About this file
This document outlines payment terms for a maintenance dredging project on the Hudson River in New York. The U.S. Army Corps of Engineers is soliciting bids to dredge the Port of Albany Turning Basin to required depths and slopes. Payment will be made by cubic yard dredged based on before and after surveys of the area. Mobilization and demobilization costs will be paid as lump sums, with 60% paid upon mobilization and the remainder with final payment. Bidders should consider potential shoaling before and after dredging in their per cubic yard rates. The contractor must inform the government upon completing dredging to initiate the final survey.

PART 1 GENERAL
SECTION 01 22 00.00 10
MEASUREMENT AND PAYMENT
03/21
1.1 SUBMITTALS
Government approval is required for submittals with a "G" designation;
submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. The following shall be submitted in accordance with Section 01 33 00 SUBMITTAL PROCEDURES:
SD-02 Shop Drawings
1.2 JOB PAYMENT ITEMS
Payment items for the work of this contract for which contract job payments will be made are listed in the BIDDING SCHEDULE and described below. All costs for items of work, which are not specifically mentioned to be included in a particular job or unit price payment item, shall be included in the listed job item most closely associated with the work involved.
The job price and payment made for each item listed shall constitute full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for which separate payment is not otherwise provided.
1.2.1 Mobilization and Demobilization
1.2.1.1 Payment
Payment will be made for costs associated with mobilization and demobilization, as defined in Special Clause PAYMENT FOR MOBILIZATION AND
DEMOBILIZATION.
Mobilization shall include all costs for operations accomplished prior to commencement of actual dredging operations, such as transfer of dredge and attendant plant and equipment to site, initial installations of pipe and other incidentals in advance of the actual dredging. Demobilization shall include general preparation for transfer of plant to home base, removal of pipelines, placement site stabilization, and transfer of plant to its home base. The cost of work other than mobilization and demobilization of the
Contractor's dredging plant and equipment shall not be included in this item. For payment for Mobilization and Demobilization see contract clause
Section 00 72 00 Contract Clauses.
All costs connected with the mobilization and demobilization of all of the contractor's dredging plant and equipment will be paid for at the contract lump sum price for this item. 60 percent of the lump sum price will be paid to the Contractor upon completion of his mobilization to the work
SECTION 01 22 00.00 10 Page 2 site. The remaining forty percent 40 percent will be included in the final payment for work under this contract.
In the event the Contracting Officer and/or his Representative considers that the amount in this item 60 percent, which represents mobilization, does not bear a reasonable relation to the cost of the work in this contract, the Contracting Officer and/or his Representative may require the Contractor to justify this portion of the bid. Failure to justify such price to the satisfaction of the Contracting Officer and/or his
Representative will result in payment of actual mobilization costs as determined by the Contracting Officer and/or his Representative, at the completion of mobilization and payment of the remainder of this item in the final payment under this contract. The determination of the
Contracting Officer and/or his Representative is not subject to appeal.
1.3 UNIT PRICE PAYMENT ITEMS
Payment items for the work of this contract on which the contract unit price payments will be made are listed in the BIDDING SCHEDULE and described below. The unit price and payment made for each item listed shall constitute full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for each of the unit price items.
1.3.1 Dredging
1.3.1.1 Payment
Payment will be made for costs associated with dredging of the project, which includes performing required dredging and other operations incidental thereto Government-furnished disposal area(s) and disposition of dredged material.
1.3.1.2 Measurement
The total amount of material removed and paid for under the contract will be measured by the cubic yard dredged. Measurement of the number of cubic yards dredged will be made by computing the volume between the bottom surface shown by soundings of the last survey made before dredging and the bottom surface shown by soundings of the survey made as soon as practicable after the entire work specified has been completed. The volume for measurement shall include the material within the limits of the overdepth and side slopes described in SECTION 35 20 23, Paragraph 3.2.7 Layout of Work, 3.2.7.1 Overdepth Dredging, and 3.2.7.2 Side Slopes.
The soundings maps and or drawings accurately represent the channel conditions existing between August and October 2020 (Port of Albany
Turning Basin, NY). The soundings shown on the contract drawings were taken with an electronic depth recorder and/or multi-beam surveying system with a transducer frequency of 200-400 KHz. Soundings after dredging will be made by using a multi-beam surveying system of the same frequency.
After- dredging-surveys will be completed generally within five days of completion of the project. Determination of quantities to be paid in the area specified after having been made once, will not be reopened, except on evidence of collusion, fraud or obvious error. Computations for payment purposes will generally be made by the Corps of Engineers utilizing the
Triangulated Irregular Network (TIN) method.
Shoaling in the areas to be dredged on this project does not occur at a
SECTION 01 22 00.00 10 Page 3 rapid rate from existing depths. However, the unit price for dredging based on the above method of computation of the quantity for which payment is to be made shall include the Contractor evaluation of shoaling, changes in the regime of the waterway, or changes caused by the Contractor's operations that may occur during the period between the survey before dredging and the survey for acceptance of work.
Scows and Hopper Dredges: Where scows and hopper dredges are used in performance of work and where the Contractor maintains load measuring devices on such scows or hopper dredges, copies of all recorded measurements made in connection with the work shall be furnished to the
Contracting Officer and/or his/her representative. If as the work progresses the Contractor determines that a significant difference exists between the recorded bin or scow quantities and the survey quantities computed from the check surveys described above, he shall immediately notify the Contracting Officer and/or his/her representative of any such discrepancies. Such notification shall include a description of the
Contractor's methods of measuring scow or bin quantities, certification of measuring techniques, documentation of material sampling and methods used to convert bin or scow measurements to in-place density.
It is emphasized that bin or scow measurements shall not be used as basis for partial or final payments.
14-day partial payments will be based on approximate quantities determined by soundings or sweepings taken behind the dredge by the Contractor. The
Contractor soundings are to be used for partial payments only and will not form a basis for the acceptance of the work.
The Contractor must inform the Government, in writing, within three calendar days of completing the work.
The total quantity of excavated material for which payment will be made will be the theoretical quantity between the ground surface as determined by a survey and the grade and slope of the theoretical cross sections indicated. No allowance will be made for the removal of any material outside the required slope lines unless authorized.
When the Government perform surveys using multibeam, the data will be binned using the median soundings for contours and volumes. The maximum bin size will not exceed 3'x3'.
In the event that unforeseen obstructions or hard material is discovered, shoals in these areas will be assessed using the minimum sounding within the bin. This method will not be used for computation.
1.3.1.3 Unit of Measure
Unit of measure: cubic yard (CY).
