About this file

This document consists of two determinations of non-susceptibility for award issued by the Arizona Department of Economic Security (ADES), dated June 23, 2025, for Solicitation BPM006864 regarding Pest Control Services. The determinations were executed by Yesenia Sandoval, Chief Procurement Officer, and document the rejection of two vendors' proposals during the evaluation period. The original solicitation was posted on March 19, 2025, with a proposal submission deadline of April 9, 2025.

KCSR Inc. was deemed not susceptible for award after failing to substantially meet one or more mandatory requirements of the solicitation and demonstrating inferior comparative merit relative to other offers. Koehler Enterprises was similarly disqualified for failing to substantially meet mandatory requirements and, more specifically, for failing to correct a material discrepancy whereby the legal entity submitting the offer did not align with the entity identified in the contract documents. The latter deficiency violated the fundamental requirement that the contracting entity must be identical to the offeror of record. Although Koehler Enterprises was notified of this discrepancy during the evaluation period, the company did not take corrective action. Both determinations were made in accordance with A.A.C. R2-7-C311 and A.A.C. R2-7-C316.
