Mr. Lewis, per our conversation today, I attached both the Petroleum Contaminated Site and Noncontaminated Site Dewatering Notice if Intent (NOI) applications. I have provided an explanation for each scenario that we discussed below.

1) The NOI for noncontaminated sites is for dewatering discharges to stormwater drainage systems, or surface waters, and the dewatering discharge does not need to be treated, because there are no contaminates with results above the surface water limits in the attached Rule 62-302.530, FAC, and/or limits for the parameters in the table of the NOI for Petroleum Contaminated Sites.

2) If you want to temporarily hold the dewatering discharge water in a frac (i.e.: holding) tank and discharge this water back on to the same ground surface where the dewatering site was located, and the dewatered water does not have any contaminates above the ground water limits in the attachment called 550 PW Stnds.pdf, then you do not need a dewatering permit for this untreated water.

3) If the dewatered water is pumped from the holding tank, or the dewatering site, and the dewatered water does have contaminates above the surface water limits in Rule 62-302.530, FAC, and/or limits for the parameters in the table of the NOI for Petroleum Contaminated Sites, and these contaminates are petroleum related, and the dewatered water is pumped back on to the same ground surface where the dewatering site was located, and the dewatering site does have an open contaminated waste cleanup case, then you should talk to the project manager with the Petroleum Storage Sites Program at either the City of Jacksonville, or our Florida Department of Environmental Protection (FDEP) office to make sure they agree with discharging the contaminated water back into the surficial ground water aquifer, or if they require treating the water to meet the ground water limits, and you do not need a dewatering permit.

4) If the dewatered water is pumped from the holding tank, or the dewatering site, and the dewatered water does have contaminates above the surface water limits in Rule 62-302.530, FAC, and these contaminates are not petroleum related, and the dewatered water is pumped back on to the same ground surface where the dewatering site was located, and the dewatering site does have an open contaminated waste cleanup case, then you should talk to the project manager with the Waste Cleanup Program with or our Florida Department of Environmental Protection (FDEP) office to make sure they agree with discharging the contaminated water back into the surficial ground water aquifer, or if they require treating the water to meet the ground water limits, and you do not need a dewatering permit.

5) If the dewatered water is pumped from the holding tank, or the dewatering site, and the dewatered water does have contaminates above the surface water limits in Rule 62-302.530, FAC, and/or limits for the parameters in the table of the NOI for Petroleum Contaminated Sites, and these contaminates are petroleum related, and this dewatered water is pumped back on to the same ground surface where the dewatering site was located, and the dewatering site does not have an open contaminated waste cleanup case, then it is still recommended to talk to the Petroleum Storage Sites Program at either the City of Jacksonville, or our Florida Department of Environmental Protection (FDEP) office to make sure they agree with discharging the untreated water back into the surficial ground water aquifer, or if they recommend treating the water to meet the ground water limits, and you do not need a dewatering permit.

6) If the dewatered water is pumped from the holding tank, or the dewatering site, and the dewatered water does have contaminates above the surface water limits in Rule 62-302.530, FAC, and these contaminates are not petroleum related, and this dewatered water is pumped back on to the same ground surface where the dewatering site was located, and the dewatering site does not have an open contaminated waste cleanup case, then it is still recommended to talk to the Waste Cleanup Program at our Florida Department of Environmental Protection (FDEP) office to make sure they agree with discharging the untreated water back into the surficial ground water aquifer, or if they recommend treating the water to meet the ground water limits, and you do not need a dewatering permit.

7) If the dewatering water has petroleum related contamination above the surface water and/or parameters in the table of the NOI for Petroleum Contaminated Sites, and it is either pumped directly from the dewatering site, or a holding tank to a stormwater drainage system, or directly to surface waters, then the dewatered water must be treated to meet the above limits, then a Petroleum Contaminated Site Permit is required. If the dewatering discharge will last <30 days, a Short-Term Petroleum Contaminate Permit should be applied for using the NOI for Petroleum Contaminated Sites, and if the dewatering discharge will last >30 days, the same NOI should be used to apply for this type of permit, but the long-term sites require an annual fee of $2,850.00 and additional monitoring requirements.

8) The NOI application fee for any of the above dewatering NOIs is $100.00.

9) If the dewatering site has non-petroleum related contamination and you want to discharge to the stormwater drainage system, or surface waters, then a dewatering permit is not applicable, and you will have to submit a Permit Determination Request (PDR), There is no application or fee for a PDR, but I have a list of items that are required to be submitted for a PDR, if you request them. After we review the PDR, we will decide if the project can be issued an exemption letter, or if a full Industrial Wastewater (IW) Permit is required. If an IW permit is required, there is a separate application and fee that must be submitted, and the timeframe for issuing this permit can take numerous months.

If the NOI application for one of the dewatering permits is submitted electronically with the $100.00 fee at the following DEP Business Portal website: https://www.fldepportal.com/go/home/, then you can enter the NOI electronically and pay the fee electronically, and you should be able to submit one attachment (i.e.: if there is more than one attachment, they should combine all pdf documents into one pdf and attach it). If you have not applied for an online DEP account at the indicated website and received a PIN number yet, then it takes about a week to get a PIN. Please see the additional instructions below for entering the NOIs electronically and paying the fee electronically at the same time. I included our Map Direct website with instructions below, also.

Please be aware that if a contractor signs the Certification Section of the NOI, an Authorization Letter (AL) from the property\business owner will have to be submitted with the NOI that states they provide approval for the contractor to sign the NOI and receive a dewatering permit for the project dewatering site. Or, you can get the property\business owner, or other responsible person that works with the business that owns the property, to sign the Certification Section, and an AL is not required. If a Project Manager, or other similar responsible person of the dewatering property that works with the business, or property owner signs the NOI, then, an AL is not required. See the attached example AL.

Additional Instructions for entering the NOI electronically and paying the fee electronically:

To enter the NOI electronically and pay the fee electronically at the same time: Go to the DEP Business Portal website https://www.fldepportal.com/go/home/, and click the Apply button, then the Discharge button, and either the ‘Generic Permit for Discharge of Ground Water from Dewatering Operations’ button for noncontaminated dewatering sites, or the ‘Generic Permit for Discharges From Petroleum Contaminated Sites.’ Then, enter your registration email address and password to get to the electronic NOI screens. After you enter the NOI electronically, you will have to pay the fee electronically, in order to submit the electronic NOI. An electronically submitted NOI automatically generates an application ID number and enters it on the NOI.

1) At the top right of the map, in the search icon field , enter the street address of the project site, or click the search icon and then the option to enter the coordinates of the site.

2) At the bottom left of the map, click the aerial photo icon to open the aerial photo map.

3) At the top left of the map, click on the double down arrow icon to see the map 6 layers

. Then, at the bottom left of each layer, click in the yellow box in each of the 6 layers to put a green check mark in the box to see the icons on the map for each layer.

4) Now, each of the 6 layers should have a green check mark in a green box, instead of yellow, as shown here:

5) Next, in the bottom right corner of each layer, click on the yellow tag in each layer to turn it green, as shown here: . This will place a label for each icon on the map.

6) At the bottom right of the map, click the marker icon to open the Map Marker option. In the Map

Marker Details pop up box , click the ‘What’s Nearby the Marker?’

option.

7) In the What’s Nearby pop up box , in the Search Radius (Buffer) field enter 500, and in the units field, select Feet. Then, press the Search button.

8) Then, a new browser tab will open called the Area of Interest Report, as shown below. This report shows the details for any site from each of the six layers with the 500-feet boundary.

9) Next, at the top of the browser, click the Map Direct Standard Map tab to view the map with the 500-feet boundary, as shown below:

10) On the map, click the yellow icon circled in red and labeled Baymeadows Way Parking, and the pop up box on the right of the map shows the details of the site. This site is a Stormwater site that has an existing Stormwater construction permit with Facility ID number FLR20AG96. Since the permit number starts with

FLR20, it means that there is an existing Stormwater construction permit for this site, and it includes noncontaminated dewatering activities for this site and for whoever the permit was issued. The Stormwater construction permits are issued out of our Tallahassee office. If there is contamination at the site, then the Stormwater construction permit does not allow dewatering, and a separate contaminated dewatering permit must be requested at the Jacksonville office.

11) If there are any petroleum contaminated sites with the 500-feet boundary, as shown below, check the Cleanup Status, and if it is marked with a SRCR-Site Rehabilitation Completion Report, in the near future a SRCO- Site Rehabilitation Completion Order may be issued, and status would show SRCO. An SRCO indicates that the site is cleaned up to an acceptable level, and is no longer considered contaminated. However, some of these sites may have restrictive covenants with requirements on use of the groundwater within the site, because of contamination levels still being just above the limit, and additional information may need to be considered for this type of site. Click on the blue hyperlink to open the files for the site, and determine if the site has a Remedial Action Plan, or other information that may help identify if the contamination plume could be a problem for the dewatering project.

12) You can print the map to a pdf file by clicking on the Print option at the top middle of the map, and then press the Printout option after it pops up.
