LiRo Engineers, Inc. (LiRo) performed a limited hazardous materials inspection of the 10th Floor - West (10W) and limited areas of the ground/first floors potentially impacted by electrical system renovations at the Manhattan VA Medical Center located at 423 East 23rd Street. The purpose of this survey was to develop an inventory of asbestos-containing materials that may be impacted by future renovations. LiRo performed the survey on March 4, 2020, and a follow up inspection on June 29, 2020 which was based on this scope of work given to us by Commander’s Concepts and Commissioning (CCCxA). The results of the inspection are summarized below:

10th floor Materials determined to be asbestos containing materials -o Asphalt Flooring under Black 9x9 Floor Tiles - MDF Closet Platform o Felt Paper/Mastic of Black 9x9 Floor Tiles (Contaminated) - MDF Closet Platform o Black 9x9 Floor Tiles (Contaminated) - MDF Closet Platform o White 12x12 Floor Tile - Corridor o Beige 12x12 Floor Tile (Contaminated) - Corridor o Black Mastic of Gray Bottom Layer Floor Tile – All Rooms o Gray Bottom Layer Floor Tile – All Rooms o Green 12x12 Bottom Layer Floor Tile – All Rooms o Thermal System Insulation (AirCell type) – Pipe Chases and Enclosures

Ground Floor Materials determined to contain asbestos o None, however, spray applied fireproofing in the Warehouse area was determine to contain vermiculite and as a result, pending further testing, is presumed to contain regulated levels of asbestos

Fluorescent light fixtures are located throughout the building and must be treated as universal waste

Fluorescent light ballasts are observed to be non-PCB containing

A second inspection was performed on April 14, 2021 to consider areas likely to be impacted by the proposed routing of electrical system and fire alarm/sprinkler system conduit, and the mounting of related system components. Copies of these system details are provided in Appendix H. Due to insufficient access to the 3rd floor kitchen soffit enclosure, the following materials are assumed to be ACM:

3rd Floor Kitchen Soffit Plaster and Enclosed Duct/Pipe Insulation

Section 4.0 of this report include the details of the inspection for suspected hazards in the survey area. The details of the individual materials, including material locations and descriptions, as well as the laboratory analysis results are included in separate sub-sections thereof. A tabular summary of asbestos survey results is included in Table 4.1 which includes results from previous inspections at the site that identified the following materials as ACM:

4.0 SUMMARY OF INSPECTION RESULTS

4.1 ASBESTOS

Asbestos Guidelines

Guidelines used for the Asbestos inspection were established by the Environmental Protection Agency (EPA) in the Guidance for Controlling Asbestos Containing Materials in Buildings, Office of Pesticides and Toxic Substances, DOC #560/5-85-024, and 40 CFR Part 763, Asbestos Hazard Emergency Response Act (AHERA).

Field information was organized as per the AHERA concept of homogenous area (HA). That is, suspect ACM with similar age, appearance, application, and texture was grouped together, sampled and assessed for condition.

Bulk samples of suspect ACM were analyzed by Polarized Light Microscopy (PLM) with dispersion staining, as described in 40 CFR Part 763 and the National Emissions Standard for Hazardous Air Pollutants (NESHAPS).

The New York State Department of Health has recently revised the PLM Stratified Point Counting Method.

The new method, “Polarized Light Microscopy Methods for Identifying and Quantitating Asbestos in Bulk Samples” can be found as item 198.1 in the ELAP Certification manual.

The State of New York ELAP has determined that analysis of non-friable organically bound materials (NOB’s) and ceiling tiles containing cellulous is not reliably performed by PLM. Therefore, if PLM yields negative results for a non-friable material, it must be confirmed by using Transmission Electron Microscopy (TEM).

All samples were initially analyzed by using Polarized Light Microscopy. Samples which yielded a negative PLM result and which are classified as a “non-friable” material were then re-analyzed utilizing transmission Electron Microscopy methodology.

The presence of vermiculite in surfacing materials has been determined to obfuscate the presence or extent of asbestos within those materials. As such, separate analysis is required for materials containing vermiculite to accurately and completely define the asbestos content, if any, within the material. Homogeneous Areas H and S were analyzed using New York State Department of Health Method 198.8 (SOF-V) which is utilized for surfacing materials containing vermiculite. These materials are confirmed to be Non-ACM.

The asbestos inspection involved a thorough visual examination of all suspect materials within the survey area as direct by facility and DASNY staff. All suspect damaged materials were sampled, quantified, and its locations were recorded by the inspector.

The summary of the Inspection Results are presented in Table 4.1.

4.2 HAZARDOUS WASTE AND UNIVERSAL WASTE

The United States Environmental Protection Agency (USEPA) defines Universal Wastes as batteries, pesticides, mercury-containing equipment and bulbs (lamps). The New York State Department of Environmental Conservation (NYSDEC) defines Universal Wastes similarly to USEPA except they list thermostats instead of mercury-containing equipment.

During our survey, LiRo performed “room to room” observations of the building and identified building components, fixtures and stored items that may be considered a universal waste.

Fluorescent light fixtures are located throughout the building and will be removed during the renovation activities. These light fixtures contain fluorescent bulbs, which must be treated as universal waste and are assumed to have PCB containing ballasts, which upon replacement, require collection, staging and recycling as hazardous waste.

Ballasts were all observed to be non-PCB Containing.

5.0 CONCLUSIONS AND RECOMMENDATIONS

Suspect materials expected to be impacted by renovations to the 10th floor and ground/first floors in connection with possible electrical system upgrades have been determined to contain ACM as identified in Table 4.1.1 above. ACM locations are provided on the site plans in Appendix C. The full extent of Thermal

System Insulation on pipe risers within pipe wet columns, pipe chases, and wet walls can be determined only through partial demolition to expose concealed areas. As indicated in Table 4.1.2 fireproofing material on structural beams was determined to contain vermiculite. In the event that disturbance to the fireproofing in this area is necessary, additional sampling and testing using New York State Department of Health ELAP method 198.8 is recommended to confirm any asbestos content in the fireproofing. We further recommend that a scope specific inspection of the 10th floor and ground/first floor be performed at such time that 100% Construction Drawings are available. Due to insufficient access to the 3rd floor kitchen soffit enclosure, the following materials are assumed to be ACM:

3rd Floor Kitchen Soffit Plaster and Enclosed Duct/Pipe Insulation

Previous inspections have identified the following materials that are ACM but do not appear to be impacted by the scope of work for this project:

Pipe Insulation – AirCell type, friable in soffits, enclosures, wet walls/chases Various 9”x9” and 12”x12” Floor Tiles and Mastic install locally

LiRo recommends the removal of all materials that were determined to be ACM prior to any disturbance following all applicable regulations. Abatement must be performed by a licensed asbestos contractor and all waste generated by the abatement must be disposed of at a landfill permitted to receive asbestos waste.

Note that during abatement activities, we recommend that a third party Asbestos Project Monitor perform oversight and inspections pursuant to ASTM E1368-05, and that area air testing be performed by a certified Asbestos Air Sampling Technician consistent with applicable regulations. In the event that suspect ACM which were not tested as part of this inspection are identified during the construction phase of work or regular maintenance operations, these materials shall be assumed to contain asbestos and tested prior to any disturbance. Any necessary asbestos abatement work shall be performed in accordance with all applicable regulations.

The contractor is advised that the work of the contract may impose certain obligations and requirements mandated by the US Department of Labor Occupational Safety and Health Administration regulations, Title 29 CFR 1926.62 Lead Exposure in Construction, relative to potential exposure to lead by its employees. The contractor assumes entire responsibility and liability for complying fully in all respects with these regulations. Additionally, if the scope of work requires the contractor to scrape loose paint, then the waste generated shall be analyzed for appropriate waste disposal. All workers to contracted and maintenance activities on 10W shall be advised that the building material(s) containing detectable trace levels of asbestos, but less than or equal to 1.0% asbestos, are classified as non-ACM but subject to federal regulations, including those established by OSHA for work involving such non-ACM asbestos trace materials.

Fluorescent light bulbs targeted for replacement must be collected, stored temporarily if necessary, and fated for recycling at a certified recycle facility.

6.0 AREAS NOT ACCESSIBLE

All locations which were reviewed on the drawings and inspected at the development were accessible with the exception of the 3rd floor kitchen and the elevator machine room. If there are any materials in locations which may be impacted and they have not been tested must be assumed to be ACM. All assumed asbestos containing materials may be tested for asbestos content during construction by the environmental consultant at the owner’s request.

PLM Bulk Asbestos Report

Client Name: The Liro Group

RReporting Notes:

*NAD/NSD =no asbestos detected; NA =not analyzed; NA/PS=not analyzed/positive stop, (SOF-V) = Sprayed On Fireproofing containing Vermiculite;

(SM-V) = Surfacing Material containing Vermiculite; PLM Bulk Asbestos Analysis using Olympus, Model BH-2 Pol Scope, Microscope, Serial #: 229003, by Appd E to Subpt E, 40 CFR 763 quantified by either CVES or 400 pt ct as noted for each analysis (NVLAP 200546-0), ELAP PLM Method 198.1 for NY friable samples, which includes the identification and quantitation of vermiculite, or ELAP 198.6 for NOB samples, or EPA 400 pt ct by EPA 600- M4-82-020 (NY ELAP Lab 11480); Note:PLM is not consistently reliable in detecting asbestos in floor coverings and similar non-friable organically bound materials. NAD or Trace results by PLM are inconclusive, TEM is currently the only method that can be used to determine if this material can be considered or treated as non asbestos-containing in NY State (also see EPA Advisory for floor tile, FR 59,146,38970,8/1/94) National Institute of Standards and Technology Accreditation requirements mandate that this report must not be reproduced except in full without the approval of the lab. This PLM report relates ONLY to the items tested. AIHA-LAP, LLC Lab ID 102843, RI Cert AAL-094, CT Cert PH-0186, Mass Cert AA000054, NJ Lab ID #NY031.
