BIDDER’S QUESTIONS AND GOVERNMENT REPLY
(Questions that may be of general interest of all bidders/Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or clarify and simplify the question(s).
Questions and answers are issued to the Offerors/Bidders for information only.)
Q001: Specification 144500 Vertical Personnel Lift does not indicate a basis of design manufacture only performance requirements. Please provide us a basis of design MFG as we are having problems locating a MFG.
A001: Basis of design is Alimak Hek, Model #SE 600. As stated in Q001 Specification 144500 Vertical Personnel Lift does not indicate a basis of design ......." and as such it is a performance based specification open to all. The “Basis of Design” does not imply that the item listed be either sole source or proprietary in any manner.
Q002: Specification 050523 paragraph 1.5.1 and 051200 paragraph 1.4 requires the steel fabricator to be AISC certified in the STD category. A majority of steel fabricators do fabricate to only one standard, the AISC. Having the requirement to have this certification will drastically limit the amount of steel contractors who will bid this project and will drive the cost higher because the Prime contractor will need to subcontractor to an STD firm. Please advise if these certifications can be waived. There have been a number of DoD projects done where these certificates were not required.
A002: The Government acknowledges this Offerors concern, but believes there to be adequate numbers of certified fabricators to ensure competition."
Q003: Drawing C-512 indicates the 2 205,000 gallon storage tanks. We have looked at the structural drawing as well as the civil drawings and cannot locate the design for the foundation for these tanks. We respectfully request a design detail.
A003: A design detail will not be provided; the contractor and their tank installer are responsible for design of the tank foundation. Please refer to the specifications, section 33 16 15, “Water Storage Steel Tanks”, paragraph 1.3, “Submittals”. Foundation design is to be included in the submittals of shop drawings and product data and must include a certificate, signed by a registered professional engineer that includes the information listed in sub-paragraph SD-07, “Certificates”.
Q004: Drawing GV102 – sheet index shows geotechnical drawings B-100 thru B-111 Vol 1A of drawings only goes to B106 (B-107 thru B-111 are missing) (they are not in the rest of the volumes either) Please provide
A004: Drawings B-107 thru B-111 have been added as part of AMENDMENT 1
Q005: Drawing A-513, details 2,6 & 10 for the TL Panel head, sill & jamb conditions. The contact documents do show how the TL panel system will attach to the steel girt. A continuous steel plate should be provided between the TL panel system and the Fabricated Wall Panel at head, sill and jambs for proper separation and structural attachment. Please provide a detail to the structural drawings and architectural drawings.
A005: Drawings and specifications will be revised in a forthcoming amendment to address this issue.
Q006: Specification Section 086045 Translucent Panels subsection 2.2.2 /Non Combustible Grid Core and 2.2.4 Panel Construction - calls for aluminum I-beam.........Should be changed to a Thermally broken I-beam to conform with "u" factor requirement (2.3.3) and Condensation Index Rating of 80 (2.3.4).
A006: Drawings and specifications will be revised in a forthcoming amendment to address this issue.
Q007: Specification Section 086045 Translucent Panels subsection 2.4 a - Integral perimeter framing system should include "all to be thermally broken" and by the manufacturer. Required for NFRC certification required as per 2.4.
A007: Drawings and specifications will be revised in a forthcoming amendment to address this issue.
Q008: Specification Section 086045 Translucent Panels subsection 2.4 h - Exterior panel impact resistance should at 70 ft.-lbs. Omit the 40' drop distance. These corrections will be in sync with all other performance requirements. Should a Hi-Impact ext. face be required, the ft-lbs should be 230 and the exterior face sheet to be changed to White and Light transmission % to 20 and SHGC to 0.28.
A008: Drawings and specifications will be revised in a forthcoming amendment to address this issue.
Q009: Factor 1 allows for Joint Venture Proposals to be submitted. Can a business classified as a small business joint venture with an large business and submitted a proposal as a qualified bidder?
A009: Large/Small business JVs except for Mentor-Protégés approved by SBA will not be allowed to submit a proposal as a qualified bidder.
Q010: Reference solicitation page 23 of 116 paragraph 3.1.2 on Past Performance Questionnaire Submission. The fifth line in the paragraph states that completed past performance questionnaires should be submitted with your proposal. Page 35 of 116 states that the completed questionnaire be returned to New York District.
Question: Do the completed client questionnaires get submitted with the contractor’s proposal or does the client submit them directly to New York District?
A010: The past performance questionnaires are to be submitted in the Offeror's proposal package. If a past client fails to return the Offeror's survey in time to include it in the proposal the Government requires the Offeror to complete and include the first page of the Past Performance Questionnaire in the proposal. Offeror's should follow-up with clients to ensure a timely submittal of questionnaires.
The following formal changes need to be made in the amendment:
Section 00 22 11, paragraph 3.1.2 Factor 2-Contractor Performance In the first paragraph, last line, delete the following sentence in its entirety without substitution "If the client requests, questionnaires may be submitted directly to the Government's point of contact: inclusive of the Corps of Engineers address and phone/fax information".
Attachment #2 - Past Performance Questionnaire - on the instructions for submission, delete the last sentence in its entirety, "Please complete and return.....". The Offeror shall instruct his client that the completed questionnaire must be returned to the Offeror for inclusion in the Offeror's proposal package.
Q011: Page 79 of 116 paragraph 3 - Prosecution of work within Wetland areas: The first sentence states “No work under this project is within wetland areas.” The remainder of the paragraph reads “The Contractor will not be allowed to work within the Wetlands nor its buffer zones. Construction of the new utilities that are located within the wetland areas or connection to existing utilities within the wetland areas will only be allowed once the appropriate New Jersey State Agency(s) has approved the Air Force’s permit application. Any work in wetlands will require a NJDEP wetlands permit through the Pinelands Commission.” The first sentence of the paragraph conflicts with the rest of the paragraph.
Question: Is any of the work under this project within the Pineland Commission jurisdiction that a permit is required?
A011: No areas within the contract are or have been identified as wetlands or are they within 300 feet of wetlands nor does the contract call for the contractor to file for permit(s) from the Pineland Commissions."
Q011: Specification 331615 references AWWA D100 which is a welded tank specification. There have been other tanks installed at Lakehurst which are AWWA D103-09 Bolted Tanks. Would bolted tanks per AWWA D103-9 be acceptable?
A011: Please provide welded steel tank in accordance with AWWA D100 and NFPA 22 as specified.
Q012: Drawing CP-105 detail 2 indicates an aircraft tie down detail using a 1.25” diameter rebar 5.75” from the top of the slab. Would the Government consider/allow the use of a Neenah Foundry Airport Mooring Eye #R-3490A (6” high).
A012: The Offers shall follow detail 2 on drawing CP-105.
Q013: Specification Section 23 81 47, Water Loop and Ground Loop Heat Pump Systems, Page 22, Paragraph 2.9 Bentonite Grout, specifies using bentonite to tremie grout the loops in place once they are installed. Is there a required minimum thermal conductivity rating for the bentonite grout material?
A013: The required minimum thermal conductivity rating for the Bentonite Grout is 1.01 BTU/hr/ft/°F. Specification Section 23 81 47 will be revised to reflect this data.
Q014: Specification Section 23 81 47, Water Loop and Ground Loop Heat Pump Systems, Page 27, Paragraph 3.4.7, Tracer Wire, stipulates the installation of tracer wire for the geothermal loop installation.
Will any additional specifications and/or details be provided regarding the specifications of the tracer wire itself, as well as details on connection and termination points of the tracer wire system?
A014: Material for and installation of tracer wire is included in Section 23 81 47, Water Loop and Ground Loop Heat Pump Systems, page 19, paragraph 2.5.7 and page 29, paragraph 3.4.7. In addition, refer to Detail 1 on sheet C-503 for a typical tracer wire installation. Material and installation of tracer wire shall conform to the requirements of this Contract Documents.
Q015: Specification Section 23 81 47, Water Loop and Ground Loop Heat Pump Systems, Page 29, Part 3.9.2, Flow Test of Ground Heat Exchanger Piping, states in part, “After purging has been completed, add the required amount of antifreeze to the system to achieve the required solution concentration” (15 degree F freeze protection). However, the pump schedule on Drawing M-701 shows water as the fluid type required for the “Geothermal Loop.” Is any antifreeze required for the geothermal loop system? If so, what type and concentration of antifreeze is required?
A015: There is no antifreeze required for the geothermal loop system. The referenced specification paragraph will be revised to delete the reference to antifreeze.
Q016: Drawing M-603, Ground Loop Diagram, shows piping transitions in each of the five loop circuits, with 2 ½ inch HDPE piping connecting to the 4 inch manifolds located in the proposed mechanical room.
Please be advised that high density polyethylene (HDPE) pipe is not manufactured in a 2 ½ inch size. Will 3 inch HDPE will be acceptable in lieu of the 2 ½ inch pipe specified?
A016: The dual temperature piping above ground is steel or copper and is specified in Section 23 81 47, page 17, paragraph 2.3 and Section 23 64 26. All manifold piping including the 2 ½” piping above grade is identified as dual temperature piping. The below ground geothermal piping identified as GHES and GHER is HDPE as required by the Contract Documents. Use of 3” HDPE for GHES and GHER is acceptable. M-603 will be revised to change all 2 ½” GHES and GHER to 3”.
Q017: Drawing M-306, Sections, Detail 1, Geothermal Return Manifold and Detail 2, Geothermal Supply Manifold both call for the installation of a 1 inch flush/purge ball valve on each supply and return line connecting to 4 inch manifolds. Specification Section 23 81 47, Water Loop and Ground Loop Heat Pump Systems, Page 28, Part 3.9.2, second paragraph from the bottom of the page, states in part, “A velocity of 2 feet/sec is required in pipe sections to remove the air.” The 1 inch flush/purge port shown on Drawing M-306 is insufficient to purge all of the air out of the geothermal loop system. Will a single three (3) inch flush/purge valve on each manifold be acceptable in lieu of the one (1) inch ?
A017: The dual temperature piping where the 1” flush/purge ball valves are shown is 2 ½” as previously indicated. Provide 2 ½” flush/purge fittings in lieu of the 1” shown on the drawings. M- 306 and M-603 will be modified to reflect the 2 ½” fittings.
Q018: Specification Section 23 81 47, Water Loop and Ground Loop Heat Pump Systems, Page 17, Part 2.3, Above Ground Piping Systems, stipulates to “Provide above ground steel or copper, dual temperature piping as specified in Section 23 64 26.” Can high density polyethylene (HDPE) pipe be used in lieu of steel or copper for the 4 inch geothermal supply and return manifolds?
A018: HDPE is not acceptable for dual temperature piping. Provide pipe materials as specified.
Q019: Drawing M-306, Sections, Detail 1, Geothermal Return Manifold and Detail 2, Geothermal Supply Manifold contain a notation of 2 ½” DTR and 2 ½” DTS. Please clarify, do these notations refer generically to the manifold piping as “Dual Temperature Water Return” and “Dual Temperature Water Return” or do they refer to an additional component required between the ball valves and circuit balancing valves and the flush ports?
A019: 2 ½” DTR and 2 ½” DTS identify the pipe and piping system as dual temperature supply pipe and dual temperature return pipe.

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is union or non‐union.
Union Identifiers
An identifier enclosed in dotted lines beginning with characters other than "SU" denotes that the union classification and rate have found to be prevailing for that classification. Example: PLUM0198‐005 07/01/2011. The first four letters , PLUM, indicate the international union and the four‐digit number, 0198, that follows indicates the local union number or district council number where applicable , i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination.
The date, 07/01/2011, following these characters is the effective date of the most current negotiated rate/collective bargaining agreement which would be July 1, 2011 in the above example.
Union prevailing wage rates will be updated to reflect any changes in the collective bargaining agreements governing the rates.
0000/9999: weighted union wage rates will be published annually each January.
Non‐Union Identifiers
Classifications listed under an "SU" identifier were derived from survey data by computing average rates and are not union rates; however, the data used in computing these rates may include both union and non‐union data. Example: SULA2004‐007 5/13/2010. SU indicates the rates are not union majority rates, LA indicates the State of Louisiana; 2004 is the year of the survey; and 007 is an internal number used in producing the wage determination. A 1993 or later date, 5/13/2010, indicates the classifications and rates under that identifier were issued as a General Wage Determination on that date.
Survey wage rates will remain in effect and will not change until a new survey is conducted.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis‐Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
