About this file
This notice solicits proposals for a design-build construction contract to complete eight military construction projects at Marine Corps Base Camp Lejeune as part of Hurricane Florence recovery efforts. The projects include construction of headquarters facilities, battalion buildings, and a MEU building. The total value of the contract is estimated between $100-250 million and proposals are due by November 8, 2019. A single award will be made for a fixed-price contract with an anticipated completion date of 1,826 calendar days following award by July 20, 2020. The solicitation is unrestricted and will utilize a two-phase evaluation including non-price factors of technical approach, experience, past performance, safety, technical solution, project management, and small business participation, as well as price. The contracting agency is the Naval Facilities Engineering Command Mid-Atlantic.

Section 00 21 16 ‐ Instructions to Proposers;
Paragraph 3;
Evaluation Factors for Award; Factor 2 –Experience:
Additional requirements for relevant projects indicate “At least one project meeting the Size/Scope/Complexity requirements shall have a final construction cost of $125,000,000 or greater. This project may include a single facility or multiple facilities, as long as one of the facilities in the project meets the Size/Scope/Complexity requirements” Procurement agencies must state requirements in a manner that will allow for the broadest field of competition within the minimum needs required. When requirements are stated in a manner that exceeds the procuring agency’s actual needs, competition is considered to be restricted.
The requirement to demonstrate experience on one project with a final construction cost of $125,000,000.00 remains. This solicitation will result in a single contract award to one offeror where the total value of the contract is anticipate to exceed $125,000,000.00.

5 (cont) Because none of the Projects listed within the RFP approach anywhere near $125 million and an awardee will have five (5) years to perform all backlog within the package while not having to perform all projects concurrently, this requirement has no rational basis and appears to be unduly restrictive of full and open competition (unnecessarily excluding many strong and capable regional contractors). While it is understood that the government has stated this requirement in furtherance of a need to procure services from a contractor that has financial strength and ability to successfully perform a large amount of backlog, there are alternative evaluative factors that would be rationally based and relevant to the subject procurement and would not run afoul of full and open competition. For example, the agency could instead require bidders to do one or both of the following: 1) demonstrate a minimum aggregate bonding capacity of $225 million (the high end of the government’s DB Budget for the package), and/or
2) demonstrate having performed at least a total of $225 million in federal government construction contracts over the last five (5) years.
The requirement to demonstrate experience on one project with a final construction cost of $125,000,000.00 remains. This solicitation will result in a single contract award to one offeror where the total value of the contract is anticipate to exceed $125,000,000.00.
See Amendment 0003.
5 (cont) To avoid an unreasonable restriction on competition, we recommend that NAVFAC lower the single project size requirement from the stated $125mil to something at or about $30 million (which would be closer to the value of the largest project within the package), and in lieu of the $125 million requirement, add the more rationally based requirements provided in the examples above.
The requirement to demonstrate experience on one project with a final construction cost of $125,000,000.00 remains. This solicitation will result in a single contract award to one offeror where the total value of the contract is anticipate to exceed $125,000,000.00.

6 10/18/2019 13 (b) (1) The RFP states “the offeror shall submit one (1) original, marked “Original”, one CD ROM, and eight (8) copies, marked “Copy”, however 13A on the SF1442 states “Sealed offers in original and 9 copies”. Please clarify if 8 or 9 proposal copies will be required.
Offerors shall submit one (1) original, marked "Original", one CD ROM, and nine (9) copies, marked "Copy."
7 10/18/2019 14 00 21 00 If the Offeror has a Past Performance Questionnaire (PPQ) on file previously completed by the Client that matches all fields of the required Attachment F, may this be submitted in lieu of requesting a new PPQ specific to this solicitation?
Offerors are permitted to submit copies of previously completed PPQs.
See Amendment 0003.
8 10/18/2019 Solicitation Instruction ‐ Factor 2
During the industry day it was mentioned that under normal circumstances these buildings would be solicited individually. However, due to time and available contracting resources five buildings have been bundled into one single solicitation. Given that it is uncommon for this many non‐adjacent structures to be solicited together, it is unreasonable that the government would expect contractors to have similar previous performance of this magnitude ($125M). A magnitude of $100M would be reasonable given the stated range of each building($25M‐100M) or the government should allow contractors to demonstrate relevant magnitude by showing that they completed several large projects in parallel. We kindly request that the government remove the unreasonable requirement which needlessly reduces competition and replaces it with a lower ($100M) threshold or allow projects completed concurrently above $50M each to counted towards the ($125M) requirement.
The requirement to demonstrate experience on one project with a final construction cost of $125,000,000.00 remains. This solicitation will result in a single contract award to one offeror where the total value of the contract is anticipate to exceed $125,000,000.00.

9 10/23/2019 N/A N/A N/A Please provide a definition of “Design to Budget”. Please clarify if the intent is (A) Fixed price specified by the Government where the Offeror will fill out the bid form with 100% of the Design to Budget for each MILCON or
(B) the Design to Budget is a Not To Exceed amount for each MILCON and the expectation is the Offeror is to evaluate the scope of each MILCON and provide a firm fixed price equal to or less than the Design to Budget for each MILCON.
Please Note: If Option B is selected, a minimum 90‐day response time will be required for Phase II and a hefty stipend provided for Phase II respondents.
For this solicitiaton, NAVFAC is using the term "Design to Budget" to mean the amount of funds that are available for construction of the specific project. The expectation for the Price Proposal in Phase II is that the offeror will evaluate the scope and provide a separate price for each of the projects within the package as a firm fixed price. Also, the Design to Budget is not a Not To Exceed amount but rather is provided for information on the Government's expectations of the scope concerning both cost and quality.
10 10/23/2019 N/A N/A N/A Please provide the “Design To Budgets” in phase 1 for each MILCON with basic parameters so Teams can make a determination if budgets are adequate before expending efforts for Phase 1.
Design to Budgets will be provided in Phase 2. RFP Packages will not be developed with sufficient fidelity to provide Design to Budgets during the Phase 1 solicitation period.
11 10/23/2019 N/A N/A N/A Please explain what information will be provided in Phase II as part of the AE1 RFP Packages. Will bridging design level information be provided with programmatic drawings or will only narratives be provided?
The Government's intent is to provide in the Phase II RFP Package, at a minimum, adjacencies, room requirements, minimal site information, and narratives.

N/A RFP Section 00 21 00 indicates, “The Design to Budget will be included in the Phase II Amendment.” Please clarify what is meant by “The Design to Budget”. Per a Hurricane Florence Industry Day, is it the Government's intent to provide a simple Construction Cost Limitation (CCL) for each project?
For this solicitiaton, NAVFAC is using the term "Design to Budget" to mean the amount of funds that are available for construction of the specific project. The expectation for the Price Proposal in Phase II is that the offeror will evaluate the scope and provide a separate price for each of the projects within the package as a firm fixed price. Also, the Design to Budget is not a Not To Exceed amount but rather is provided for information on the Government's expectations of the scope concerning both cost and quality.

N/A RFP Section 00 21 16, Factor 2, (a) Solicitation Submittal Requirements indicates for Design Experience that offerors are to submit “…relevant design projects for the Designer of Record(s)…”. Referencing Attachment C ‐ Design Experience Project Data Sheet, please confirm for a Design Experience project to be considered relevant, it must have the box checked for “Designer of Record” under Box 8. Design Project: Type of Contract/Task Order.
As long as the proposed design propject meets the defined Size, Scope, and Complexity requirements and is compliant with requirements of Factor 2; the proposed Designer(s) of Record does not have to have been the Designer of Record on a proposed project for it to be considered Relevant.
