ENVIRONMENTAL STORM WATER, DRINKING WATER,

WASTE WATER, AND HAZARDOUS WASTE PROFILING

SAMPLING AND TESTING BRIDGEPORT, CA

SECTION 1.0 - GENERAL

This Performance Work Statement (PWS) solicits services for performing laboratory testing of storm water, drinking water and waste water program requirements for water, soils, sludge and solid materials, at Marine Corps Mountain Warfare Training Center (MCMWTC), Bridgeport, CA, and shall be performed as outlined below. All work for the MCMWTC Bridgeport water program shall be completed in accordance with the most current regulations in California Code of Regulations Title 22 and updated approved revised state issued permits (i.e., Safe Drinking Water Act [SDWA], Clean Water Act [SWA] permits, National Pollutant Discharge Elimination System [NPDES] permits). All work must be performed following applicable and appropriate Department of Defense (DOD) guidance and policy and consider all site documentation and reports to date.

Under this PWS, the following services are required:

• Laboratory testing of storm water, drinking water, waste water, hazardous waste profiling and environmental media related to the MCMWTC Bridgeport water program

• Hardcopy and electronic data (PDF/NECARS) reporting deliverables

1.1 PRIMARY OBJECTIVE

The primary objective of this project is to provide laboratory testing of storm water, drinking water, and waste water program requirements at MCMWTC Bridgeport. The project scope shall include all of the necessary labor and equipment associated with meeting the objective.

The contractor shall obtain final approval of the work required by NAVFAC SW upon completion of these performance objectives as specified in Section 7: PERFORMANCE MEASUREMENT AND PAYMENT

SUMMARY AND OFFER SCHEDULE.

1.2 BACKGROUND

The contractor shall provide laboratory services and associated reporting requirements to support environmental decision making, promote the wise use of environmental resources, and determine compliance with environmental regulations and permits. The MCMWTC Bridgeport water program requires ongoing environmental laboratory services to comply with the most current regulations in California Code of Regulations Title 22 and updated approved revised state issued permits (i.e., SDWA, CWA permits). Therefore, it is critical that monitoring, trend analysis and data gathering are conducted to maintain the drinking water program to include appropriate notification of any result above maximum contaminant levels (MCLs), public health goal (PHG), or bacteriological exceedance on drinking water. The notification shall be made in accordance with regulatory requirements. The contractor shall perform all work neatly, accurately, correctly and conform to the respective specifications, standards, requirements, permits and in accordance to appropriate codes and practices to include all Federal, State, local government and MCMWTC Bridgeport base regulations, laws and permits.

SECTION 2.0 – WORK ELEMENTS

The contractor shall furnish all labor, management, supervision, tools, material, and equipment necessary to perform all work in accordance with the PWS. The contractor shall conduct all work in accordance with all pertinent state, local and federal regulations and approved work plans.

The contractor’s work areas and activities at the site shall be subject to inspection without announcement by the Navy/Marine Corps and their representatives.

The estimate should include the following work elements:

• WORK ELEMENT 1: Project Management

• WORK ELEMENT 2: Lab Testing and Reporting

2.1 WORK ELEMENT 1 – PROJECT MANAGEMENT

The contractor shall provide project management in support of this CTO in consultation with the Contracting Officer’s Representative (COR). The contractor is expected to provide efficient project management (i.e.

supervision of personnel, subcontractor procurement and management, field visits by various specialists, preparation and maintenance of project schedules, budgets and files, progress reports and billing, and overall base-wide technical coordination) in order to minimize costs to the Navy. Furthermore, project management will be in accordance with Sections A thru J of the basic contract. The contractor shall provide all labor, approved material, equipment, supplies and supervision, necessary to perform the Sampling, Field Testing and Laboratory Services.

The contractor shall consult with the COR before altering/modifying any existing approved Environmental Laboratory Services contract documents. The documents, which include Standard Operating Procedures (SOPs) and/or Safety Plans, must be consistent with NAVFAC policy and with MCMWTC Bridgeport program requirements. The most current update of the SOP will be followed. The contractor shall coordinate meetings with the COR and take meeting minutes. Draft minutes are due to the COR within two (2) working days after the meeting/teleconference concludes. Once the minutes are approved by the COR, the contractor shall distribute the COR-approved minutes to all attendees within one (1) workday.

2.2 WORK ELEMENT 2 –LAB TESTING AND REPORTING

The contractor shall provide all labor, management, supervision, tools, material, and equipment required to perform field and laboratory testing, and reporting services in accordance with the basic contract requirements per Section C

– Descriptions and Specifications, Annex 0100000, Annex 0200000, Annex 1502000, Annex 1604000, and Annex 1606000. The contractor shall execute the work under the specifications of the basic contract to meet the customer requirements which include responding to sampling requests and timely completion and delivery of lab reports.

The contractor shall provide analyses as requested in this PWS and shall provide sampling kits and courier service from MCMWTC during working hours to the laboratory. All samples will be collected by MCMWTC environmental personnel. The work shall include procurement of subcontractors, equipment and supplies as necessary. Re-sampling and associated analyses shall occasionally be required on an emergency basis.

The contractor shall provide courier services to pick-up regularly scheduled sampling. Emergency sampling pick-up shall be coordinated with the COR and MCMWTC Environmental Office to determine

fastest delivery of samples to the lab. Reports of analytical results for all media must include the cited regulatory levels and flag any results exceeding regulatory levels, permit levels, MCLs, or PGHs.

Per permit requirements, annual drinking water results shall be submitted to California Department of Health Services (CA DHS) electronically from the laboratory though EDT using Primary Station Codes (PS Codes). The results of the drinking water monitoring shall be reported to CA DHS by the sixth day of the following month. A hard copy of this report shall be provided to the MCMWTC Environmental Office with emails in pdf format sent to the Chief Plant Operator, the Environmental Manager, and the Water Quality Manager. The actual analytical results shall also be available electronically in a data base spreadsheet that is up-loadable using an Excel compatible program. The results, QA/OC, chain-of-custody, etc. shall be provided to the Environmental Office in .pdf format.

Sampling requirements for MCMWTC Storm Water/NPDES requires at least two (2) storm events per year must be sampled. There are five (5) outfalls to be sampled for which the contractor shall provide sampling kits to the Environmental Office. The contractor shall provide a minimum of 2 sampling kits per outfall annually with 5 total kits being provided to the Environmental Office upon contract award. Sampling kits for the second storm water sampling event shall be provided as requested by the Environmental Office following the first event sampled.

Sampling Kits shall include sample bottles with preservative (as appropriate), labels, blue ice and cooler for shipping and to keep samples at the required temperature.

Sampling requirements for MCMWTC Hazardous waste testing shall be ordered by the Environmental Office using generator knowledge of waste streams to determine required analyses that will be ordered at a unit price. Hazardous waste profiling and supporting analytical testing are required on a regular basis (semi-annual to annual). Sampling requirements for MCMWTC Waste Water sludge shall be tested for Type 3 Municipal Landfill acceptance criteria.

The contractor shall provide these analyses of existing waste streams to ensure waste profiles are correct. The contractor shall provide sampling kits appropriate to tests requested by the MCMWTC Environmental Office.

Typical hazardous waste streams analyses that are required would normally be CAM metals, TPH (gas, diesel and waste oil), Flashpoint, EPA 8260 and EPA 8270. For the purpose of selecting ELINS per characterization, below are the lab tests that may be used:

• Used Oil: TPH Gas/ BTEX, TPH-Diesel, flashpoint, ethylene glycol, Title 22 Metals.

• Leaded Gasoline: TPH Gas / BTEX, flashpoint

• Diesel: TPH-Diesel, flashpoint

• JP-8: Fuel Fingerprint

• Contaminated Dirt with any combination of substances assuming unknown: Volatile Organics by EPA

Sampling requirements for MCMWTC Monitoring Wells #9, #10 and #11 (groundwater) are also required on a quarterly or annual basis depending upon the analyses.

The results shall be reported as indicated in the applicable permits and in a manner suitable to determine compliance. For example, all results must be reported to the method detection limits with estimated values provided between the method detection limits and reporting limits. Approved analytical methods from 40 CFR part 136 should be used when possible. If not possible, methods preapproved by the applicable regulatory agency as indicted by the COR will be used. Analytical methods should be selected that have minimum levels at or below the compliance limits. The reporting limits shall be at or below the compliance limits and minimum levels when possible.

All data deliverable packages shall be provided to the COR in order to meet MCMWTC water permit and regulation requirements. The contractor shall provide the monthly compilation of the data packages no later than the 6th day of the following month (i.e. the data package for September will be due no later than 6 October) on the contractor’s web portal or as directed by the COR. The contractor shall notify the COR by email that the data packages are ready to be viewed in the system. These data deliverable packages are a monthly compilation of all field test reports, laboratory tests reports and summary reports. The contractor shall provide early notification to the COR of preliminary results that may exceed permit limits so that parameter can be resampled, at the discretion of the Navy, within the same monitoring period.

Analytical data shall reference the Environmental Laboratory Services contract documents. Furthermore, a narrative summary cover page shall be included to final report deliverables discussing any anomalies experienced in the environmental sample(s). For example, if a sample was not properly preserved or holding time was not met according to EPA requirements but analysis was still performed on the sample as requested by the Government.

Additionally, analytical data should include the summary and required reports and provide electronic data deliverables as required by the MCMWTC Bridgeport water program. This includes, but is not limited to:

Chain of Custody (COC) and sample information shall be peer-reviewed and entered in the Navy

Environmental Laboratory Information Management System (LIMS).

Sample and analytical data shall be uploaded to the Naval Environmental Compliance Analytical Reporting

System (NECARS).

SECTION 3.0 – SPECIAL REQUIREMENTS/CONDITIONS

The contractor shall produce deliverables that do not require extensive revision/correction or extra effort for internal review and QA/QC. The contractor shall ensure that deliverables will not include any major technical and/or legal issues, or inconsistencies that require extensive re-write. The contractor shall correct any deficiencies identified by the Navy at no additional cost to the Government. The contractor shall respond to all comments from the environmental compliance community and regulatory agencies throughout the duration of this delivery order that address any deliverable.

The contractor shall obtain approval from the COR prior to obtaining photography records, still or motion picture and/or aerial or ground photographs, in accordance with Public Law: 18 U.S. Code 795 and applicable station regulations. The Government may provide a representative to act in an advisory capacity to prevent unauthorized disclosure of classified information.

No understanding, agreement, modification, change order, or other matter deviating from the terms of the basic contract and CTO between the Contractor and any person other than the Contracting Officer will be effective or binding upon the Government, unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the CTO. The Contracting Officer’s authorized representatives are:

(1) The Contracting Officers Representative (COR) is responsible to the Contracting Officer for monitoring performance and the technical management of the effort required under this CTO, and should be contacted regarding questions or problems of a technical nature. The COR is not authorized to make any commitments or changes that will affect price, quality, quantity, delivery, or any other term or condition of the contract.

(2) The Contract Specialist (CS) assists the Contracting Officer and should be contacted for all other contract administrative matters for this CTO.

Except for changes identified as such in writing and signed by the Contracting Officer, the Contractor shall notify the Administrative Contracting Officer in writing, within 30 calendar days from the date that the Contractor identifies any Government conduct (including actions, inactions, and written or oral communications) that the Contractor regards as a change to the contract terms and conditions.

The COR is the first and primary point of contact for ALL inquiries, questions, concerns, and issues related to the implementation of the technical requirements and specifications of this CTO. Subject Matter Experts (SMEs) are Government technical personnel providing assistance to the COR in the administration, oversight, and performance assessment of the CTO. Neither the COR, nor any other Government representative may direct any change that affects price, quality, quantity, delivery, or other terms and conditions of the basic contract or CTO.

The contractor shall not implement any change to the contract before receiving written authorization from; or a contract modification issued by the Contracting Officer.

Contractor employees performing services under this order will be controlled, directed, and supervised at all times by management personnel of the contractor. Contractor management will ensure that employees properly comply with the performance work standards outlined in the performance work statement. Contractor employees will perform their duties independent of, and without the supervision of, any Government official or other Defense Contractor. The tasks, duties, and responsibilities set forth in the task order may not be interpreted or implemented in any manner that results in any contractor employee creating or modifying Federal policy, obligating the appropriate funds of the United States Government, overseeing the work of Federal employees, providing direct personal services to any Federal employee, or otherwise violating the prohibitions set forth in Parts 7.5 and 37.1 of the Federal Acquisition Regulation (FAR). The Government will control access to the facility and will perform the inspection and acceptance of the completed work.

Public Affairs – The contractor shall not disclose any data resulting from actions in this contract to the news media or public. The contractor shall refer all press or public contacts to the COR. The contractor may not distribute reports or data to any other source, and shall follow the public affairs policies in accordance with NAVFAC Southwest instruction. The contractor shall provide copies of all correspondence to the COR.

SECTION 4.0 – GOVERNMENT FURNISHED EQUIPMENT/DATA

There is no government furnished equipment to be available at MCMWTC Bridgeport to the contractor for use under this contract. Government Furnished Property shall be in accordance with the basic contract and applicable modifications, Section J. Attachment JC-0200000-08.

In section 2.5 it calls for the results to be sent to CADHS. The regulator is now the State Water Resource Control Board Division of Drinking Water. The wastewater analysis all looks good. There is a lot missing on the water end. Both wells need to be sampled for the following:

Arsenic, Inorganic chemicals, General mineral, General physical, Synthetic organic compounds, Secondary/ General physical, nitrate, nitrite, perchlorate and Volatile organic compounds. 1.0 Introduction

The general scope of this statement of work consists of performing analytical services and reporting the results.

2.0 Scope

The contractor shall furnish all supervision, labor, materials, equipment, required testing, laboratory support, reports and incidentals necessary to perform laboratory analysis for storm water, wastewater, drinking water, and hazard waste profiling, to include courier services. To include appropriate notification of any result above MCL's (minimum contamination level), PHG (public health goal), or bacteriological exceedance on drinking water. The notification shall be made in accordance with regulatory requirements. The contractor shall perform all work neatly, accurately, correctly and conform to the respective specifications, standards, requirements, permits and in accordance to appropriate codes and practices to include all Federal, State, local government and MCMWTC Bridgeport base regulations, laws and permits.

2.1 Contractor shall provide analyses as requested in the following paragraphs, sampling kits and courier service from MCMWTC to Lab. The work shall include procurement of subcontractors, equipment and supplies as necessary.

2.2 Field implementation: The contractor shall provide courier services to pick-up regularly scheduled sampling. Emergency sampling pick-up shall be coordinated with Environmental Office to determine fastest delivery of samples to Lab. Reports of analytical results for all media must include the cited regulatory levels and flag any results exceeding regulatory levels, permit levels, MCL's or PGHs

2.3 The contractor shall provide sampling kits for Environmental Personnel to collect all samples.

Contractor shall provide courier service to pick up samples during working hours for lab analysis. Re-sampling and associated analyses shall occasionally be required on an emergency basis.

2.4 Hazardous waste profiling and supporting analytical testing are required on a regular basis (semi annual to annual).

2.5 Per permit requirements, annual drinking water results shall be submitted to California Department of Health Services (CA DHS) electronically from the laboratory though EDT using Primary Station Codes (PSCodes). The results of the drinking water monitoring shall be reported to CA DHS by the tenth day of the following month. A hard copy of this report shall be provided to the MCMWTC Environmental Office with emails in pdf format sent to the Chief Plant Operator, the Environmental Manager, and the Water Quality Manager. The actual analytical results shall also be available electronically in a data base spreadsheet that is up-loadable using an Excel compatible program. The results, QA/OC, chain-of-custody, etc. shall be provided to the Environmental Office in .pdf format.

2.6 Sampling requirements MCMWTC storm water/NPDES Analysis Requirements: At least 2 storm events per year must be sampled. There are five outfalls to be sampled for which the contractor shall provide sampling kits to the Environmental Office. The following tests are required:

2.7 Storm water sampling kits: minimum of 2 sets per outfall annually– 5 total minimum shall be provided to the Environmental Office at the beginning of the contract. Sampling kits for the second storm water sampling event shall be provided as requested by the Environmental Office following the first event sampled. Sampling Kits shall include sample bottles with preservative as required. Labels, blue ice and cooler for shipping and to keep samples on ice.

2.8.2 Bacteriological:

2.8.2.1 Minimum of two (2) presence/absence distribution system bacti samples are required monthly. If a positive result occurs, re-sampling must take within 24 hours. E coli results are required on all positive samples.

2.8.2.2 Minimum of two (2) MPN bacti samples from the Wells are required quarterly.

2.8.3 Contractor shall provide sampling kits – minimum of (2) months worth of sampling kits sets per location shall be provided at the beginning of the contract. Sampling kits shall include sample bottles with preservatives as required, labels, blue ice and coolers for shipping and to keep samples on ice.

2.9 MCMWTC Hazardous waste testing: These tests shall be ordered by the Environmental Office using generator knowledge of waste streams to determine required analyses that will be ordered at a unit price.

3.0 Period of Performance

The period of performance is 365 days from the contract award date. The period of performance may be extended at the governments interest by no more than 6 additional months or decreased as necessary at the governments interest to facilitate MCMWTC's compliance (i.e. all reports and reporting and standard operational procedures) with regional, state and/or federal requirements for storm water, ground water, waste water and potable water monitoring, sampling and reporting.

4.0 Contract Authority:

Notwithstanding any other provision of this contract, the Contracting Officer shall be the only individual authorized to redirect the effort or otherwise amend any of the terms of this contract.

5.0 Place of Performance

The place of performance is the MCMWTC, all areas, potable water wells, storm water outfalls, monitoring wells, other areas designated for sampling and associated facilities for onsite work. Offsite work (testing) will be done at contractor’s facility.

6.0 Government Furnished Property

There is no government owned equipment to be furnished to the contractor for use under this contract.

8.0 Non Personal Services

Contractor employees performing services under this order will be controlled, directed, and supervised at all times by management personnel of the contractor. Contractor management will ensure that employees properly comply with the performance work standards outlined in the statement of work. Contractor employees will perform their duties independent of, and without the supervision of, any Government official or other Defense Contractor. The tasks, duties, and responsibilities set forth in the task order may not be interpreted or implemented in any manner that results in any contractor employee creating or modifying Federal policy, obligating the appropriate funds of the United States Government, overseeing the work of Federal employees, providing direct personal services to any Federal employee, or otherwise violating the prohibitions set forth in Parts 7.5 and 37.1 of the Federal Acquisition Regulation (FAR). The Government will control access to the facility and will perform the inspection and acceptance of the completed work.
