21 NOV 2024

MEMORANDUM FOR EVALUATION FACTORS

FROM: 97CONS/PKA

SUBJECT: 52.212-2 - EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

THIS SECTION IS FOR SOLICITATION PURPOSES ONLY. THIS SECTION WILL BE PHYSICALLY

REMOVED FROM ANY RESULTANT AWARD.

The Government will award a contract resulting from this solicitation to the responsible vendor whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate quotes:

• Price

• Technical Acceptability

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a quote is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful party within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party.

Before the quote’s specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are communications after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

ADDENDUM TO FAR 52.212-2

Best Value to the government will result from the party who provides the Lowest Technically Acceptable quote. No contract award shall be made unless the Contracting Officer makes an affirmative determination of responsibility in accordance with FAR 9.104. By submission of its quote, the vendor accepts all solicitation requirements, including all technical requirements and terms and conditions. Failure to conform to solicitation requirements may result in a quote being determined not awardable without further evaluation.

EVALUATION METHODOLOGY:

The evaluation will begin with a cursory review all submissions for completeness. If a vendor fails to submit a complete submission, the vendor will be rendered non-responsive, and no further evaluation will be conducted. Complete quotes will be ranked by Total Evaluated Price (TEP) from lowest to highest (see below detailed explanation on the calculation of TEP). The evaluation will begin by evaluating the technical submissions of the three (3) lowest ranked quotes. If the technical submissions of the three lowest ranked offers are acceptable, the evaluation process will proceed to the next step. This process will continue until a best value determination can be made. Award will be made to the responsible vendor whose quote conforms to all required terms and conditions outlined in this Request for Quote (RFQ), includes all required representations and certifications, meets all requirements set forth in supplemental attachments.

A detailed look at the evaluation criteria is below:

FACTOR 1 - PRICE

The total evaluated price will be determined by adding the value of each Contract Line Item (CLIN), plus 50% of option year four (4001 & 4002) CLIN. The additional 50% of the final option year prices represents the total cumulative price of an additional 6 months of service under FAR clause 52.217-8. Should 52.217-8 be exercised in the future, the price will be pro-rated to the actual performance required. Before a contract may be awarded, the contracting officer must determine the price fair and reasonable pursuant to Federal Acquisition Regulation (FAR) 13.106-3 - Award and Documentation. The Government reserves the right to conduct an analysis for balance on the vendor’s quote. A quote maybe not awardable if it is determined to be unbalanced.

FACTOR 2 – TECHNICAL ACCEPTABLE/UNACCEPTABLE RATING METHOD

The term “technical,” as used herein, refers to non-price factors other than past performance. The purpose of the technical factor is to assess whether the vendor’s response to the RFQ will satisfy the Government’s minimum requirements through evaluation of the technical approach provided by each vendor in response the Governments RFQ.
