About this file
This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for a sole source acquisition of Pelco security cameras and related equipment for the VA New York Harbor Healthcare Medical Center (VANYHMC).
The J&A states that the existing camera system at the VANYHMC facility is comprised of Pelco products, which need to be standardized for maintenance and integration purposes. The new Pelco security camera system, including approximately 25 cameras, will be installed at the facility's loading dock area to monitor and record access. The estimated value of the procurement is $45,000 with a 60-month period of performance. The J&A cites the statutory authority under 41 USC 3304(a)(1) and FAR 6.302-1 for other than full and open competition, noting the need to maintain the existing Pelco system for efficiency and uniformity. The contracting officer has determined the anticipated cost to be fair and reasonable based on the competitive Request for Proposal process.

DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval (J&A) For
Other Than Full and Open Competition
1. Contracting Activity: Department of Veterans Affairs, Office of Construction and Facilities
Management-Eastern Region (003C4C), 425 I Street, NW Washington DC 20001
2. Nature and/or description of the Action Being Processed: This sole source justification for a brand name comes as a result of a VA New York Harbor Healthcare Medical Center (VANYHMC) requirement for a firm fixed priced delivery order to the CD Refresh Project. This purchase serves to standardize Pelco and shall include installation, materials, parts, software, labor and certifications. These Pelco Security Cameras shall be installed, made operational, and integrated with the existing VAHNYMC camera system.
3. Description of Supplies: Pelco Secuity Camera devices is comprised of an IP network-based video camera and head-end equipment for viewing, recording and playback of security video.
The head-end equipment will be located in Security Room 0258E to ensure access is restricted to authorized Medical Center staff. Cameras are located around the Loading Dock Area of the building per the previously approved locations of the Phase 2A drawings. The Pelco camera system will provide monitoring and recording of all who enter or exit the Loading Dock and areas where controlled products will be stored, processed, and handled. Intrusion devices will be added as part of the existing building security system. The newly installed system will include roughly 25 cameras with an estimated cost of $45,000. The estimated delivery period of performance is 60 months.
4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(1), as implemented by FAR 6.302-1.
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Throughout the Manhattan VA facility the existing camera system is comprised of Pelco line of products. This system is able to be monitored and controlled from the buildings main security office in the VANYHMC police station. It will be cost-effective in terms of maintenance and service;
VANYHMC will not require different maintenance contracts for every security system installed at the hospital. In addition, it will maintain the efficiency and uniformity of cameras specified for use in recent and on-going facility projects. Therefore for the benefit of the Government, it is requested that Pelco line of products shall be specified for the camera system including Notification Appliances and Initiating Devices for the CD Refresh Project by means other than full and open.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as demmed practicable: This procurement will be competed and synopsized on SAM.gov as an Request for Proposal (RFP) and will indicate the requirement for brand name specification for the Pelco devices. Since the construction contract is being awarded as a firm fixed price contract through competitive proposals, the proposers are incentivized to locate the supplier that will provide the item at the most economical price.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and
Reasonable: The Contracting Officer has determined the procurement to be the best value to meet the Government’s needs. The requirement to use Pelco was verified through peer review of the Independent Government Estimate (IGE). The request for proposal (RFP) will seek competition. Proposals received in a competitive environment are considered fair and reasonable to the government based on competition.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons
Market Research Was Not Conducted: Since this is the existing campus wide system and patching in another manufacturer to it is not feasible, no additional market research was conducted and the decision was made to sole source Pelco for this brand name justification.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None, see item
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None.
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:
VANYHMC has considerable investment in its camera system that uses Pelco. There are no plans for any future changes to their camera system which if necessary, would require major changes and considerations to the facility and support including training and familiarity for current employees that use the Pelco equipment. VANYHMC will be continuing with the Pelco line of products for its camera system needs and continuity in patient care, which will be the least costly method of procurement, all considerations (procurement/administrative costs) considered. Efforts will be made to introduce other contractors that have been authorized by Pelco to provide goods and services.
12. Requirements Certification: I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
