About this file
This is a Price Proposal Form for a design-bid-build construction project at Naval Station Newport, Rhode Island, encompassing two major facilities: Project P-084 (Next Generation Torpedo Integration Lab) and Project P-1016 (Consolidated Research, Development, Test and Evaluation Systems Facility).
The base contract (CLIN 0001) requires pricing for the complete construction of the P-084 facility, a 12,920 SF multi-story steel frame laboratory and office building with shallow foundation, metal standing seam roof, and masonry/metal panel exterior walls, including site preparation, stormwater retention system, mechanical and electrical utilities, telecommunications, landscaping, drainage, parking, and exterior lighting. Additional CLINs include unit pricing for geotechnically unsuitable subgrade soil removal and replacement (3,000 CY), non-hazardous contaminated soil disposal at permitted RCRA facilities (8,000 tons), construction dewatering effluent treatment and disposal (100,000 gallons), and buried concrete/debris demolition and disposal (500 tons). Option Items 1-3 (CLINs 0002-0004) address P-084 audio-visual design services, audio-visual equipment procurement and installation (Government estimated at $125,000), and furniture, fixtures, and equipment procurement (Government estimated at $539,503). Option Items 4-9 (CLINs 0005-0010) mirror the structure for P-1016, including construction of a 17,978 SF multi-story laboratory facility with the same environmental and contamination management unit price items, plus options for AV design services, AV equipment ($338,554 estimated), FF&E ($855,715 estimated), building demolition, and paved parking with low-impact development stormwater system. Offerors may propose a Handling and Administration Rate (HAR) not to exceed 5 percent for FF&E and AV items. All pricing must be firm fixed-price with no economic price adjustment. The Government reserves the right to award any or all option items within 365 calendar days after contract award, with contract completion remaining 901 calendar days from award if options are exercised. Estimated quantities marked with asterisks (*) are subject to equitable adjustment if actual quantities vary more than 15 percent from estimates. Performance and payment bonds must reflect 100 percent of the aggregate award amount if any option items are exercised. A signed Project Labor Agreement is mandatory for proposal submission, and Cybersecurity Maturity Model Certification (CMMC) Level 1 self-assessment compliance is required in accordance with DFARS deviations.

Total Price for CLIN 0001 - 0010
GENERAL BID NOTES
a) Award will be evaluated on the price proposed for Line Items 0001 – 0010 (including 0001A-0001D and 0005A-0005D), Base Price and the sum of all Option Item prices.
b) The Government reserves the unilateral right to award any or all Line Items 0002-0010 (including 0005A-0005D) to the Contractor at the proposed price within 365 calendar days after the contract award and in accordance with all bid notes. A firm fixed proposed price is required for Line Items 0001-0010 (including 0005A-0005D). No provision is made for economic price adjustment. If the Option(s) are exercised, the contract completion date remains 901 calendar days after award of the contract.
c) Quantities on the bid schedule that are followed by an asterisk (*) are estimated quantities. Contractor shall only be paid for quantities/units of work actually performed. If the estimated quantity used in the bid schedule is not reached, a deductive modification shall be taken at the end of contract for quantities/units not performed. If the estimated quantity is exceeded, an equitable adjustment shall be made to the contract price for work performed over the estimated quantity. If the quantity of a unit-priced item in this contract is an estimated quantity and the actual quantity of the unit-priced item varies more than 15 percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party. The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 15 percent or below 85 percent of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the Contractor may request, in writing, an extension of time, to be received by the Contracting Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting Officer before the date of final settlement of the contract. Upon the receipt of a written request for an extension, the Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgement of the Contracting Officer, is justified.
d) Evaluation of Options (JUL 1990). Except when it is determined in accordance with FAR 17.202 (b) (DEVIATION 2026-O0027) not to be in the Government's best interest, the Government will evaluate offers for award purposes by adding the price for Line Items 0002 - 0010 to the total price for the Base Bid, (Line Item 0001). Evaluation of options will not obligate the Government to exercise the Option(s). (FAR 52.217-5 DEVIATION 2026-O0038).
e) The Government may reject an offer as non-responsive if it is materially unbalanced as to prices for the basic requirement and the option quantities. An offer is unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated for other work.
f) Failure to enter a price for any Line Item will result in a proposal being rejected.
g) For bid items where unit prices are indicated as required, bidders shall enter unit prices and extended totals in spaces provided. If there is a difference between a unit price and the extended total, the unit price will be held to be the intended bid and the extended total recomputed accordingly. If an Offeror provides a total but fails to enter a unit price, the total divided by the specified quantity will be held to be the intended unit price.
h) If any or all of Line Item 0002 - 0010 (including 0005A-0005D) is exercised, additional bonding and consent of surety is required. Consequently, the Performance Bond must reflect 100 percent of the aggregate amount of all items.
ADDITIONAL BID NOTES
a) For CLIN 0001A and 0005A: Geotechnically Unsuitable Subgrade Soil Removal, temporary stockpiling, and Replacement: Unit price for all work in connection with the removal, disposal, and replacement of Geotechnically unsuitable subgrade soil with imported Structural Fill as specified. Unsuitable subgrade soil determinations must be made by the Government Geotechnical Engineer and approved by the Contracting Officer. The price must include removal of geotechnically unsuitable soils shown on Sheet CD103, or identified during proof rolling of planned subgrades, and backfilling the excavation with compacted imported Structural Fill. Soils disturbed by the contractor’s Construction activities, or that are excessively wet and soft due to lack of proper site maintenance and protection measures, and lack of specified drainage or excavation dewatering will not be considered unsuitable. Unit price must include all handling and transportation. The volume of material removed and imported backfill required must be neat quantities determined based on field measurements (length x width x depth) of the completed excavation to remove the unsuitable soil as approved by the Contracting Officer. Any work under this CLIN will not proceed without prior written approval of the Contracting Officer and direction of the Government Geotechnical Engineer.
| b) | For CLIN 0001B and 0005B: Unit price for providing all work in connection with excavation, handling, temporary stockpiling, sampling, analysis, transportation, and disposal of non-hazardous contaminated surplus soil media at a permitted licensed facility. Sampling must be performed in accordance with Specification Section 01 57 19, plus any other analytes required by the treatment/disposal facility. Unit price must include all work in connection with removal, testing, treatment and disposal of non-hazardous contaminated surplus soils encountered within planned excavations and soils removed under CLIN 1A, at a permitted licensed treatment/disposal facility as specified. Unit price must include all work in connection with evaluation and handling, any necessary storage, stockpiling and related storage maintenance and transportation, and all that entails. The volume of contaminated soil removed will be based on approved truck scale measurement at the receiving facility and the quantity must be approved by the Contracting Officer. Any work under this CLIN will not proceed without prior written approval and field verification from the Contracting Officer. |
| c) | For CLIN 0001C and 0005C: Unit price for providing all work in connection with handling, containerizing, testing, storage, management (including operation and oversight), and offsite treatment and disposal of contaminant impacted construction dewatering effluent (including but not limited to, PFAS, petroleum, and metals) at a permitted licensed facility. Sampling must be performed in accordance with Specification Section 01 57 19, plus any other analytes required by the treatment/disposal facility. The quantity of contaminant impacted construction dewatering effluent treated and discharged in gallons must be based on certified and the quantity must be approved by the Contracting Officer. Any work under this CLIN will not proceed without prior written approval and field verification from the Contracting Officer. The Contractor must select means and methods to minimize the volume of construction dewatering effluent to the greatest extent possible. |
| d) | For CLIN 0001D and 0005D: Unit price for providing all work in connection with demolition, removal and disposal of unknown buried concrete, pipes and debris (including creosote treated timber) encountered within planned excavation limits and not identified in the Contract Documents. Buried concrete and debris meeting the specified criteria must be field verified by the Contracting Officer prior to removal and must be segregated from the surrounding soil during demolition and excavation operations. Buried concrete and debris encountered within the planned excavation limits smaller than 1/2 cubic yard in size must be considered to be incidental to the work (i.e., at no cost to the Government). Unit price must include all work in connection with buried concrete and debris removal and disposal and replacement with clean imported structural backfill or other material specified. Unit price must include handling and transportation. The volume of buried concrete and debris removed will be based on approved truck scale measurement at the receiving facility and the quantity must be approved by the Contracting Officer. Any work under this Line Item will not proceed without prior written approval and field verification from the Contracting Officer. |
BID NOTES FOR FFE & AV (LINE ITEMS 0003, 0004, 0007 and 0008).
1) The estimated amount for FF&E and A/V has been supplied by the Government, to provide offerors with the projected magnitude of effort. The estimated amount includes the actual cost of the FF&E and A/V including freight and installation charges. The Government FF&E and A/V Estimate is only an estimated amount.
2) If awarded, line items will be funded separately after completion of FF&E and A/V design package review by the Government, and receipt of appropriate funding by the Government, and receipt of appropriate funding by the Government. Requirements and details for FF&E are provided in Section 12 00 01.00 20 FURNITURE, FIXTURES, AND EQUIPMENT (FF&E) PACKAGE. Requirements and details for AV are provided in Section 01 30 02.00 22 DESIGN, PROCUREMENT, AND INSTALLATION OF AUDIOVISUAL EQUIPMENT.
3) Bonding
i) Bonding is not required for the design, procurement and installation of FF&E and AV at time of Construction Contract Award.
FAR 28.102-1(a) (DEVIATION 2026-O0005) requires that performance and payment bonds be included in all construction contracts exceeding the SAT, except under the conditions listed. Since the FF&E & AV Option Item is not part of the original contract award, the Construction Contractor must not be required to secure bond for the FF&E & AV at the time the basic contract is awarded.
ii) Additional Bond at FF&E Option Item Award FAR 28.102-2(d) (DEVIATION 2026-O0005) requires the Government to secure additional bond from the Construction Contractor for any contract price increases. Therefore, an increase to the original contract bond is required at the time of the FF&E Option Items award, to protect the Government against the Construction Contractor not providing FF&E ordered and to ensure that the vendor(s) receive payment if the Construction Contractor goes out of business. The increased cost of the bond must come from the FF&E funding source and is not a part of the Construction Contractor’s HAR.
iii) Bonds Required by the Construction Contractor If the Construction Contractor requires bonding from the FF&E subcontractor(s), the cost must be covered in the Construction Contractor’s HAR.
4) Offerors may propose a Handling and Administration Rate (HAR) for the FF&E and A/V not to exceed 5 percent. This fee will account for all administrative costs, overhead, bonding fees, administration of subcontracts, profit, and any other costs associated with and related to the coordination and processing of the procurement and installation of FF&E and A/V. The proposed HAR percentage will be incorporated into the contract award and will not be adjusted regardless of fluctuations from the estimate amount for the FF&E and A/V. The proposed HAR is a fixed rate.
5) The Government is not obligated to award CLINs 0002, 0003, 0004, 0006, 0007 and 0008. Should the Government choose to award the Option Item, the line item will be awarded as a negotiated modification to the contract/task order. The Contractor's proposed HAR will be applied to all vendor/supplier costs for the FF&E and A/V.
6) If awarded, the FF&E and A/V modifications will be awarded at least six months prior to the contract completion date. A minimum of six months is required for the Contractor to purchase, deliver and install the FF&E and A/V without impacting the overall completion date of the project. The Contractor's schedule must assume the award of the FF&E and A/V as an option. No schedule extensions will be granted if the option is awarded at least eight months prior to the contract completion date. If the Government decides to negotiate and award the furniture option with less than six months prior to the contact completion date, the Contractor may be entitled to a contract extension and extended field overhead. A contract extension and extended field overhead will only be granted in those cases where the Contractor demonstrates that an accepted Final FF&E and A/V packages were submitted within the approved schedule deadlines and sufficient lead time for the FF&E and A/V is not available and the Government's award of the option is in the last six months of the contract.
