention of this under Factor 1 therefore we are unsure what is allowable. We have projects that meet the required criteria but if they cannot be considered as acceptable under Factor 1 Contractor Past Performance Experience / Factor 2 Contractor Past Performance we may be unable to submit a proposal with a teaming partner.
A099:
a. Large/Small business JVs except for “Mentor-Protégé Agreements, approved by the
SBA” will not be allowed to submit a proposal as a qualified bidder.
b. The Offeror (s) submitting on this solicitation is expected to meet all the criteria as stated in this solicitation and any amendments.
c. This question has been sufficiently answered between this and previous amendments.
Q100: On the Sheet Keynotes for Drawings ET402, ET502 and ET503, there’s requirement that states the intrusion detection system wiring, equipment and control panels shall be GFGI.
Question: Does this mean that the Government will come directly to Advantor for the intrusion detection system?
A100: The contractor is not responsible for providing or installing the intrusion detection system (IDS) wiring or control equipment. The IDS wiring and control equipment will be provided and installed by others. The exact make and model of control equipment is to be determined by government
Q101:
Reference Section 00800, Special Contract Requirements – Paragraph 42 ENVIRONMENTAL
RESPONSIBILITY (10-8-99)
Discussion Paragraph 42 states:
The Contractor shall immediately take all appropriate actions to minimize the consequences of any and all environmental incidents resulting from actions taken to execute this contract.
Environmental incidents, include, but are not limited to, spillage of oil and other HAZMAT; solid and/or hazardous waste removal, handling and disposal; lead and/or asbestos abatement, removal, handling and disposal; and spillage or release of any other pollutants. Appropriate actions include, but are not limited to, notification, evacuation, control, containment, cleanup, removal, disposal and remediation as conducted in accordance with all applicable Federal, State, and local laws and regulations at NO ADDITIONAL COST TO THE GOVERNMENT.
Question Please advise how the contractor is to price this contract requirement in a fixed price contract when no lead, asbestos, or other hazardous materials are indicated in the contract documents.
A101: This requirement simply stated places the responsibility on the contractor for his actions under the contract. If for example, the contractor is removing asbestos as part of his work or simply refueling his vehicles and there is a spill, the contractor is responsible for cleaning or otherwise removing the spilled materials.
