About this file
This document is a response to a revision request from the Arizona Department of Corrections, Rehabilitation and Reentry (ADCRR) regarding an Electronic Payment Transaction Processing Services contract (BPM 005375) submitted by Keefe Group. The RFP requires all equipment and services to be installed, operational, and ready for final integration testing by November 30, 2023, with payment transaction services commencing no sooner than December 31, 2023, and no later than January 1, 2024, which serves as the contract's effective date. More precise schedule requirements were to be communicated to the contractor at a later date. Keefe affirms its ability to meet this timeline as an incumbent state vendor with no service downtime anticipated during implementation.
Keefe addressed three primary revision requests from ADCRR. First, Keefe acknowledged compliance with the schedule requirements outlined in Section 4.3. Second, regarding Section 4.4 (Utilization of Contractor's Services), Keefe accepted ADCRR's terms clarifying that service usage is at the public's discretion and that ADCRR makes no guarantees concerning transaction volume or revenue. Keefe acknowledged that any assumptions regarding transaction fee collections and usage patterns are made solely at the contractor's risk. Third, concerning Section 4.5.4.1.5 (Penetration Testing), Keefe provided additional detail on its security measures, noting that a third-party conducts annual system testing with findings documented in report summaries, and offered to provide the latest Sikich penetration testing report upon request. Keefe also clarified that it does not authorize customer penetration testing of its systems.

KEEFE RESPONSE TO REQUEST FOR REVISIONS
Keefe Response: Please see the following for Keefe’s response to ADCRR’s Request for Revisions.
1. Schedule (Section 4.3)
Keefe’s response did not address this section. Please acknowledge your understanding of this section and state your agreement and compliance with this requirement.
Original Section from RFP:
4.3. SCHEDULE: All equipment and services are to be installed, operational, and ready for final integration testing with ADCRR’s system no later than Thursday, November 30, 2023. All payment transaction services for public use are to begin no sooner than Sunday, December 31, 2023, and no later than Monday, January 1, 2024 (which will be the Effective Date of any resultant contract); more precise schedule requirements will be communicated to Contractor(s) at a later date. Offeror should clearly state whether it can meet this schedule.
Any Offeror unable or unwilling to accept this schedule may be determined not susceptible for award.
Keefe Response: Keefe has read, understands, and shall comply with this Subsection.
As a current vendor for the State, Keefe can meet the schedule as required in 4.3. There would be no downtime for services.
2. Utilization of Contractor’s Services (Section 4.4)
Keefe’s response did not address this section. Please acknowledge your understanding of this section and state your agreement and compliance with this requirement.
4.4. UTILIZATION OF CONTRACTOR’S SERVICES: Use of Contractor’s services is at the discretion of the public at large. ADCRR makes no representation or guarantee of any kind concerning the public’s use of Contractor’s payment transaction services, and Contractor shall have no recourse against ADCRR regardless of the extent to which actual public usage may deviate from what Contractor may have contemplated or expected. Any presumptions or plans made by Contractor regarding the amount and/or timing of transaction fees it will collect from the public under any resultant contract are made solely at Contractor’s risk. Offeror should acknowledge it has read and agrees with this Section 4.4. Any Offeror unable or unwilling to accept these terms shall be determined not susceptible for award.
Keefe Response: Keefe has read, understands, and shall comply with Subsection 4.4.
Keefe accepts these terms as written.

3. Penetration Testing (Section 4.5.4.1.5) Keefe’s response does not provide the requested level of detail intended on this testing. As offered in your proposal, please submit a summary of the latest third-party test report and/or provide additional details on how your protection and recovery systems operate and other requested details.
Keefe Response: Keefe has read, understands, and shall comply with this Subsection.
In Keefe’s original response, the below was stated:
A third-party tests our system annually. A summary of that report can be provided upon request. Keefe responds to all findings and those efforts are noted in the report summary. Keefe does not authorize our customers penetration testing our system.
Please see the attached information from Sikich about penetration testing and its findings.
