Department of Homeland Security United States Coast Guard

Request for Proposal

Indefinite Delivery-Indefinite Quantity Nationwide Tower/Antenna Multiple Award Construction Contract

(IDIQ-TMACC)

Solicitation No.: 70Z08822RESDV0001

NOTICE FOR FILING AGENCY PROTESTS

United States Coast Guard Ombudsman Program

It is the policy of the Coast Guard to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the General Accounting Office (GAO).

Interested parties are encouraged to seek resolution of their concerns within USCG as an Alternative Dispute Resolution (ADR) forum, rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the Contracting Officer or Ombudsman.

Informal forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer. If the Contracting Officer is unable to satisfy the concerns, the interested parties are encouraged to contact the Coast U.S. Coast Guard Ombudsman for Agency Protests.

Under this informal process, the agency is not required to suspend contract award performance.

Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable).

Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions. If the protester’s concerns are unresolved, an independent review is available by the Ombudsman. The protester may file a formal agency protest either to the Contracting Officer or as an alternative to that, the Ombudsman under the OPAP program.

Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth at FAR 33.103(d) (2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. To be timely, protests must be filed within the period specified in FAR 33.103(e). Formal protests filed under the OPAP program should be submitted electronically to OPAP@uscg.mil and the Contracting Officer to Travis.Cohen@uscg.mil or by hand delivery to the Contracting Officer.

Election of Forum. After an interested party protests a Coast Guard procurement to the Contracting Officer or the Ombudsman, and while the protest is pending, the protestor agrees not to file a protest with the GAO or other external forum. If the protest is file with an external forum, the agency protest will be dismissed.

SOLICITATION INTENTIONS

This announcement constitutes the only solicitation. The solicitation number is 70Z08822RESDV0001. The solicitation is issued as a Request for Proposal (RFP) and the solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2022-04. The North American Industry Classification System (NAICS) for this acquisition is 237130 Power and Communication Line and Related Structures. The size standard is $39.5 million.

The purpose of this contract solicitation is to solicit a Tower/Antenna Multiple-Award Construction Contract (TMACC). The TMACC contracts will meet a majority of the USCG tower and antenna construction, maintenance, rehabilitation, demolition, inspection, and repairs with a value below $3M within the 50 United States and its territories. Initial contracts will be competitively solicited and awarded nationally. Task orders will range from a minimum task order value of $3,500 dollars to a maximum task order value of $3 million dollars. Orders will be solicited on a competitive basis among the TMACC firms unless an authorized exception applies.

The contracts offer a streamlined approach to construction contracting and ongoing competition between qualified contractors. Awards will be restricted to small business set-aside firms. All qualified small business firms can compete.

The U.S. Coast Guard intends to award up to seven (7) Indefinite Delivery Indefinite Quantity (IDIQ) Nationwide Tower/Antenna Multiple Award Construction Contracts (TMACCs). The terms and ordering procedures of each contract will be uniform among the IDIQ contracts and consistent with ordering procedures in FAR 16.505.

Each of the IDIQ contracts will include a base year plus four one-year options (five-year total).

Task order limits will range from $3,500 to a maximum task order value of $3 million. The minimum guarantee for each individual contract will be $1,000. The anticipated aggregate capacity for the seven new national TMACC contracts is $24.9 million dollars. Contract awardees will be eligible to compete for TMACC task orders at various USCG Districts in locations nationwide. A map of the Coast Guard Districts has been provided below. Ordering authority will be available to any United States Coast Guard component with appropriate warrant authority. However, task orders will primarily be awarded and administered by the Coast Guard’s Civil Engineering Units (CEUs).

The contract awardees under this procurement shall be able to provide all necessary personnel, facilities, equipment, and materials for multiple and concurrent task orders across the United States and its territories. Firms shall ensure that all activities performed by its personnel, subcontractors and suppliers are executed as required in compliance with all applicable environmental and safety laws and regulations and will meet all relevant, appropriate, and applicable standards. Specific requirements will be detailed in each task order general requirements, specifications, and drawings.

The description of these requirements will vary for each Task Order dependent upon the needs of the requiring entity.

In order to be selected for award, offerors will be required to submit an electronic proposal consistent with the requirements of Section L of the solicitation. It is the offerors’ responsibility to insure their proposal meets all of the requirements stated in Section L of the solicitation.

Failure to provide all necessary information may result in a proposal being rejected or not receiving full consideration since the Government reserves the right to award a contract based upon initial proposals and without negotiations.

As stated in Section M of this solicitation, the Government intends to award a maximum of seven contracts, but reserves the right to adjust the number of contract awards or make no award at all.

The Government intends to make multiple awards of this tower multiple-award construction contracts for one base year with four one-year option periods.

Consistent with FAR 15.305(a) (2) past performance will be an important part of the evaluation.

Offerors shall be provided the opportunity to identify past or current contracts for efforts similar to the Government requirements. Offerors should provide the submission of information as required by Section L.11 -Electronic Proposal Submission in DoD SAFE.

All questions will be directed to the Contracting Officer, Travis Cohen, at (510) 637-5589, email: Travis.Cohen@uscg.mil and Contract Specialist, Denver Johnson, at (510) 332-9635, email: Denver.L.Johnson@uscg.mil.

The Government shall give the Contractor a preliminary written notice of its intent to extend before the contract expires. The preliminary notice does not commit the Government to an extension. The total duration of this contract, including the exercise of any options shall not exceed five (5) years.

F.3 FAIR OPPORTUNITY PROCEDURES

1. This contract provides for the issuance of task orders in accordance with FAR 16.505 (b).

a. A task order is the contractual instrument issued by the Government to the Contractor to order work. The task order is issued upon agreement between the Government and the Contractor on the scope of work, performance time, and the fixed price for the work.

Each individual task order becomes a fixed priced lump sum contract. Order for Supplies or Services Form, OF 347, will be issued for each task order. Task Orders will be mailed, emailed, or faxed, whichever is more expeditious. The Government reserves the right to issue task orders unilaterally if prior negotiated agreement to the terms of that order cannot be reached before the date that the Contracting Officer determines that prosecution of work must begin.

b. The Contracting Officer will provide each awardee a fair opportunity to be considered for each order over minimum order amount issued under the IDIQ except as provided for in FAR 16.505 (b)(2). When a Purchase Request is received identifying a requirement under this contract, a Task Order-Request for Proposal (TO-RFP) will be sent to each awardee, except for emergency work which may be ordered on a sole source basis.

Each Task Order will be awarded based upon on either “Price Only” or “Best Value” process depending upon the needs of the Government at the time the TO-RFP is issued. The TO-RFP will state the basis for award. If the Trade Off process is utilized the TO-RFP will advise as to the specific evaluation criteria pertaining to that Task Order.

c. Each Task Order (TO) will include the following information:

i. Date of order;

ii. Contract number and order number;

iii. Type of Contract;

iv. Scope of work as defined by paragraph F.4.(a);

v. Delivery or performance date;

vi. Place of delivery or performance;

vii. Packaging, packing, and shipping instructions;

viii. Accounting and appropriation data;

ix. Bonding requirements;

x. Insurance and Wage Determination

xi. Any other pertinent information; and,

xii. Method of payment and payment office

d. All task orders are subject to the terms and condition of the IDIQ contract. However, in the event of a conflict between a task order and this contract, the task order statement of work shall take precedence.

e. Issuance of a Task Order by the Contracting Officer indicates the Government’s acceptance of the offeror’s proposal within the terms and limits of the firm’s IDIQ contract.

f. Task Orders issued under this contract must be placed in writing.

g. Emergency work may be orally directed on a unilateral basis (and followed-up in writing) or may be competed with other offerors. If the emergent work is competed then proposals will be due within 5 calendar days after issuance of the RFP. It may also be competed with offeror’s proposals due within five calendar days after the Request for Proposal is issued. The method for executing emergent work will be at the Contracting Officer’s discretion.

An accelerated task order may be initiated orally in urgent situations determined by the Contracting Officer. An accelerated task order may be issued unilaterally by the Contracting Officer. Upon receipt of this accelerated task order notification, the Contractor shall:

(i) Within one (1) calendar day, the Contractor may visit the proposed work site in the company of the Contracting Officer or his authorized representative.

(ii) Within two (2) calendar days from the date of the site visit, submit to the Contracting Officer a detailed cost proposal.

h. When awarding emergency response contracts during the term of a major disaster or emergency declaration by the President of the United States under the authority of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5120, et seq.), preference shall be given, to the extent feasible and practicable, to local firms.

Preference may be given through a local area set-aside or an evaluation preference.

i. The Contracting Officer may set aside solicitations to allow only local firms within a specific geographic area to compete (see FAR 6.208). The contracting officer, in consultation with the requirements office, shall define the specific geographic area for the local set-aside. A major disaster or emergency area may span counties in several contiguous States. The set-aside area need not include all the counties in the declared disaster/emergency area(s), but cannot go outside it.

j. Modifications to task orders may be required. Modifications are issued pursuant to specific standard clauses contained in the basic contract. If a modification to a task order is required, the Contractor shall submit a detailed cost proposal in accordance with the following clause:

“MODIFICATION PROPOSALS--PRICE BREAKDOWN

(a) The Contractor shall furnish a price breakdown, itemized as required and within the time specified by the Contracting Officer, with any proposal for a contract modification.

(b) The price breakdown—

(1) Must include sufficient detail to permit an analysis of profit, and of all costs for—

(i) Material;

(ii) Labor;

(iii) Equipment;

(iv) Subcontracts; and

(v) Overhead; and

(2) Must cover all work involved in the modification, whether the work was deleted, added, or changed.

(c) The Contractor shall provide similar price breakdowns to support any amounts claimed for subcontracts.

(d) The Contractor's proposal shall include a justification for any time extension proposed.”

F.4 PROJECT SCOPING AND PROPOSAL PROCEDURES

(a) Consistent with FAR 16.505(b) each awardee will be provided a fair opportunity to be considered for each order exceeding the minimum order, except as outlined at FAR 16.505(b) (2). The Contracting Officer reserves the discretion to determine the submission requirements for each task order. Each request for proposal will clearly outline the proposal requirements and evaluation criteria. The Contracting Officer may elect to use the appropriate evaluation scheme depending on the complexity of the subject task order. The following procedures may be used:

(1) Price proposal only. For simple work requirements, awards will be made to the lowest priced proposal.

(2) Price proposal and past performance. For work that is slightly more complex and where work requirements are well defined, past performance may be evaluated. The Government will reserve the right to make a technical price trade-off and may elect to award to a higher priced proposal where the proven past performance justifies this trade-off.

(3) Oral presentations and/or technical proposal. Complex work where the requirements are not as well defined, past performance will be evaluated along with the Contractor’s proposal. Government reserves the right to make a technical price tradeoff and to award to other than lowest priced proposal.

(b) In most circumstances, the Contractors shall be provided with a general scope of work, and/or drawings, and/or specifications. The Contractor may be required to provide a design as part of a task order submittal.

(c) Upon receipt of a task order request for proposals/task order announcement, the Contractor shall:

(1) If necessary, visit the proposed work site in the company of the Contracting Officer or his authorized representative. Establish, clarify, and define the scope of work of the individual requirement to prepare a detailed cost proposal.

(2) Within the time period established in the Request for Proposal the Contractor shall submit a priced proposal, supported when appropriate by necessary documentation, to indicate that adequate planning to accomplish the requirement has been done. Examples of documentation that might reasonably expected would include shop drawings, catalog cuts, required submittals, or as otherwise required by the Contracting Officer.

(d) Upon receipt of the Contractors’ proposal, the Government will review the proposal for completeness. The Government may enter into dialogue with the competing Offerors to clarify any discrepancies or inconsistencies in the proposal prior to making an award decision. The Government may also engage in further discussions, to include bargaining, to clarify the work requirements or the proposed price. Award shall be acknowledged by the issuance of a task order to the successful offeror.
