About this file
This document contains questions and answers regarding a solicitation for detention services in California. U.S. Immigration and Customs Enforcement is seeking proposals for facilities housing a minimum of 700 adult male and female detainees in one area, up to 1,150 detainees in the San Francisco area, and up to 1,950 detainees in the Los Angeles area. The solicitation allows offerors to propose housing more detainees than specified minimums. Radii for facilities were adjusted to a maximum of 100 miles from Los Angeles and San Francisco field offices. National Commission on Correctional Health Care accreditation must be achieved within 12 months of contract commencement. While the solicitation provided a CLIN structure, offerors may propose alternate pricing models but the government prefers the provided structure.

Question 1.
Section/Subsection Number:
Combined Synopsis and Solicitation, Item 16, Page 2
Requirement A (page 2) of the Combined Synopsis and Solicitation Notice states, "the facility or facilities shall house a minimum of approximately 700 adult male and female detainees."
However, Requirements C and D each state that the "facility or facilities shall house up to".
Section F.3 also states similar language with some slight variation.
Could the Government please confirm that each requirement is for a minimum number of beds, and that Offerors can propose more beds than the number specified for each Requirement, consistent with Requirement A?
a. To clarify the language in the Combined Synopsis and Solicitation Notice, we respectfully request the government revise the solicitation as follows:
Requirement C, Page2
A third facility or facilities is needed up to for a minimum of 1,150 adult male and female detainees within the San Francisco AOR (hereby referred to as “Requirement C”).
Requirement D, Page 2
A third facility or facilities is needed up to for a minimum of 1,950 adult male and female detainees within the Los Angeles AOR (hereby referred to as “Requirement D”).
b. To clarify the language in Section F.3 Place of Performance, we respectfully request the government revise the solicitation as follows:
Requirement C, Page 98
One or several facilities shall house a minimum of up to 1,150 adult male and female detainees within the San Francisco AOR (hereby referred to as “Requirement C”).
Requirement D, Page 98
One or several facilities shall house a minimum of up to 1,950 adult male and female detainees within the Los Angeles AOR (hereby referred to as “Requirement D”).
ICE Response:
Combined Synopsis and Solicitation has been revised for Requirement C and Requirement D.
Question 2.
Solicitation Section D-M, Section F, Part F.3 Place of Performance
The solicitation requires facilities proposed under Requirement D to be located a maximum of 75 miles from the Los Angeles Field Office located at 300 North Los Angeles Street, Los Angeles, CA 90012.
Question: Would the government consider a radius of 100 miles from the Los Angeles Field Office instead of the maximum 75-mile requirement?
Radius adjusted to 100 miles for Requirement D.
Question 3.
Section/Subsection Number:
California Wide PWS, Part II Section E , Armed Transportation Services.#10, Question: Will Government provide the Contractor access to a Government radio frequency for official communication purposes?
ICE Response:
No. Government owned radios are specifically for Law enforcement and all LEO’s are assigned numbers so they can communicate to X- Sector. Contractors are not on the network.
Contract staff can provide radios to ICE for internal to the Facility communications.
Question 4.
PWS, Section C, Paragraph 5 & Section V.D, Subsection 24
Section C states: “The contractor shall be responsible for obtaining and maintaining accreditation with National Commission on Correctional Health Care (NCCHC) within one year of contract performance.”
Section V.D states: “The Medical Service Provider will achieve full NCCHC (Adult) accreditation within 6 months of the contract award.”
Question: Please confirm that contractors are allowed 12 months from service commencement to obtain NCCHC accreditation.
Confirmed, Contractors will have 12 months.
Question 5.
Section B: Supplies or Services and Prices/Costs, Part B.2 Contract Pricing
Section B.2 states “Offerors may propose an alternate CLIN structure.”
Question: May offerors submit single-year pricing for each of the 15 years of the proposed contract?
ICE Response:
No, but per the RFP, vendors may provide an alternate CLIN Structure. The Government preference is that vendors provide pricing using the CLIN structure provided. Increases related to the SCA will be handled through those procedures and vendors are permitted to request an adjustment for Government review to their bed day rates every 36 months if necessary due to vendor cost increases
