Solicitation: WPS III - 19AQMM20R0013
Question and Answers - IDIQ
Date: Amendment 0007
ItemDocument Reference (PWS, Attachments, Solicitation)Questions/IssuesAQM/Program Office Corrective Action/Response
Attachment 1 – Personnel Qualifications-2.7.2.9 Firearms Instructor/Simulator Operator-Technician (FI/SOT) (S)Given the short turn around on task order requests and limited manufacturer training schedules, please provide the various firearms simulation training systems currently in use that will require certification?Attachment 1 of the IDIQ states as specified by the task order. For this sample task order, the simulation system is Meggitt FATS.
Attachment 6, Section 1, DAttachment 6 states that the brand name/model numbers are provided for reference only and that equivalent or higher quality equipment will be acceptible. Can the government clarify how this determination will be made? What will be the government's criteria to determine if an item is of equal or higher quality given that much of the equipment does not have a specific model number identified? For the purpose of the sample task order solicitation, offerors will propose similar items to Attachment 6, OPO will determine if the proposed make/model meets the specifications of those make/models provided. Items in Attachment 6 that do not specify a specific make/model are considered generic brands.
Attachment 1, 2.1.1Can the government clarify the supervisory experience for the Local Program Manager? Paragraph D seems to conflict with the qualifications identified in paragraph C, e.g. would someone with a master's degree and 3 years of supervisory experience also need an additional 7 years of supervisory experience?Attachment 1 , Section D, 2.1.1 has been deleted. See Attachment 01 released under Amendment 06.
Attachment 1, 2.3.9Can the government please clarify/define Fleet Operations as it pertains to the professional driving experience required for the Armed Driver?Fleet operations experience pertains to working for an organization that has responsibilities of providing transportation through company or public owned assets.
Attachment 1, 2.6.2Can the government please confirm that the Physician Assistant is required to be fluent in all languages identified in TO?Confirmed. The Physician Assistant is required to be fluent in all languages identified in the task order.
Attachment 1, 2.6.8The Search and Rescue Paramedic is identified as a 'P' position but there are no weapon qualification or PRT requirements identified in Attachment 1 for this position. Are personnel filling this position required to complete weapons qualifications and PRT testing? The Attachment 1 PD for the Search and Rescue Paramedic has been corrected. See Attachment 01 released under Amendment 06.
Section C, 8.2.4.4 and 8.2.4.7Can the government please confirm that relief guards as required will be considered billable and would be included in the staffing requirements identified for each task order?Relief guards are billable and captured within the PWS staffing table.
Section C, 8.3.5.2Can the government please confirm that the Canine Handlers will be billable up to 72 hours per week, e.g. time spent on biological breaks, training, exercising canines, record keeping, etc. will be considered billable time?Confirmed. The Canine Handlers will be billable up to 72 hours per week.
Section C, 9.3Given that LPMO personnel could potentially be leveraged across multiple Task Orders, is it safe to assume that this CLIN will be available on all Task Orders?LPMO services will be specified at the Task Order level.
Section C, 10.4.1Can the government please confirm that on-the-job observational learning will be considered billable time?Confirmed. As long as billable staffing numbers do not exceed the maximum amount of billable positions, on-the-job observational learning will be considered billable time.
Section C, 10.4.2Will the government consider the Canine Handlers labor during the canine acclimation and training period to be billable time?Yes. As long as billable staffing numbers do not exceed the maximum amount of billable positions, the Canine Handlers labor during the canine acclimation and training period to be billable time.
Section H, H.13Attachment H identifies the insurance requirements for the contract and states that these must be provided "at no additional cost or expense to this contract or the US Government." As these insurance services in a high threat environment have a cost only applicable to this contract (particularly when they are location specific), how does the goverment expect that there be no cost passed through to the government?Insurance expense are not direct billable. Section H.13 has been revised.
Section H, H.13Attachment H identifies the insurance requirements for the contract and states that these must be provided "at no additional cost or expense to this contract or the US Government." Is it the government's intent that the cost for the specific insurance required by this contract be captured in the contractor's overhead rates?Insurance expense are not direct billable. Section H.13 has been revised.
Section H, H.13.7Is the medical malpractice insurance requirement only applicable if a TO is issued that includes a requirement for a Medical Officer? If a Operational Medical Director or Medical Officer is specified in a task order, medical malpractice insurance (more properly called professional liability insurance) is required.
Section H, H.13.7Current commercial availability of malpractice insurance on a by name basis for non-physicians, e.g. AEMTs and Paramedics, is not available on the market. This type of medical support is typically covered under Allied Healthcare Services professional liability coverage. Would it be sufficient for contractors to have Allied Healthcare Services professional liability coverage in lieu of the by name based malpractice insurance? As long as the vendor maintains professional liability coverage for all medical personnel on the task order, this requirement is satisfied.
Section H, H.13.7Malpractice insurance is typically written on claims-made basis. Would the government consider revising this requirement to remove the 'occurrence-based' requirement? As written, there will be very limited competition in the insurance market which will drive up the cost to the government. No adjustment will be made. Section H 13.7 contains the word "or", which allows offerors to make the choice.
Section H, H.13.7Would the government consider removing the by name requirement for the malpractice insurance? As long as the vendor maintains professional liability coverage for all medical personnel on the task order, this requirement is satisfied.
Attachment 16, IDIQ PricesThere are numerous formula errors in the calculated subtotal column in multiple contract years. For instance, the subtotal for Armed Guard (X23) is linked to the staff for the USC (X012) on row 22 in the base period. Will the government please correct these subtotals or unprotect the worksheet?Attachment 16, IDIQ Pricing Table, was updated under Amendments 05 and 06.
Section H, Exh 26.6Paragraph B states that the "U.S. Government will consider any position staffed by a person who: (1) has not received DS approval & authorization, (2) lacks required equipment, training or, (3) is otherwise not in compliance with the terms and conditions (e.g., weapons qualifications, certifications, conduct, etc.) for that position in accordance with the WPS III IDIQ, contract or TO's, to be UNSTAFFED for the purposes of assessing deducts". Is it the government's intent that no personnel with any of the above mentioned known deficiencies not stand post"?Yes, it is the Government's intent that no personnel with any of the mentioned known deficiencies not stand post.
Section H, Exh 26.6.1Under Paragraph B, the government asserts that all staffing shortfalls are the result of two factors: 1) normal rotations/end of contract and 2) Unscheduled replacements due to personnel quitting, personal emergencies, removal by the contractor or being incapacitated. Where is the closure of host-country government offices - preventing visa processing or host-country closure of borders to travel addressed?Under Paragraph B, the list of provided unplanned circumstances for replacement is not exhaustive.
Section H, Exh 26.6.1Under Paragraph F, it states that "the U.S. Government , at its discretion, will begin assessing deductions on the Contractor for all CLIN positions below one hundred percent (100) of required staffing, regardless of the occurrence of incidents requiring the unscheduled replacement of personnel." What is the meaning of the phrase, "as its discretion"? Is there specific criteria that will consistently be applied by all government personnel across all WPS III task orders to ensure reasonable application of judgement? Can you please share the criteria so that appropriate pricing adjustments can be made to address the unscheduled vacancies inherent in large task orders? As contractors respond to the requirement for 100% staffing, is it the government's expectation that "reserve personnel" be on the ground at the site available to step in for unplanned vacancies? Will the government provide in a similar fashion for those reserve personnel as they do duty personnel (housing, meals, travel, etc.)?The Government reserves the right to apply deductions in the event that CLIN positions fall below 100% staffing. The Government does not provide or pay for personnel beyond what is detailed on the staffing table.
Section H, Exh 26.6.1In Paragraph F, the deduction calculation states that "from ninety-nine (99) percent to ninety five (95) percent of required staffing levels, the Contractor will be assessed a one (1) percent deduction for the respective billing cycle's total labor invoice. For each additional five (5) percent unstaffed for required CLIN positions the Contractor will be assessed an additional one (1) percent of that billing cycles' total labor invoice. This rate of assessed deduction will carry through fifty (50) percent failure to staff where the Contractor will be assessed a total of twenty (20) percent of the billing cycles' total labor invoice. This twenty (20) percent assessment will follow any and all total unstaffed required CLIN percentages below fifty (50) percent. The total amount deducted on any one labor invoice is capped at twenty (20) percent of the total invoice value." Can the government explain how applying the deduct percentage against the entire invoice is representative of the impact to the program for Contractor service that was not provided by 100% staffing? A single female LN screener missing for the month from a CLIN with two (2) required personnel on a task order would be a Contractor revenue loss and Government's impact to service of one month's revenue (ballpark $5K). However, the total monthly invoice for a 1,264 person task order (like the sample task order) would equate to an approximate $7,000,000 labor invoice. So the 20% max deduction for that one missing position would equal a $1.4M deduction off the invoice. That would seem grossly excessive when compared to the impact that one person has as evidenced by the price the government pays for their service. Should the government be calculating the deduct assessment against the required CLIN monthly invoice value not the total invoice? It is the Government's intention that any deducts applied are temporary in nature and that the Contractor resume 100% performance to recoup those deducts as detailed in Section H.26.4.
Section H, Exh 26.4In Paragraph A, the Contractor is allowed the opportunity to seek a reduction in the assessed deductions. However, it indicates that the government will only do this at the end of a period of performance. Why would the government not wait until the end of the period of performance to apply the deduction assessment when all credits are know as opposed to withholding the cash against legitimately provided labor services for more than an entire year when potentially the entire deduct my be reduced to zero as reflected in your example in Paragraph B?The Government's intent with deductions is to immediately incentivize the the contractor to remedy the issue that created a deduction, and the recoupment of those deductions is not automatic and requires specific criteria to obtain a recoupment.
Section H, Exh 26.4In Paragraph A, the Contractor is allowed the opportunity to seek a reduction in the assessed deductions. However, it indicates that the government will only do this at the end of a period of performance. As shown in the government's example, the reduced deductions could result in a significant refund from the government based on the Contractor's performance to the conditions to recovery of deductions. Will the government also be paying interest on the refunded deductions retained over the course of the year? What labor CLIN is the refund to be billed against, a percentage of every labor CLIN previously reduced by deduction in a single invoice reflecting the entire period of performance?DS will not pay interest on refunded deductions because when the deducts are assessed, they are valid at that time of invoicing. The refunds are applicable to the CLINs that are assessed the deducts. At the end of the period of performance the Government and the contractor will "true-up" invoice billings.
Section H, Exh 26.4In Paragraph A, the Contractor Conditions for recovery of deducts are biased towards smaller task orders where 100% staffing is easier to accomplish on a 30 person task order than on a 1000+ person task order, is it the government's intent to disincentivize contractors from supporting the government on large, high complexity task orders? In the government's decades of supporting this mission, has a Contractor on a 1000+ person task order ever had a full month with 100% staffing? The Government's deduction structure is not biased towards small or large task order operations.
Section H, Exh 26.4In Paragraph A, the last condition for recovery of deductions requires submission of invoices within 30 days of receipt of services. To meet this requirement for labor requires the signature of a government representative on the duty site where timely review and signature can impact the 30 day schedule. What does the government consider timely review and approval of submitted musters? Would any additional delays by the government extend the 30 days threshold? The window for review of the muster by Government personnel is generally 48 hours upon receipt. Justification for extensions may be considered by the Contracting Officer on a case-by-case basis.
