About this file
This is a Federal Acquisition Regulation (FAR) clause 52.212-2 establishing evaluation criteria for commercial products and services solicitations.
The Government will award contracts to the responsible offeror whose conforming offer is most advantageous, evaluated using three factors in descending order of importance: Technical Submission, Price, and Delivery Lead Time. Technical acceptability is determined by reviewing the Technical Capability Certification Chart & Statement (Attachment A) and supporting descriptive literature to verify all technical requirements are met. A quote meeting all identified requirements receives an "Acceptable" rating; failure to meet any requirement results in an "Unacceptable" rating that renders the entire quotation ineligible for award. Award will be made for technically acceptable item(s) resulting in the lowest aggregate price. Price is evaluated by adding estimated amounts for each line item to determine total evaluated price, with all prices assessed for reasonableness per FAR 12.204(a) and held firm for sixty days. Delivery time is evaluated based on what is most advantageous as determined by the Government. The clause specifies that acceptance of an offer by written notice creates a binding contract without further action, and the Government may accept an offer before expiration unless a written withdrawal notice is received beforehand. No options are available under this solicitation.
