About this file
This is an employee rights notice issued by the U.S. Department of Labor's Wage and Hour Division regarding Davis-Bacon Act protections for laborers and mechanics employed on federal or federally assisted construction projects.
The notice establishes mandatory wage and compensation requirements that contractors must observe. Workers must receive prevailing wage rates as determined by the Davis-Bacon Wage Decision posted with the solicitation, and must be paid at least one and one-half times their basic hourly rate for all hours worked beyond 40 per week, with limited exceptions. Apprentice rates apply only to workers properly registered under approved Federal or State apprenticeship programs. The document emphasizes enforcement mechanisms, including contract payment withholding, potential liquidated damages, contract termination, and debarment from future federal contracts for up to three years. Contractors who falsify certified payroll records or induce wage kickbacks face potential civil or criminal prosecution, fines, and imprisonment. Employees who do not receive proper compensation or require wage information should contact Daniel P. Kinney, Contract Specialist with the Department of Veterans Affairs National Cemetery Administration, at daniel.kinney@va.gov or 402-830-4683, or contact the U.S. Department of Labor's Wage and Hour Division at 1-866-487-9243.
