About this file
This document is an addendum to FAR 52.212-2 establishing the evaluation criteria for a firm fixed price (FFP) commercial products and services contract award. The Government will evaluate quotations based on two factors: Technical Approach (significantly more important) and Price, with price becoming the deciding factor as technical ratings become more equal. Quoters must meet all solicitation requirements, including terms, conditions, technical specifications, and pricing instructions, or face removal from consideration.
The Technical Approach evaluation assesses compliance with the Performance Work Statement (PWS), specifically Objective 1 (paragraphs 2.1 and subparagraphs) and Objective 2 (paragraph 2.2 and subparagraphs), with particular emphasis on the proposed database solution's functional compliance. Technical ratings are assigned on a five-point scale: Outstanding (exceptional approach with multiple strengths and low risk), Good (thorough approach with at least one strength and low-to-moderate risk), Acceptable (adequate approach with moderate risk), Marginal (meets requirements with high risk), or Unacceptable (does not meet requirements and is unawardable). Price evaluation will assess the total quoted price for reasonableness using FAR 12.203 and applicable DFARS Part 212 class deviations. Quoters must submit complete pricing for all Contract Line Items (CLINs) identified in Section B, evaluated separately by CLIN. For options, quoters must provide pricing for the base period and all option periods; the Government will evaluate total price by combining base and option prices, and may reject offers with significantly unbalanced option pricing. Additionally, the Government reserves the right to test Information and Communication Technology (ICT) items for Section 508 accessibility compliance prior to acceptance and may reject quoters whose proposed ICT products or services are non-compliant.

FAR 52.212-2, ADDENDUM to EVALUATION OF COMMERCIAL PRODUCTS AND
COMMERCIAL SERVICES (NOV 2021)
1. QUOTE EVALUATION:
To be eligible to receive a contract, Quoters are required to meet all solicitation requirements, such as terms and conditions, and technical and pricing instructions. Failure to comply with all solicitation requirements and instructions may result in the Quoter being removed from further contract consideration.
The Government intends to award a firm fixed price (FFP) contract resulting from this solicitation to the Quoter whose quote provides the best value to the Government in accordance with Federal Acquisition Regulation (FAR) Part 12 (Acquisition of Commercial Products and Commercial Services). To make the award decision, the Government will consider two evaluation factors:
(Technical approach, and (2) Price.
Relative Order of Importance: Technical is significantly more important than price. However, as quotes become more equal in their technical ratings, price will become the deciding factor. The Government reserves the right to award to other than the lowest-priced quoter if a higher quote provides a superior technical solution that represents the best value.
Note: Section 508 Acceptance:
1. Prior to acceptance, the Government reserves the right to perform testing on required ICT items to validate the Quoter’s Section 508 conformance claims. If the government determines that Section 508 conformance claims provided by the Quoter represents a higher level of conformance than what is actually provided to the agency, the government shall, at its option, require the Quoter to remediate the item to align with the Quoter’s original Section 508 conformance claims prior to acceptance.
2. Quoter may be ineligible for contract award if proposed ICT products or services are not compliant with Section 508 standards.
2. EVALUATION CRITERIA:
Basis for Award: A FFP award will be made on a competitive best value basis. Evaluations will be conducted in accordance with the evaluation criteria below:
1. Factor 1 – Technical Approach
In accordance with FAR 15.103-1, the Government will evaluate the technical capability of each quote by reviewing the extent to which the proposed solution demonstrates compliance with the requirements of the Performance Work Statement (PWS). As part of this assessment, the Government will also conduct an evaluation of each Quoter’s proposed database solution for compliance with the functional requirements described in the PWS, Objective 1, paragraphs
2.1 and all of its subparagraphs as well as Objective 2, paragraph 2.2 and all of its subparagraphs.
The ratings used for Factor 1 are defined as follows:
Combined Technical/Risk Ratings Rating Description Outstanding Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.
Good Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.
Acceptable Proposal indicates an adequate approach and understanding of the requirements and risk of unsuccessful performance is no worse than moderate.
Marginal Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.
Unacceptable Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable. Proposal is unawardable.
2. Factor 2 – Price
Price will be evaluated separately from technical factors. Quoter’s total quoted price will be evaluated for reasonableness in accordance with FAR 12.203 and applicable DFARS Part 212 class deviations. The Government will establish a total evaluated price based on the sum of all prices quoted. The Government may use one or more price analysis techniques. Incomplete pricing submissions may result in rejection.
Quoter shall complete the pricing information on all CLINs identified under this solicitation in Section B. Each set of CLIN will be evaluated separately.
OPTIONS. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the base period. The Quoter shall submit pricing for the base period and all option periods. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).”
