About this file

This is a Task Assignment Change Order Form (Change Order No. 1) issued by the Florida Department of Environmental Protection (FDEP) for contract CN331 involving Humiston & Moore Engineers as the consultant. The project concerns seawall improvements at Von D. Mizell – Eula Johnson State Park, located in Broward County, Florida. The change order was authorized on February 22-28, 2023, with approval signatures from FDEP representatives including Budget Representative Tamika Bass, Project Manager Theresa Carron, and Contract Manager Ralph Perkins, as well as consultant representative Matthew Fleming.

The change order authorizes additional professional services valued at $52,684.61, consisting of $49,184.61 in fixed-price costs and $3,500.00 in reimbursable expenses. The scope includes five subtasks: mitigation plan development ($20,506.48 fixed + $3,500.00 reimbursable for application fees), jet probe geotechnical investigation ($4,338.60), bid support services ($3,844.00), construction administration ($17,676.03), and post-construction survey ($2,819.50). These services address regulatory requirements for wetland mitigation, bedrock investigation to reduce contractor risk, and construction oversight. The original task completion date of June 24, 2023 was extended by 720 days to June 23, 2025, reflecting the added complexity of permitting with mitigation requirements and the inclusion of construction administration and final certification services. Payment is contingent upon FDEP approval of deliverables for each subtask.

RE: DEP Agreement CN331 ‐ Humiston & Moore Engineers

Seawall Replacement – Von D. Mizell – Eula Johnson State Park Task Assignment Number – 16 Change Order Number ‐ 1

Dear Ms. Carron, Permit applications for this project to replace approximately 250 linear feet of seawall were submitted in June, 2022. Since that time, site meetings were held in August and follow‐up discussions through October.

Regulatory agencies have determined that mitigation is required for the wetlands that have become established landward of the seawall. This change order includes mitigation plan development, a Jet Probe geotechnical investigation to reduce contractor’s risk in bidding, and construction administration (CA) services, including bid support, surveys, and final certifications. These are briefly described below.

Mitigation Plan The land behind the seawall has subsided due to deterioration of the existing wall. The lower land elevation resulted in development of wetland habitats landward of the wall. This includes several mangroves and other indicator species. The vegetation must be removed and suitable runoff restored for construction of the new wall. Federal, State, and local agencies have determined that this represents impacts to protected wetlands that must be offset by mitigation. Humiston & Moore (H&M) has negotiated an agreement that mitigation bank credits will be acceptable in combination with sufficient documented, ongoing wetland and habitat enhancement programs at the park. This change order includes tasks necessary to develop impact assessments and mitigation plans to satisfy agency requirements. Impact assessments will be developed by Pinnacle Ecological in consultation with H&M and the regulatory agencies. The impact assessments are then used by the agencies to determine the quantity of mitigation credits required.

Jet Probes The geotechnical investigation for this project encountered bedrock at an elevation of approximately ‐13.5’ in one test hole and ‐17.5’ in the other. Due to poor soil conditions at the site, the sheet pile design requires embedment into bedrock. The observed variability in bedrock elevation raises the potential of ordering excess steel at unnecessary additional cost. Jet probes will be collected at several locations along the water side of the wall. This will document the depth to refusal to allow the contractor to better estimate the lengths of sheets needed at various locations and reduce the contractor’s risk in bidding. Jet probes and refusal elevations will be conducted and compiled by Terraquatic.

Construction Administration (CA) Bidding, contractor selection, and construction administration services are included with this change order to ensure swift transition into construction phases after permits are issued. H&M will assist the BDC during the bid process and contractor selection period with responses to questions, requests for additional information, a pre‐bid meeting and other support as necessary. Due to the sensitive nature of the environment and the difficult soil conditions encountered, frequent progress meetings on site are recommended during construction in addition to pre‐construction and post‐construction punch‐list meetings for final certification. Construction observation by our structural engineer and a post‐ construction topographic survey will also be required.

The initial task assignment for this project consisted of work up to and including completed permit applications, RAI responses and construction documents. The initial task assignment provided a target completion date of June 24, 2023 for those tasks. The target completion date has been revised by 720 days to June 23, 2025 due to the added complexity of permitting projects that include a mitigation component, and the addition of bid support, construction administration, and final certifications to the scope of work. Note that this includes assumptions regarding permit review timelines, bid process and construction which will be monitored as the project progresses.

H&M has prepared the attached task assignment change order proposal summary and labor‐hour documentation to provide the professional services described above.

Sincerely, HUMISTON & MOORE ENGINEERS

Matthew Fleming

Mitigation Plan, Bedrock Investigation and Construction Administration Services for

Seawall Replacement

Von D. Mizell – Eula Johnson State Park

Subtask 8: Mitigation Plan

Description: A functional assessment and mitigation plan is required by the South Florida Water

Management District (SFWMD) for assessed impacts to wetlands associated with this project. Mitigation will also be required by the US Army Corps of Engineers and Broward County. This task will provide a functional assessment using the Wetland Assessment Technique for Environmental Review (WATER) methodology. The assessment forms the basis of the purchase of mitigation credits as agreed with the agencies. This task also includes a summary of ongoing wetland habitat enhancement at the park and coordination with permitting agencies throughout the mitigation assessment and permitting process.

Additional application fees are also included. The mitigation credits to be purchased will be determined based on the work included in this item. Purchase of mitigation credits is not included in this subtask.

Deliverable:

Mitigation Plan including functional assessment of existing wetlands using WATER method and cumulative impact analysis will be provided to DEP in .pdf format.

Performance Measure: Deliverables will be reviewed by the Department to confirm they are complete, accurate, and timely.

Subtask 9: Jet Probes

Description: The geotechnical investigation at this site identified weak, compressible organic soils several feet in thickness, overlaying sand and bedrock. The seawall design for this project will require embedding steel sheets into the bedrock. Jet probes will be used to identify refusal (typically top of bedrock) at several points along the proposed wall alignment. This information can be useful to reduce contractor’s risk during bidding and minimize waste due to excess sheet length.

Deliverable: Report of refusal elevations along the proposed wall alignment will be provided to DEP in

.pdf format.
