Projects that are within an existing permitted boundary or in close proximity to an existing permit, should modify an existing permit. Projects that are stand alone should be permitted individually.

4. Topographic Survey: Prior to starting work, contractor is responsible to physically verify the location of all existing utilities and obtain survey data required to provide final design. CAD files of Existing Contours AutoCAD Drawings will be provided by Government for reference.

B. PART 3 PROJECT PROGRAM

1. PART 3.0, GENERAL (ALL MILCONS)

a. CHAPTER 2 – Part 2.3.1

1) AE2 is not responsible for generating the required documentation for Item 2-7.1, Address Climate Change Risk. Due to the nature of the Design/Build process in place, Item 2-7.1 is considered complete based on the efforts of the Government and AE1 during the discussions and development of the RFP. Climate change risks were considered throughout the development of the RFP and therefore do not need to be re-evaluated as part of AE2’s scope.

b. CHAPTER 3 – Part 3.1, 3.1.2.6

1) Stormwater Control Measures (SCM): MCB Camp Lejeune prefers wet ponds, bioretention and/or infiltration basins. As in RFP, the goal is to provide functioning and compliant devices which are not maintenance intensive, nor require specialized or propriety materials. Sand filters should be used with caution due to past experiences. If infiltration basins are to be used, heavy equipment in the bottom will not be allowed due to risk of compaction.

c. CHAPTER 3 – Part 3.1 STORM DRAINAGE SYSTEM

1) The RFP describes the goal and challenges of providing SCM devices at these sites. In response to PPI, additional clarification is provided that MCB Camp Lejeune prefers wet ponds, bioretention and/or infiltration basins. Again, the goal is to provide functioning and compliant devices which are not maintenance intensive, nor require specialized or propriety materials. Sand filters should be used with caution due to past experiences. If infiltration basins are to be used, heavy equipment in the bottom will not be allowed due to risk of compaction.

2) Refer to attached Stormwater Permit attachments

i. SW NPDES Permit NCS000290, March 14, 2016

ii. MCB Final Stormwater Master Plan at Hadnot Point Areas 100 and 200, March 2012

iv. NC SW Permit SW8 081015 for Wallace Creek Regimental Complex, January 17, 2018

d. CHAPTER 3, PART 6

1) Space Tabulation and HVAC System: The Government finds the amount of space available to be more than adequate to meet the requirements of the RFP. Space reductions are not seen as necessary and no space reduction priorities will be provided. HVAC equipment selection must not be changed. It has been determined by LCCA and many other factors. Any adjustments to HVAC equipment will adversely impact the Government and cannot be accepted

2) Flood Plane Criteria: All MILCONs to meet ASCE 24-14 and UFC 3-201-01.

Where discrepancies occur, the more stringent requirement is to be followed.

e. CHAPTER 3 – ESR B20 EXTERIOR ENCLOSURE

1) Contractor is required to meet minimum building envelope insulation requirements of UFC 3-101-01, Architecture. Exceeding RFP requirements will not be considered as a betterment, strength or additional considerations by offers.

2) Windows are required in rooms of regularly occupied spaces located on exterior walls except where noted as "Not Permitted.

f. CHAPTER 6 – ESR D20, D202003

The following sentences can be deleted from D202003 ALL MILCONS: “Provide strainers on RPZ back flow preventers. Provide a testable double check back flow preventer on the building domestic water service unless otherwise noted in the scope of work.” Section D20 should be made consistent with D40 as noted below.

2. BASIS FOR AWARD

2.1 The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with offerors in the competitive range; and to award the contract to the offeror submitting the proposal determined to represent the best value—the proposal most advantageous to the Government, price and other factors considered.

2.2 The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In addition, if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

2.3 The tradeoff process is selected as appropriate for this acquisition. The Government considers it to be in in its best interest to allow consideration of award to other than the lowest priced offeror or other than the highest technically rated offeror.

2.4 Factors 1-3 will be evaluated in Phase I and Factors 4-6 will be evaluated in Phase II. Factor 1 will only be rated Acceptable or Unacceptable. If an offeror is rated Unacceptable in Factor 1, then they will not be considered for Phase II unless corrected through discussions. In making the best value award decision after Phase II, the Government will consider Factors 2-6 and price. The relative order of importance of the non-price evaluation factors is that technical factors (Factors 2, 4, 5, and 6) are equal to each other and, when combined, are of equal importance to the performance confidence assessment (Factor 3). All technical factors and the performance confidence assessment (past performance) rating, when combined, are significantly more important than price.

2.5 Any proposal found to have a Deficiency in meeting the stated solicitation requirements or performance objectives will be considered ineligible for award, unless the Deficiency is corrected through discussions. Proposals may be found to have either a Significant Weakness or multiple Weaknesses that impact either the individual factor rating or the overall rating for the proposal. The evaluation report must document the evaluation board’s assessment of the identified Significant Weakness(s) and/or Weakness(s) and the associated risk to successful contract performance . This assessment must provide the rationale for proceeding to award without discussions.

3. EVALUATIONS FOR AWARD

3.1 The solicitation requires the evaluation of price and the following non-price factors:

PHASE I

Factor 1 – Technical Approach Factor 2 – Experience

Factor 3 – Past Performance

PHASE II

Factor 4 – Technical Solution Factor 5 – Project Management Approach Factor 6 – Small Business Utilization

The distinction between Experience and Past Performance is that Experience pertains to the types of work and volume of work completed by a contractor that are comparable to the types of work covered by this requirement, in terms of size, scope, and complexity. Past Performance pertains to both the relevance of recent efforts and how well a contractor has performed on the contracts.

Factors 1-3 will be evaluated in Phase I and Factors 4-6 will be evaluated in Phase II.

After evaluating Phase I proposals, the source selection authority shall select the most highly qualified offerors and request that only those offerors submit Phase II proposals. In accordance with FAR 36.303-1(a)(4), the solicitation shall state that a maximum of three offerors will be selected to submit Phase II proposals unless the Government determines that a number greater than three is in the Government’s best interest.

The importance of price will increase if the Offerors’ non-price proposals are considered essentially equal in terms of overall quality, or if price is so high as to significantly diminish the value of a non-price proposal’s superiority to the Government. Award will be made to the responsible Offeror whose offer conforms to the solicitation and represents the best value to the Government, price and non-price factors considered.

3.2 Basis of Evaluation and Submittal Requirements for Each Factor.

a. Price & Factor 6: PHASE II
