About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for a sole source purchase of a TigerFlow Triplex pump and related installation services for the VA NY Harbor Healthcare Medical Center in Manhattan, NY. The requirement is part of a CD Refresh project to standardize the procurement and installation of the TigerFlow Triplex pump, which includes a pre-wired control panel, VFDs, and vibration isolators to reduce noise. The pump will be integrated with the existing domestic water pump system. The estimated cost is $65,000 with a 60-month period of performance. The J&A cites the statutory authority of 41 USC 3304(a)(1) and FAR 6.302-1(c) to support the sole source justification, noting the TigerFlow pump's unique technical capabilities and integration with the existing system. The procurement will be competed through an RFP, with the brand name requirement indicated, to ensure fair and reasonable pricing.

Justification and Approval (J&A) For

Other Than Full and Open Competition

1. Contracting Activity: Department of Veterans Affairs, Office of Construction and Facilities

Management-Eastern Region (003C4C), 425 I Street NW Washington, DC 20001.

2. Nature and/or Description of the Action Being Processed: This sole source justification comes as a result of a VA NY Harbor Healthcare Medical Center (VANYHMC) in Manhattan, NY requirement for a firm fixed priced delivery order to the CD Refresh project. This purchase serves to standardize the procurement of a TigerFlow Triplex pump and includes installation, materials, parts, software, labor and certifications. The TigerFlow Triplex pump shall be installed, made operational, and integrated with the existing VANYHMC domestic water pump system.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: The Tigerflow triplex pump includes a pre-wired control panel and VFD for each pump for easy routine maintenance and installation. Installion of this pump includes but is not limited to: connecting new drain piping, installing a new expansion tank, new shutoff valves, coordination of the interruption of domestic hot and cold-water services with the medical facility, installing new inertia and concrete pads, new pipe insulation, furnishing and installing new gate valves, removal and salvage of existing old VFDs, and demolishing control panels and power for the 3 exisitng pumps. The estimated cost as per A/E Basis of Design Narrative is $65,000. The estimated delivery period of performance is 60 months.

4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(1), as implemented by FAR 6.302-1 (c).

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority: The TIGERFLOW SERIES VMS- 4000-VFD, MODEL TVMV-50GL-C-S8-VM-P-VFD booster pump provides a single source power connection which allows for easy installation. The Tigerflow triplex pump includes a pre-wired control panel and VFD for each pump for easy maintenance. The Tigerflow triplex pumps comes in a packaged skid and vibration isolators which will reduce the noise levels tremendously, providing comfortable working conditions for the facility. The new Tigerflow Series triplex pumps will provide better efficiency and reduce operating costs in the long term. Therefore, for the benefit of the Government, it is requested that the TigerFlow series VMS-4000-VFD, Model TVMV-50GL-C-S8-VM- P-VFD shall be specified for use under the CD Refresh project by means other than full and open.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: This procurement will be competed and synopsized on SAM.gov as an Request for Proposal (RFP) and will indicate the requirement for brand name specification for the TigerFlow Triplex pump. Since the construction contract is being awarded as a firm fixed price contract through competitive proposals, the proposers are incentivized to locate the supplier that will provide the item at the most economical price.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The Contracting Officer has determined the procurement to be the best value to meet the Government’s needs. The requirement to use a TigerFlow Triplex pump was verified through peer review of the Independent Government Estimate (IGE). The request for proposal (RFP) will seek competition. Proposals received in a competitive environment are considered fair and reasonable to the government based on competition.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Due to site specific circumstances and the need to tie into an existing domestic water pump system no additional market research was conducted and the decision was made to sole source TigerFlow for this brand name justification.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None. See Item #5 above.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:

VANYHMC has considerable investment in its existing domestic water pump systems. There are no plans for any future changes to their domestic water pump system which if necessary would require major changes and considerations to the facility and support including training and familiarity for current employees. TigerFlow manufactured equipment is recognzied for its forward life safety priorties and continuity with hospital projects. It will be the least costly method of procurement, all considerations (procurement/administrative costs) taken into account. Efforts will be made to introduce other contractors that have been authorized by TigerFlow to provide goods and services.

12. Requirements Certification: I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
