a. Prospective Bidders’ Questions and Government’s Response to The Questions are as follows:
Q131: Given that the Salt Lake City, UT EHRM bid is scheduled for 1:00 p.m. EST on the same day, with the bid opening just 30 minutes before the San Antonio EHRM bid, would it be possible to extend the bid due date by one or two hours?
A131: The Bid Due Date is extended to 3:00 p.m. Eastern Time on 6 September 2023. The Bid Opening shall now be at 4:00 p.m. Eastern Time on 6 September 2023. The Telephone Call-In Number for the Bid Opening is 205-235-3524, and the new Phone Conference ID is 322 273 263#.
Q132: Sheets TN400, TN401, TN402, TN403, TN404, TN405, TN406, TN407, TN410, TN411, TN412, TN414, TN415, TN416, TN417, TN419, TN420, TN421, TN422, TN423, TN424, TN425, TN450 and T605 have not been provided. Can you please provide them?
A132: These sheets were not intended to be included in this solicitation. They will be provided to the awardee contractor in a post-bid construction set after award is made.
Q133: The specs are calling for 150KVA, 2N redundant UPS units. The drawing states 150KVA frame, 60KW capacity. Which one is correct?
A133: The new UPS is a modular system with an expandable maximum rating 150kVA;
however, the UPS will be provided with a Day 1 capacity of 60kVA.
Q134: Please confirm UPS output voltage is 120/208V.
A134: Refer to Sheet ‘EN497’; output voltage is 208Y/120V.
Q135: Please confirm the battery discharge time to the end of voltage is 20 minutes -- not 240 minutes as stated in the specifications.
A135: 20 minutes, not 240 minutes, is the minimal required UPS time.
b. Before awarding a contract in an IFB/sealed bidding procurement, the apparent low bid must be determined fair and reasonable. Thus, in accordance with FAR 14.408-2(a), “The contracting officer shall determine that a prospective contractor is responsible and that the prices offered are reasonable before awarding the contract. The price analysis techniques in 15.404-1(b) may be used as guidelines.” Per 15.404-1(b)(2), “The Government may use various price analysis techniques and procedures to ensure a fair and reasonable price.
Examples of such techniques include, but are not limited to, the following…(viii) Analysis of data other than certified cost or pricing data (as defined at 2.101) provided by the offeror.”
Per 2.101(b)(2) Definitions, “Data Other Than Certified Cost or Pricing Data means pricing data, cost data and judgmental information necessary for the contracting officer to determine a fair and reasonable price or to determine cost realism. Such data may include the identical types of data as certified cost or pricing data, but without the certification. The data may also include, for example, sales data and any information reasonably required to explain the offeror’s estimating process, including but not limited to (1) the judgmental factors applied and the mathematical or other methods used in the estimate, including those used in projecting from known data; and,
(2) the nature and amount of any contingencies included in the proposed price.”
