2. To address the following questions received from vendors in response to the RFP:
Question 32
Question 32: The flow down of ‘Buy American’ clauses is minimal, and appears to say – ‘list the components you intend to source from OCONUS, and the USG will then assess acceptability.’ Is that correct? Also, does that apply to overseas engineering design services
(hours) given only ‘Distribution A?’
Response 32: Yes, this is correct. Foreign made supplies must be identified per FAR 52.225-1 and 52.212-3 (f). Overseas engineering design services are not applicable. All Buy American requirements are identified in the contract.
Question 33
Question 33: (J4, 4.1j) Regarding Acoustic Sensor Calibration System - can more detail be provided on expected functionality and end use so that this can be fully integrated by KUTL during HAT?
Response 33: The government uses acoustic systems for quantitative echo measurements, these systems require regular calibration with a target sphere. This is a regular practice with split beam systems and multibeam systems and is regularly conducted with the SES SSV and their equipment. The general idea is to suspend a target sphere within the acoustic beam and then move the target throughout the beam to map out both the beam pattern and sensitivity of the system. The target strength (in effect, the acoustic reflectivity) of the sphere can be calculated analytically and confirmed in a lab. The split-beam sonar systems can locate the target within the beam, so control of the sphere is required, but not precise line-out measurements. The work is done in calm water with the ship at anchor or drifting.
For all systems, the target suspension needs to be kept clear of the hull. The target is suspended between 13 and 25 meters below the transducers. This requires some sort of outriggers. A minimum of three outrigger/ downriggers are required for three-dimensional control of the targets; four outriggers make control simpler.
The government has modified J.4 section 4.1j from “Two shielded cables shall be installed in parallel from the Scientific Server Room to each watertight junction box and terminated with connectors at each end. The shielded cables shall be constructed of 6 pairs of AWG bare copper, with all pairs enclosed in a polyester/aluminum shield. Cables shall be able to accommodate 30A at 12V. Three independent cables of the same type, 30.5 m (100 feet) in length each, with mating watertight connectors at each end shall be provided.” to “Two cables installed in parallel from the Scientific Server Room to each watertight junction box shall be provided. Each of these cables shall be of the same type, constructed of 2-conductor #10 AWG uncoated copper enclosed in a polyester/aluminum shield, 100 feet (30.5 m) in length each, with mating watertight connectors at each end.”
Question 34
Question 34: RFP_Class_B_1305M222RNMAN00157_051922; Section C-3.1.095f page 51 and Section C-3.1.095i page 52; "Equipment access and removal routes shall be verified by inspection of the actual installation and location of all equipment identified on the Shipbuilder's equipment removal routing plan and by actual removal and reinstallation of any two shipboard equipment items selected by the Government." and "The Contractor shall demonstrate equipment removal in accordance with the Equipment Removal Drawing. The Government may request the actual removal and reinstallation of up to five (5) shipboard equipment items to be demonstrated." Question: It appears that 3.1.095f and 3.1.095i are duplicate requirements. Will the Government remove 3.1.095i to remove the duplication?
Response 34: The Government agrees that there is a duplication of requirements between C-
3.1.095f and C-3.1.095i and will therefore delete clause C-3.1.095i. However please note that clause C-3.1.095f has been modified from:
“Equipment access and removal routes shall be verified by inspection of the actual installation and location of all equipment identified on the Shipbuilder's equipment removal routing plan and by actual removal and reinstallation of any two shipboard equipment items selected by the
Government. Where the selected equipment must pass through a WERP to be removed from the ship, the equipment will be moved to the WERP location without the WERP being removed.
Verification shall ensure the installations of identified equipment are in accordance with the plan and the equipment can be removed from the ship and removal routes are clear of non-removable interferences not identified on the plan.”
to:

Question 35
Question 35: Attachment J.1 Statement of Requirements; Section 583.2 page 149 and
Attachment J.9 Class B Price Schedule; "Two (2) Crewed Survey launches shall be provided in accordance with Attachment J.3 Crewed Survey Launch Requirements." and CLINS 0001,0006, 0012, 0017 state "INCLUDES ONE CREWED SURVEY LAUNCH." Question: How many
Crewed Survey Launch Vessel are to be priced with each NOAA Class B Vessel?
Response 35: Attachment J.1 section 583.b has been updated from “Two (2) Crewed Survey launches shall be provided in accordance with Attachment J.3 Crewed Survey Launch
Requirements.” to “Crewed Survey Launches shall meet the requirements of Attachment J.3
Crewed Survey Launch Requirements and the contract.” The CLIN description for the base vessels and option vessels remain the same to require a single crewed survey launch per CLIN.
Question 36
Question 36: RFP_Class_B_1305M222RNMAN00157_051922; Section B; (6) For OPTION
CLINS 0002, 0007, 0013, 0018 – VENDOR RECOMMENDED SPARES, VESSEL #’S 1, 2, 3
AND 4. The Offeror shall provide additional repair parts, spares, special tools, and support and test equipment as required by the Government. Orders for this effort shall be executed via bilateral contract modification. No action shall be taken by the Offeror without prior approval of the Contracting Officer (CO) or formally delegated representative. The stated material handling percentage proposed shall be applied to the proposed materials costs. The material handling percentage stated in the price schedule under CLINS 0002, 0007, 0013 and 0018 includes any applicable handling charges, storage, overhead, or other costs. Question: The Government has not identified a minimum level of vendor spares. This creates inconsistent responses between vendors potentially creating an unfair evaluation. Will the Government clarify that Section B is requiring only the identification of the material handling percentage associated with Vendor
Recommended Spares not a lot price for delivered spares?
Response 36: For the purposes of this proposal, the Government will use $3,000,000 per CLIN as the estimated base amount of the Vendor Recommended Spares. This amount is to be multiplied by the offeror’s material handling/markup rates for the evaluated price for these
CLINs. The Price Schedule and Section B of the RFP have been updated to reflect this.
Question 37
Question 37: RFP_Class_B_1305M222RNMAN00157_051922; Section I.1(P) and L.2(J);
L.2(J) page 140: "Proprietary Products/Information/Data As part of the Offeror’s Business
Proposals, Offerors shall disclose the use of proprietary products, information and/or processes.
Other than items allowed in the aforementioned disclosure, it is the Government’s desire that all noncommercial technical data (TD) and computer software (CS) and computer software documentation (CSD) be delivered with Unlimited Rights. If such noncommercial TD/CS/CSD contains elements generated previously with offeror’s own capital, with a minimum of
Government Purpose Rights (as defined in FAR 52.227-13 and 14). If the Offeror proposes to deliver commercial TD/CS/CSD, it is the Government’s desire to obtain a license to the commercial TD/CS/CSD that would grant the Government the rights to use and modify such data solely to maintain, repair, overhaul, modernize, and replace components, equipment, and parts of the vessel without the written permission or authorization of the Contractor. Offeror’s price proposal shall include all applicable licenses that are included in the Offerors’ technical proposal." Question: The only data rights clauses included in the solicitation are FAR 52.227-
14 and Alt II. These clauses do not provide a mechanism for the contractor to deliver technical data to the Government with rights other than Unlimited Rights or Limited Rights.
Notwithstanding this, the solicitation on p. 140 (Section L, Volume 1 – Business Proposal) appears to contemplate delivery of technical data subject to other licenses (for example, Government Purpose Rights) that are neither defined in nor contemplated by the included and cited data rights clauses. Page 140 references requirements from the DFARS that are not applicable to a FAR acquisition. Please remove the quoted content from the solicitation.
Response 37: Vendors are responsible for the software/equipment recommendations as part of their design and any required licenses. Any proprietary information needs to be marked and identified as so. Any restrictions on licenses or data use needs to be identified in the proposal.
DFARS is not references in the RFP.
Question 38
Question 38: Referring to Attachment J.1, Section 330.a, please confirm if refrigerated spaces may be illuminated with LED fixtures.
Response 38: The Government confirms that refrigerated spaces may be illuminated with LED fixtures.
Question 39
Question 39: Can a gondola or faired appendage design be added to the hull form to help achieve optimum sonar mission system performance?
Response 39: The Government will not entertain a gondola or faired appendage design due to the draft limitations of the expected harbors of operation.
Question 40
Question 40: (RFP C-3.1.426) Item 12 is DPINS, item 16 is Inertial Navigation System. The question is, is the DPINS considered the same unit as the survey dept INS - is intent the system is shared between the DP and scientific sonars or are redundant (separate) systems required?
Response 40: Yes, the dynamic positioning system and the scientific electronic system can use the same inertial navigation system.
Question 41
Question 41: Source Document: RFP_Class_B_1305M222RNMAN00157_051922 &
Attachment J.16 Class B Payable Event Schedule. Reference: FAR 52.232-16 PROGRESS
PAYMENTS (NOV 2021). Content Excerpt: The Government will make progress payments to the Contractor when requested as work progresses, but not more frequently than monthly, in amounts of $2,500 or more approved by the Contracting Officer, per Attachment J.16 Payable
Event Schedule and under the following conditions: (a) Computation of amounts. (1) Unless the
Contractor requests a smaller amount, the Government will compute each progress payment as
80 percent of the Contractor’s total costs incurred under this contract whether or not actually paid, plus financing payments to subcontractors (see paragraph (j) of this clause), less the sum of all previous progress payments made by the Government under this contract. The Contracting
Officer will consider cost of money that would be allowable under Federal Acquisition
Regulation (FAR) 31.205-10 as an incurred cost for progress payment purposes. Question: The
Attachment J.16 progress payment schedule explicitly shows a % payment for Payable Events throughout the contract, however FAR 52.232-16 PROGRESS PAYMENTS (NOV 2021) part
(a) states "the Government will compute each progress payment as 80 percent of the Contractor’s total costs incurred". These two (2) requirements appear to contradict each other regarding payment. Is the government requiring progress payments in accordance with J-16 payable events schedule or monthly payments at 80% of cost incurred?
Response 41: The Government will be following Attachment J.16 Payable Events schedule.
The Government may elect to amend the document during Final Negotiations. FAR 52.232-16
Progress Payments, has been removed from the RFP and replaced by new language in Section H
(Commercial Item Financing) and FAR 52.232-29 (added in 52.212-5) and 52.232-32 (added in
Section I).
