About this file
This is a Department of the Army Letter of Permission (LOP) issued by the U.S. Army Corps of Engineers, Charleston District, authorizing the USDA-Forest Service to construct recreational facilities at Buck Hall Recreation Area in McClellanville, South Carolina.
The permit (SAC-2023-00443) authorizes construction of a new kayak launch and extension of an existing fishing pier on the Atlantic Intracoastal Waterway. Specific authorized structures include an 8-foot by 80-foot ADA gangway leading to a 14-foot by 15-foot fixed deck and 12-foot by 40-foot floating dock for kayak operations, as well as a 6-foot by 20.9-foot walkway extending from the existing fishing pier to a new 12.7-foot by 27.2-foot fixed pierhead. The work is classified as minor in nature with no significant individual or cumulative impacts. The permit was issued October 16, 2024, with work completion required by October 16, 2029. However, the permit is provisional and contingent upon the permittee obtaining and providing a Coastal Zone Management Act (CZMA) consistency determination from the State of South Carolina prior to commencing work—without this state authorization, the LOP is not valid. The permittee must also provide as-built drawings prepared by a registered surveyor within 60 days of completion, submit a compliance certification within 60 days following completion, comply with U.S. Coast Guard requirements for safety lights and signals, install float stops on floating docks to prevent bottom contact, and adhere to extensive endangered species protection measures including manatee observation protocols, pile driving restrictions (maximum 12 hours per day with soft-strike procedures), vessel speed limitations, and siltation barrier requirements. Permittees are entitled to appeal the permit decision within 60 days of issuance.

DEPARTMENT OF THE ARMY
U.S. ARMY CORPS OF ENGINEERS, CHARLESTON DISTRICT
69A HAGOOD AVE, CHARLESTON, SC 29403
October 16, 2024
Regulatory Division
Mr. Jeremiah Zamora USDA-Forest Service 4931 Broad River Road Columbia, South Carolina 29063 jeremiah.zamora@usda.gov
Dear Mr. Zamora:
This is in reference to your February 15, 2024, request for a Department of the Army (DA) permit (SAC-2023-00443), which was considered complete on March 13, 2024, to perform work in or affecting waters of the United States; specifically, to construct a new kayak launch and extend an existing fishing pier. The work affecting waters of the United States is part of an overall project known as Buck Hall Recreation Area and Boat Landing improvements. The activities in waters of the US include the construction of a new kayak launch consisting of an 8-foot by 80-foot gangway leading to a 14-foot by 15-foot fixed deck and 12-foot by 40-foot floating dock, as well as an extension to an existing fishing pier consisting of a new 6-foot by 20.9-foot walkway leading waterward from the existing structure to a new 12.7-foot by 27.2-foot fixed pierhead. The project is located on the Atlantic Intracoastal Waterway (AIWW) at 8443 Highway 17 (TMS #7120000001) in McClellanville, Charleston County, South Carolina (Latitude: 33.0375°, Longitude: -79.5619°).
A review of the provided information indicates the work proposed is minor in nature, will not have significant individual or cumulative impacts, and is not contrary to the public interest; therefore, under the provisions of Section 10 of the Rivers and Harbors Act of March 3, 1899 (U.S.C. 403), this Letter of Permission (SAC-2023-00443) is issued to authorize the performance of the work in accordance with the attached drawing sheets 1-11 of 11 titled” Buck Hall Recreation Area Fishing Pier Extension and Kayak Launch” and dated March 26, 2024.
As of the date of this Letter of Permission, the U.S. Army Corps of Engineers, Charleston District (Corps) has not received a Coastal Zone Management Act (CZMA) consistency determination from the State of South Carolina for the work; therefore, this Letter of Permission is provisional. In accordance with Special Condition ‘a’ below, the permittee must obtain and provide the Corps with an individual Coastal Zone Management Act concurrence from the State prior to beginning the authorized work.
For this Letter of Permission to be valid, the project must comply with the following General Conditions:
a. The time limit for completing the work authorized ends on October 16, 2029. If you find that you need more time to complete the authorized activity, submit your request for a time extension to this office for consideration at least one month before the above date is reached.
b. You must maintain the activity authorized by this permit in good condition and in conformance with the terms and conditions of this permit. You are not relieved of this requirement if you abandon the permitted activity, although you may make a good faith transfer to a third party in compliance with General Condition ‘d’ below. Should you wish to cease to maintain the authorized activity or should you desire to abandon it without a good faith transfer, you must obtain a modification of this permit from this office, which may require restoration of the area.
c. If you discover any previously unknown historic or archeological remains while accomplishing the activity authorized by this permit, you must immediately notify this office of what you have found. We will initiate the federal and state coordination required to determine if the remains warrant a recovery effort or if the site is eligible for listing in the National Register of Historic Places.
d. If you sell the property associated with this permit, you must obtain documentation from the new owner that they accept the transfer of this permit. Submit a copy of this documentation with a copy of the permit to this office to validate the transfer of this authorization.
e. You must allow representatives from this office to inspect the authorized activity at any time deemed necessary to ensure that it is being or has been accomplished in accordance with the terms and conditions of your permit.
Additionally, for this Letter of Permission to be valid, the project must comply with the following Special Conditions:
a. That prior to beginning the authorized work, the permittee must obtain and provide the Corps with a copy of all requisite state authorizations (e.g., State Coastal Zone Management Act concurrence, State Navigable Waters Permit, etc.). This PROVISIONAL Letter of Permission is NOT VALID until the permittee obtains and provides the requisite state authorization(s) in accordance with this special condition.
b. It is recognized that this structure is to be constructed on/or adjacent to an area subject to a prism and/or disposal easement held by the United States in perpetuity in conjunction with a Congressionally authorized project for the maintenance and improvement of the Atlantic Intracoastal Waterway.
This permit does not convey any property rights either in real estate or material or any exclusive use privileges; nor does it relinquish any right the United States has for the use of its easement or the maintenance and future widening or deepening of the Atlantic Intracoastal Waterway pursuant to its easement rights.
c. It is understood and agreed that if the District Commander determines this structure shall in any way in the future conflict with the improvement, operation, maintenance and widening or deepening of the Atlantic Intracoastal Waterway, the owners themselves, their heirs, successors and assigns will remove said structure within 45 days from the date that written notice is given by the District Commander, and there shall be no entitlement to compensation from the United States for damage or injury.
d. Conveyance of this permit applies only to the structure authorized and does not authorize the construction of any permanent structure or any structure suitable for habitation or any utility leading either to permanent structures suitable for habitation or to permanent structures within the bounds of areas on which the Corps of Engineers enjoys easement rights.
e. The permittee agrees that no permanent structures, beyond those authorized by this document, will be placed on the prism easement or on any adjacent disposal easement without written approval of the District Commander.
f. That the Secretary of the Army, representing the United States of America, hereby consents to the herein authorized facilities or structures to be located on or across easement lands vested in the United States of America for the construction and operation of the Atlantic Intracoastal Waterway. The permittee shall not engage in any act which may interfere with or abridge the easement interests of the United States, except those specifically authorized herein.
g. That the permittee agrees to provide, as a part of the completion notification, as-built drawings which indicate all dimensions of the structure as well as the distance between the edge of the federal channel, and the waterward edge of the authorized structure. The drawings should also include the State Plane Coordinates, NAD 1983, for a minimum of two corners on each structure where it is closest to the federal channel. These drawings must be prepared by a registered land surveyor and submitted within sixty (60) days of the completion of the structure. Failure to provide these drawings will result in non-compliance with the permit and further enforcement action will be taken.
h. The permittee agrees to provide all contractors associated with construction of the authorized activity a copy of the permit and drawings.
A copy of the permit must be available at the construction site at all times.
i. The permittee shall submit a signed compliance certification to the Corps within 60 days following completion of the authorized work and any required mitigation. The certification will include:
1. A copy of this permit.
2. A statement that the authorized work was done in accordance with the Corps authorization, including any general or specific conditions.
4. The signature of the permittee certifying the completion of the work and mitigation.
j. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or their authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration.
k. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the U.S.
l. The permittee must install and maintain, at their expense, any safety lights and signals prescribed by the U.S. Coast Guard (USCG), through regulations or otherwise, on authorized facilities. The USCG may be reached at the following address and telephone number: (as of February 2013) U. S. Coast Guard District Seven, Waterways Management Branch, 909 SE 1st Ave, Suite 406, Miami, FL. 33131, and 305-415-6755 or 305-415- 6750.
m. Floating docks shall be located in areas of adequate depth to ensure that clearance between the float and the bottom is maintained at all times. In areas where the depth is not adequate to maintain clearance, floating docks shall be fitted with structures (i.e. float stops) that prevent the float from contacting the bottom.
n. If any previously unknown historic, cultural or archeological remains and artifacts are discovered while accomplishing the activity authorized by this permit, the permittee must immediately notify the district engineer of what has been found, and to the maximum extent practicable, avoid construction activities that may affect the remains and artifacts until the required coordination has been completed. The district engineer will initiate the Federal, Tribal and state coordination required to determine if the items or remains warrant a recovery effort or if the site is eligible for listing in the National Register of Historic Places.
o. In order to ensure protection of any threatened or endangered species, and designated critical habitat that may be present in the vicinity of the project area during construction activities, the permittee will comply with the following:
1. The permittee shall instruct all personnel associated with the project of the potential presence of and the need to avoid collisions with protected species, which may include but is not limited to West Indian manatees, Atlantic sturgeon, shortnose sturgeon, sea turtles, wood stork, blue whale, fin whale, humpback whale, North Atlantic right whale, sei whale and sperm whale.
2. The permittee shall advise all construction personnel that there are civil and criminal penalties for harming, harassing, or killing protected species, to include manatee(s), which are protected under the Marine Mammal Protection Act of 1972 and/or the Endangered Species Act of 1973.
3. Any siltation barriers used during the project shall be made of material in which protected species, to include manatee(s), cannot become entangled and must be properly secured, and regularly monitored to avoid protected species entrapment.
4. All vessels associated with the project shall operate at "no wake/idle" speeds at all times while in the construction area and while in water where the draft of the vessel provides less than a four-foot clearance from the bottom. All vessels will follow routes of deep water whenever possible.
5. If protected species, to include manatee(s), are seen within 100 yards of the active construction area all appropriate precautions shall be implemented to ensure protection of the protected species, to include manatee(s). These precautions shall include the operation of all moving equipment no closer than 50 feet to a protected species, to include manatee(s). Operation of any equipment closer than 50 feet to a protected species, to include manatee(s), shall necessitate immediate shutdown of that equipment. Activities will not resume until the protected species, to include manatee(s), has departed the project area of its own volition.
6. Incidents where any individuals of sea turtles, Atlantic sturgeon, shortnose sturgeon, blue whale, fin whale, humpback whale, North Atlantic right whale, sei whale and sperm whale listed by NOAA Fisheries under the Endangered Species Act appear to be injured or killed as a result of discharges of dredged or fill material into waters of the United States or structures or work in navigable waters of the United States authorized by this DA permit shall be reported to NOAA Fisheries, Office of Protected Species at (727) 824-5312, the SCDNR Hotline at 1-800-922-5431, and the Regulatory Office of the Charleston District of the U.S. Army Corps of Engineers at (843) 329-8044. The finder should leave the animal alone, make note of any circumstances likely causing the death or injury, note the location and number of individuals involved and, if possible, take photographs. Adult animals should not be disturbed unless circumstances arise where they are obviously injured or killed by discharge exposure, or some unnatural cause. The finder may be asked to carry out instructions provided by NOAA Fisheries, Office of Protected Resources, to collect specimens or take other measures to ensure that evidence intrinsic to the specimen is preserved.
7. The permittee understands and agrees that all in-water lines (rope, chain, and cable, including the lines to secure turbidity curtains) must be stiff, taut, and non-looping. Examples of such lines are heavy metal chains or heavy cables that do not readily loop and tangle. Flexible in-water lines, such as nylon rope or any lines that could loop or tangle, must be enclosed in a plastic or rubber sleeve/tube to add rigidity and prevent the line from looping and tangling. In all instances, no excess line is allowed in the water. Where appropriate, in water wires should be fitted with PVC sleeve from the surface to the bottom to prevent any potential scraping of the passing manatees.
8. The permittee understands and agrees that pilings will be installed using a water jet or vibratory hammer, to the maximum extent practicable.
In the event standard pile driving (impact hammer) is utilized, the permittee understands and agrees that a soft-strike procedure (three strikes at 40%-
60% energy level once a minute for 3 minutes) must be conducted prior to beginning pile driving activities and after any pile driving interruptions of more than 30 minutes.
9. That the permittee understands and agrees that pile driving activities must be limited to 12 hours per day with a 12-hour rest period between pile driving activities to avoid potential cumulative noise impacts to Federally-listed Threatened and Endangered (T&E) species.
p. In order to ensure protection and reduce potential construction-related impacts to West Indian manatees that may be in the vicinity of the project area during construction activities, to discountable and insignificant levels, the permittee will comply with the following for all projects affecting the coastal waters of South Carolina:
1. The permittee shall instruct all personnel associated with the project of the potential presence of manatees and the need to avoid collisions with manatees. All construction personnel MUST monitor water-related activities for the presence of manatee(s).
2. Any collision with and/or injury to a manatee shall be reported immediately to the U.S. Fish and Wildlife Service contacts: Melanie Olds, South Carolina Manatee Lead, Charleston Field Office, at 843-727-4707 ext.
205; or Terri Calleson, Manatee Recovery Coordinator, North Florida Field Office, at 904-731-3286.
q. That the permittee understands consultation pursuant to Section 7 of the Endangered Species Act of 1973, as amended was conducted using the U.S. Fish and Wildlife Service's (USFWS) Interim Consultation Framework Guidance for Northern Long-Eared Bat (Interim Guidance). Therefore, if this Interim Guidance is modified or revoked before certain activities, including but not limited to tree cutting, limbing, trimming, and/or topping activities associated with this Department of the Army permit have been completed, additional consultation with the USFWS may be required and this DA Authorization may be suspended until consultation with USFWS has concluded.
This Letter of Permission does not obviate the necessity of obtaining any other state or local approvals that may be required by law. You should contact the South Carolina Department of Environmental Services (SCDES) to ascertain any additional requirements (beyond the requirement per Special Condition ‘a’. above) they may have before performing any work that may be subject to their jurisdiction. By copy of this letter, I am forwarding all relevant information to the SCDES for necessary action.
The proposed activity authorized by this letter of permission must be completed by the date referenced in General Condition ‘a’. Per Special Condition ‘i’, please promptly submit the attached Compliance Certification Form when work is completed.
In all future correspondence, please refer to file number SAC-2023-00443. A copy of this letter is forwarded to State and/or Federal agencies for their information. If you have any questions, contact Kristopher Maedke-Russell, Project Manager, at 912-856- 8203, or by email at kristopher.d.maedke-russell@usace.army.mil.
