About this file

This document is an addendum to FAR 52.212-2 establishing the evaluation criteria and quote requirements for a commercial products and services acquisition under FAR Part 12. The Government intends to award a firm fixed price (FFP) contract to the quoter whose quote provides the best value based on two evaluation factors: (1) Technical Approach and (2) Price. Quoters must meet all solicitation requirements, including terms, conditions, technical specifications, and pricing instructions, or risk removal from further consideration. The technical evaluation will assess compliance with the Performance Work Statement (PWS) requirements, specifically paragraphs 2.1 Objective 1 (Tasks 1-3) and 2.2 Objective 2 (Tasks 1-2) for a proposed web-based solution, with ratings assigned as either "Acceptable" (meets requirements) or "Unacceptable" (does not meet requirements).

Price evaluation will be conducted separately from technical factors, with the Government establishing a total evaluated price based on the sum of all quoted prices across all CLINs identified in Attachment 5 – Pricing. Each CLIN will be evaluated separately for reasonableness under FAR 12.204 and applicable DFARS Part 212 class deviations. Quoters must submit complete pricing for the base period and all option periods; incomplete pricing may result in rejection. The Government will evaluate offers by adding base period pricing to all option period pricing and may reject offers with significantly unbalanced option prices. FAR 52.217-8 allows the Government to extend services at contract rates (adjustable only by prevailing labor rate revisions) for up to six months total, with the option price evaluated using final year proposed pricing and exercisable within 15 days of contract expiration. Additionally, the Government reserves the right to test ICT items for Section 508 conformance claims; quoters may be ineligible for award if proposed ICT products or services are not Section 508 compliant.

FAR 52.212-2, ADDENDUM to EVALUATION OF COMMERCIAL PRODUCTS AND

COMMERCIAL SERVICES (FEB 2026)

1. QUOTE EVALUATION:

To be eligible to receive a contract, Quoter’s are required to meet all solicitation requirements, such as terms and conditions, and technical and pricing instructions. Failure to comply with all solicitation requirements and instructions may result in the Quoter being removed from further contract consideration.

The Government intends to award a firm fixed price (FFP) contract resulting from this solicitation to the Quoter whose quote provides the best value to the Government in accordance with Federal Acquisition Regulation (FAR) Part 12 (Acquisition of Commercial Products and Commercial Services). To make the award decision, the Government will consider two evaluation factors: (1) Technical approach, and (2) Price.

Note: Section 508 Acceptance:

1. Prior to acceptance, the Government reserves the right to perform testing on required ICT items to validate the Quoter’s Section 508 conformance claims. If the government determines that Section 508 conformance claims provided by the Quoter represents a higher level of conformance than what is actually provided to the agency, the government shall, at its option, require the Quoter to remediate the item to align with the Quoter’s original Section 508 conformance claims prior to acceptance.

2. Quoter may be ineligible for contract award if proposed ICT products or services are not compliant with Section 508 standards.

2. EVALUATION CRITERIA:

Basis for Award: A FFP award will be made on a competitive best value basis. Evaluations will be conducted in accordance with the evaluation criteria below:

1. Factor 1 – Technical Approach

The Government will evaluate the technical capability of each quote by reviewing the extent to which the proposed solution demonstrates compliance with the requirements of the Performance Work Statement (PWS). As part of this assessment, the Government will evaluate each Quoter’s proposed web-based solution for compliance with the requirements outlined in paragraphs 2.1 Objective 1; Task 1 (2.1.1); Task 2 (2.1.2); Task 3 (2.1.3); 2.2 (Objective #2), Task 1 (2.2.1) and Task 2 (2.2.2) of the Performance Work Statement (PWS).

Attachment 4

The ratings used for Factor 1 are defined as follows

Adjectival Rating Description Acceptable Quote meets the requirements of the solicitation Unacceptable Quote does not meet the requirements of the solicitation

2. Factor 2 – Price

Price will be evaluated separately from technical factors. Quoter’s total quoted price will be evaluated for reasonableness in accordance with FAR 12.204 and applicable DFARS Part 212 class deviations. The Government will establish a total evaluated price based on the sum of all prices quoted. The Government may use one or more price analysis techniques. Incomplete pricing submissions may result in rejection.

Quoter shall complete the pricing information on all CLINs identified under this solicitation in Attachment 5 – Pricing. Each CLIN will be evaluated separately.

OPTIONS. The Government will evaluate offers for award purposes by adding the total price for the base period to the total price for all options. The Quoter shall submit pricing for the base period and all option periods. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of option prices shall not obligate the Government to exercise the option(s).

FAR 52.217-8. The Government may require continued performance of any services within the limits of, and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to the prevailing labor rates provided by the Secretary of Labor. The price for FAR 52.217-8 Option to Extend Services will be evaluated using the final year’s proposed pricing. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed six months. The Contracting Office may exercise the option by written notice to the Contractor within 15 days of contract expiration.
