DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval (J&A) For

Other Than Full and Open Competition

1. Contracting Activity: Department of Veterans Affairs, Office of Construction and Facilities

Management-Eastern Region (003C4C), 425 I Street NW Washington, DC 20001.

2. Nature and/or Description of the Action Being Processed: This sole source justification for a brand name comes as a result of a VA New York Harbor Healthcare Medical Center (VANYHMC) requirement for a firm fixed priced contract delivery order to the CD Refresh project. This purchase serves to standardize Lencore Engineered System Solution and shall include installation, materials, parts, software, labor and certifications. These Lencore Engineered System Solution devices shall be installed, made operational, and integrated with the existing VAHNYMC Audio/Visual (AV) Public Announcement (PA) network.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: Lencore Engineered

System Solution devices consists of a paging (Public Annoncement) System with ceiling mounted Zone Speakers distributerd throughout the CD Refresh project. There are roughly 10 new devices to be installed with a totel estimated cost as per A/E Basis of Design Narrative of $15,000 . The estimated delivery period of performance is 60 months.

4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(1), as implemented by FAR 6.302-1.

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Throughout the Manhattan VA facility the existing Public Announcement (PA) system uses Lencore Engineered System Solution. .

The goal is to have complete and comprehensive integration for cross-communications in one facility-wide enterprise network. Continuing with Lencore products allows end users and maintainers of the network a level of competency that is integral to patient care. Maintainers will will realize cost savings in parts and devices needed to maintain the network when every area is standardized to one system. If VANYHMC was to procure any system other than Lencore Engineered System Solution would require extensive re-cabling, redesign and replacement throughout the entire facility which includes multipe buildings and floors. Any other system procured would require retraining of PA System personnel and engineering staff, as well an additional maintenance contract for every new system installed at the hospital. Also, there will be compatibility and interfacing issues with the current Lencore Engineered System Solution equipment if another brand is used since there no other known vendors who can provide the proprietary operating system software which can integrate with the existing PA network. Therefore, for the benefit of the Government, it is requested that the Lencore Engineered System Solution line of products shall be specified for the Public Announcement (PA) devices including Notification Appliances and Initiating Devices for the CD Refresh Project by means other than full and open.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: This procurement will be competed and synopsized on SAM.gov as an Request for Proposal (RFP) and will indicate the requirement for brand name specification for the Lencore Engineered System Solution devices. Since the construction contract is being awarded as a firm fixed price contract through competitive proposals, the proposers are incentivized to locate the supplier that will provide the item at the most economical price.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable: The Contracting Officer has determined the procurement to be the best value to meet the Government’s needs. The requirement to use Lencore Engineered System Solution was verified through peer review of the Independent Government Estimate (IGE). The request for proposal (RFP) will seek competition. Proposals received in a competitive environment are considered fair and reasonable to the government based on competition.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted: Since this is the existing campus wide system and patching in another manufacturer to it is not feasible, no additional market research was conducted and the decision was made to sole source Lencore Engineered System Solution for this brand name justification.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None. See Item #5 above.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:

VANYHMC has considerable investment in its Public Announcement (PA) system that uses Lencore Engineered System Solution. There are no plans for any future changes to their Public Announcement (PA) system network which if necessary, would require major changes and considerations to the facility and support including training and familiarity for current employees that use the Lencore Engineered System Solution equipment. VANYHMC will be continuing with the Lencore Engineered System Solution line of products for its Public Announcement (PA) system needs and continuity in patient care, which will be the least costly method of procurement, all considerations (procurement/administrative costs) considered. Efforts will be made to introduce other contractors that have been authorized by Lencore Engineered System Solution to provide goods and services.

12. Requirements Certification: I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
