About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for a contract to obtain Hirsch-Identiv Electronics devices for the VA New York Harbor Healthcare Medical Center (VANYHMC).

The J&A states that VANYHMC requires a firm fixed-price delivery order to the CD Refresh project for Hirsch-Identiv Electronics devices, including installation, materials, parts, software, labor, and certifications. This will standardize the Physical Access Control System (PACS), duress/panic alarm, intrusion detection, and contactless card readers across the VANYHMC campus. The estimated cost is $530,000 with a 60-month period of performance. Due to the existing installation of Hirsch-Identiv systems throughout VANYHMC, continuing use of this brand will maintain efficiency, uniformity, and seamless integration, and comply with VA requirements. The procurement will be competed via an RFP to be posted on SAM.gov, with the brand name specification included. No market research was conducted, as integrating another manufacturer is not feasible given the existing system. VANYHMC plans to continue using Hirsch-Identiv Electronics for its physical access control needs.

DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval (J&A) For

Other Than Full and Open Competition

1. Contracting Activity: Department of Veterans Affairs, Office of Construction and Facilities

Management-Eastern Region (003C4C), 425 I Street, NW Washington DC 20001

2. Nature and/or description of the Action Being Processed: This sole source justification for a brand name comes as a result of a VA New York Harbor Healthcare Medical Center (VANYHMC) requirement for a firm fixed priced delivery order to the CD Refresh project. This purchase serves to standardize Hirsch-Identiv Electronics and shall include installation, materials, parts, software, labor and certifications. These Hirsch-Identiv Electronics devices shall be installed, made operational, and integrated with the existing VAHNYMC Physical Access Control Systems.

3. Description of Supplies: The proposed Hirsch-Identiv Electronics devices will consist of Physical

Access Control System (PACS), duress/panic alarm, intrusion detection, and contactless card readers which will be housed in Security Room 0258E, located in the 0275E corridor. Hirsch- Identiv access controls will limit access to persons issued a valid government ID card to only allow them to their permitted rooms or locations. Any person accessing a secured door will be required to use their card credentials to enter a secured door. The estimated cost is $530,000.

The estimated delivery period of performance is 60 months.

4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(1), as implemented by FAR 6.302-1.

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Installed Security PACS throughout previous and on-going projects at VANYHMC are using Hirsch-Identiv Electronics. The Hirsch-Identiv system is able to be monitored and controlled from the buildings main security office in the VANYHMC police station. It will be cost-effective in terms of maintenance and service; VANYHMC will not require different maintenance contracts for every security system installed at the hospital. In addition, continuing with the use of Hirsch-Identiv products will maintain the efficiency and uniformity of physical access controls used throughout the existing security system on the campus and will integrate seamlessly limiting down time or interrupting patient care. Also, this system complies with VA requirements and specifications for Access Control and Security Systems. Therefore for the benefit of the Government, it is requested that Hirsch-Identiv be specified on the new CD Refresh project by means other than full and open competition.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: This procurement will be competed and synopsized on SAM.gov as an Request for Proposal (RFP) and will indicate the requirement for brand name specification for the Hirsch-Identiv Electronics devices. Since the construction contract is being awarded as a firm fixed price contract through competitive proposals, the proposers are incentivized to locate the supplier that will provide the item at the most economical price.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable: The Contracting Officer has determined the procurement to be the best value to meet the Government’s needs. The requirement to use Hirsch-Identiv Electronics was verified through peer review of the Independent Government Estimate (IGE). The request for proposal (RFP) will seek competition. Proposals received in a competitive environment are considered fair and reasonable to the government based on competition

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted: Since this is the existing campus wide system and patching in another manufacturer to it is not feasible, no additional market research was conducted and the decision was made to sole source Hirsch-Identiv Electronics for this brand name justification.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None, see item

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:

VANYHMC has considerable investment in its physical access control system that uses Hirsch- Identiv Electronics. There are no plans for any future changes to their physical access control system network which if necessary, would require major changes and considerations to the facility and support including training and familiarity for current employees that use the Hirsch- Identiv Electronics equipment. VANYHMC will be continuing with the Hirsch-Identiv Electronics line of products for its physical access control system needs and continuity in patient care, which will be the least costly method of procurement, all considerations (procurement/administrative costs) considered. Efforts will be made to introduce other contractors that have been authorized by Hirsch-Identiv Electronics to provide goods and services.

12. Requirements Certification: I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
