23 ASI 5/19/2023

The 450 Day period of Performance listed in Amendment #0002 with dates of 8/7/2023 to 10/30/2024 seems to be very aggressive. If winter shutdowns are required, this only allows one construction season to perform all work on the project. Consider a longer period of performance that would allow a 2nd construction season (accounting for winter shutdown). 5/25/2023 See Amendment 3 for revised requirement. 6/5/2023

24 ASI 5/19/2023

Solicitation Section M.2.3.4.2 Key Personnel requires experience by the proposed team in successful execution of the following project aspects within the past 5 years. Please consider increasing the experience time limit for all Key Personnel from “within the past 5 years” to “within the past 10 years”. 5/25/2023 See Amendment 3 for revised requirement. 6/5/2023

25 ASI 5/19/2023

The Roller Compacted Concrete Foreman shall have installed no less than 50,000 CY of RCC within the past 5 years. This project involves only 17,000 CY of RCC. Please consider either reducing this requirement to match the project size and increasing the time limit from “within the past 5 years” to “within the past 10 years”. 5/25/2023 See Amendment 3 for revised requirement. 6/5/2023

26 ASI 5/19/2023

Spec 03 37 23 Section 1.04 Submittals A.3.c. requires Submittal of the NRMCA Certifications and calibration report before trial placement. Is an MRMCA Certification required for the Plant to be utilized to produce RCC or is only calibration in accordance with NRMCA procedures required? 5/25/2023

6/5/2023

27 ASI 5/19/2023

Spec 03 37 23 Section 1.04 A.4.b. requires the submission of an executed contract with an approved conveyor system supplier. Is there an “approved list” conveyor system suppliers? Are contractor-owned conveyor systems allowed or must a third party conveyor system be utilized? 5/25/2023 See Amendment 3 for revised requirement. 6/5/2023

28 ASI 5/19/2023

Specification 1.03 paragraph D defines a Cold Joint as a horizontal lift area of RCC that has a LJM of 1,000-degree F-hours. Given the design requires using Retarder and specifies an initial set of 18 to 24 hours, the 1,000-degree F-hour appears overly restrictive. The RCC is very likely to reach the 1000-degree F-hour prior to initial set [presuming planned summer-time placement schedule].

Can the 1000-degree F-hour cold joint requirement be relaxed to a range of 1,500- 1,800 degree-hours to better match the initial set of 18 – 24 hours requirement?

This would appear more appropriate for this RCC application. 5/25/2023

No change to requirements. See Specification 03 27 23 Roller Compacted Concrete, Section 3.06 B.5 for additional information. 6/5/2023

29 ASI 5/19/2023

The RCC specification 03 37 23 appears to be written for a much larger RCC dam construction project. Specification 1.04 paragraphs B2 lists multiple positions to be included in the RCC Personnel Plan: including “… the CONTRACTOR's project manager; project superintendent overseeing RCC operations; RCC production supervisor(s); RCC placing supervisor(s); quality control manager(s); and the on-site person(s) who will be responsible for day-to-day set-up, maintenance, and operation of the RCC production, delivery and placing operation.” If only one RCC crew is utilized, can the same person perform multiple roles (ie. can the RCC Superintendent and RCC Placing supervisor or the RCC Superintendent and RCC Production supervisor be the same person)? 5/25/2023 See Amendment 3 for revised requirement. 6/5/2023

30 ASI 5/19/2023

Spec 03 37 23 Section 1.04 Submittals B.2 RCC personnel. This section identifies numerous roles and qualifications including RCC production Supervisor and RCC Placing supervisor (two required each). The RCC Scope on this project is not large enough for the need to place RCC on multiple shifts requiring two of each position. If the RCC work will not be performed on multiple shifts, are two of each position still required? 5/25/2023 See Amendment 3 for revised requirement. 6/5/2023

31 ASI 5/19/2023

Spec 03 37 23 Section 1.05 Quality Assurance A.1. requires the Mix designer to be a Licensed Professional Engineer registered in the State of South Dakota with a minimum of 5 years of experience in the design of RCC Mixes for RCC Construction projects with a minimum of 50,000 CY of RCC placed for each project. 32 ASI 5/19/2023

Spec 03 37 23 Section 2.02 RCC Mixture paragraph D requires a Vebe time of 9 +/- 3 seconds. This Vebe time is not conducive to placing multiple lifts per shift when haul vehicle placement is used to move RCC to the point of placement on the RCC lift as allowed in the RCC specification. Please consider increasing the range of Vebe to 12 +/- 3 seconds? 5/25/2023 No change to requirements. 6/5/2023

33 ASI 5/19/2023

Spec 03 37 23 Section 3.03 4.b. Cold Joints within Lift: Whenever it is necessary to discontinue lift placement and produce a cold joint, it shall be located at least 30 feet from the location of other cold joints that may have previously occurred in the same direction in any of the previous 10 layers. Is this section referring to a vertical joint in the middle of a lift as opposed to the horizontal lift surface that may exceed the 1000 deg-F-hr limit and be classified as a Cold Horizontal Lift Joint? 5/25/2023 See Amendment 3 for revised requirement. 6/5/2023

34 ASI 5/19/2023

Spec 03 37 23 Section 3.06 E.2.b requires Vertical Contraction Joints to be formed using Galvanized Steel sheet metal minimum 14-gauge thickness with Plastic Sheeting or woven Geotextile. See Amendment 3 for revised requirement.

6/5/2023

36 ASI 5/19/2023

Spec 03 37 23 Section 2.02 G requires two horizontal samples by sawcut methods to be taken from the test section. Please provide dimensions of the horizontal sections to be cut from the RCC. 5/25/2023 See Amendment 3 for revised requirement. 6/5/2023

37 ASI 5/19/2023

Bid Items 16, 17, and 18 Item Supplies or Services states the items are for Cement, Fly Ash and Admixtures for RCC and CVC Facing. Item 19 Service Spillway Conventional Concrete description states that item 19 is for furnishing and placing reinforced Class C, D and RCC Facing Concrete. It also states that it Includes all concrete materials and admixtures. Are the Cement, Fly Ash and Admixture for the Class B RCC Facing Concrete paid separately under items 16, 17 and 18 or are they to be included in item 19 for the Service Spillway Conventional Concrete. 5/25/2023 See Amendment 3 for revised requirement. 6/5/2023

38 ASI 5/19/2023

Spec 03 30 00 Section 1.03 B. Mass Concrete - Is the Class B CVC Facing Concrete considered to be Mass Concrete even though it’s placed in multiple 12-inch thick layers? 5/25/2023 See Amendment 3 for revised requirement. 6/5/2023

If aggregate processing is not to be performed onsite, is this required? 5/25/2023 See Amendment 3 for revised requirement. 6/5/2023

40 ASI 5/19/2023

Spec 03 30 00 Section 1.04 A.10. Thermal Control Plan – Is a thermal control plan required for the RCC/CVC Facing portion of the spillway. 5/25/2023 See Amendment 3 for revised requirement. 6/5/2023

41 ASI 5/19/2023

Spec 03 30 00 Section 10.5 E.7 provides Tolerances for Control Structure & Chute Concrete Surfaces subject to High Velocity Water Flow. Does this section of the specification apply to the Service Spillway? If so, the 1/8” tolerance on exposed surfaces seems to be excessive. Please consider a greater allowable tolerance for the Service Spillway exposed surfaces. 5/25/2023 No change. 6/5/2023

42 ASI 5/19/2023

Spec 03 30 00 Section 2.02 C.1. requires Preliminary Mixture-Proportioning Studies at least nine months in advance of the time when placing of concrete is expected to begin. Based on the 450 day Period of Performance the 9-month advanced mix testing may not allow sufficient time to complete the project. 5/25/2023 See Amendment 3 for revised requirement. 6/5/2023

44 ASI 5/19/2023

Spec 03 30 00 sections 3.02, 3.04. This specification requires a central-mix batch plant equipped with dual-drums, a rescreening plant and a washing plant. This specification appears to be written for a much larger dam or lock project. Please be advised that to satisfy this requirement the Contractor will have to install a batch plant with a capital cost in excess of $5 million to produce less that 10,000 CY of CVC. None of the commercial ready-mix plants within the region satisfy this requirement Please consider revising the specification to allow either commercial ready mix, or a standard portable batch-plant on-site. 5/25/2023 See Amendment 3 for revised requirement. 6/5/2023

45 ASI 5/19/2023

Spec 03 30 00 section 3.02 A.1 requires the concrete batch plant to be equipped with dual drums. This seems excessive for the size of the project. If contractor can demonstrate that a single drum mixer will satisfy its production requirements will a single-drum be approved? 5/25/2023 See Amendment 3 for revised requirement. 6/5/2023

We have contacted the TERO office and they provided us with a the compliance plan information and we have the following questions and concerns:

1) The TERO compliance plan and office indicates a TERO tax of 4% and a 1% EPA fee and a 2% Excise tax , so 7% of total contract value is required to be paid to TERO. Please confirm this is accurate with the BIA as tis will be a signifigant amount for this size of a project and its important all bidders have it correctly accounted for.

2) In addition it states that contractors must hire 95% of the skilled, semi-skilled and clerical employees must be filled with local Indians or Indian Employees.

Although it would be great if the tribe has sufficient qualified workforce to fill these roles, the nature of the work and specialty scope (RCC, DSM, Cutoff Wall, etc.) concerns us as these trades are very limited in the workforce nationally. We intend to comply with the attempt to try and fill positions if the candidates meet or exceed the requirements but also feel 95% may be impossible to obtain. The agreement does allow for the contractor to justify the rejection of employees but we see a significant challenge that could result in tension between the tribe and the contractor. We will give every candidate a fair and reasonable accommodation but just do not believe that 95% will be achievable for the scope of work related to this project.

6/16/2023

TERO is a tribal law and BIA cannot speak to the specific requirements the Tribe has. Please contact the Tribe's TERO office for their requirement.

125 T1/MW

6/16/2023

In additon to the hiring criteria above, the specifications and the RFP require specific experience requirements including supervisors and foremen with up to 15 years of experience as well as key employees who run certain pieces of specialty equipment. The 95% requirement will be impossible to achieve and be able to utilize experienced personnel to do the specialty work. Please clarify.

6/16/2023

TERO is a tribal law and BIA cannot speak to the specific requirements the Tribe has. Please contact the Tribe's TERO office for their requirement.

The TERO office provided a waste permit application that will be required for the awarded contractor. We have asked if this will permit for free disposal of excess soil and rock within the reservation. The specs do state a waste area can be coordinated with the BIA. Please confirm that the intent is to waste on-site and if so what distance from the dam should the contractors assume for their bids. Also if the 1% EPA fee does not cover the on-site wasting fees please provide what that fee would be for each cubic yard of soil or rock to be wasted.

6/16/2023

The specifications state "Provide low ground-pressure (less than 250 psf) equipment to limit loads on the dam crest." This is only 1.74 psi and may be a mistake by GEI. We are working on another dam project with GEI which has nearly identical specifications, but is limited to 1,250 psf which is a much more reasonable 8.7 psi. Can you please verify this requirement? 6/16/2023 See amendment 4 for revised requirement.

Specification 03 30 00 Section 3.02 A 4. Amendment 3 does not appear to address questions #46 and #47 previously submitted. Subsections J and K of this specification require Re-screening and Washing of coarse aggregates for the conventional concrete immediately prior to batching. These requirements are unusual on a project of this small a magnitude (< 8,000 CY concrete), and for a structure of this configuration and purpose. Compliance with this requirement will substantially increase the cost to BIA. It is requested that these requirements be re-evaluated.” 6/16/2023 No change
