About this file

This is a substance use treatment and prevention services agreement template between the County of Santa Clara and contracted providers for delivery of behavioral health services to county residents. The agreement establishes terms and conditions for providers to deliver Drug Medi-Cal Organized Delivery System (DMC-ODS) services and other substance use treatment and prevention programs through the Behavioral Health Services Department (BHSD). The contract term begins on a specified date and expires on a designated date, with potential for amendment or extension. Services are provided across multiple program types as detailed in attached exhibits, with specific requirements for service availability, client accessibility, timely access to care (24/7 when medically necessary), and coordination of care. Contractors must maintain continuous operations, comply with all state and federal licensure and certification requirements, and adhere to trauma-informed service delivery approaches.

Compensation is provided on a monthly basis within 30 days of invoice submission, with payments capped at the Maximum Financial Obligation (MFO) specified in Exhibit B budgets. Contractors must bill Medi-Cal as the primary payer, followed by Medicare and third-party insurers, with remaining funds available for non-Medi-Cal clients. Funding derives from federal Medi-Cal reimbursement, Substance Abuse Prevention and Treatment Block Grant (SABG) funds, and county appropriations. Contractors are subject to interim settlement and final audit processes, with cost reports due November 15 annually. The agreement includes provisions for recoupment of unused funds, rate increases up to 12% for eligible staffing categories, and client fee collections on a sliding scale basis. Contractors must maintain comprehensive compliance programs, pass federal database checks, implement corrective action plans when deficiencies are identified, and provide detailed financial and clinical documentation for audit purposes. All staff must be credentialed through Valley Health Plan's Managed Services Organization process before service delivery.
