52.212-2 -- Evaluation -- Commercial Items.
As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows:
Evaluation -- Commercial Items (Oct 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
(1) Responsiveness and Technical Quality of Proposal
(2) Technical approach
(3) Previous Corporate Experience - Experience is the opportunity to learn by doing. The Government will evaluate each offeror's organizational experience on the basis of its breadth, its depth, and its relevance to the work that will be required under the prospective contract, based on the information provided in the past experience information sheets submitted in the proposal. Previous experience shall be demonstrated in including previous contracts held of similar scope and magnitude.
(4) Past Performance - Past performance is a measure of the degree to which an offeror satisfied its customers in the past and complied with Federal, state, and local laws and regulations. Past performance shall be evaluated based on the questionnaires submitted by at least three (3) previous contracts performed.
Each of these factors are evaluated as either technically acceptable or unacceptable.
(i) technical capability of the item offered to meet the Government requirement;
(ii) RESERVED – we are not evaluating key personnel
(iii) price;
(iv) past performance (see FAR 15.304);
Technical and past performance, when combined, are approximately equal to price. The award will be made to the lowest priced offer whose offer is evaluated as technically acceptable. Offers above the lowest price will only be evaluated if the lowest offer fails to meet these requirements. Evaluation will continue until the next lowest offer is evaluated as acceptable. Once an offer is deemed technically acceptable, there will be no further evaluations.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the
Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an http://farsite.hill.af.mil/reghtml/regs/far2afmcfars/fardfars/far/12.htm#P120_20013 offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
