Solicitation questions through January 3
1. Is there a maximum EMR rating that you will accept for the proposal?
Answer: We do not ask for the EMR rating.
2. Exhibit B - Does the sub-contractor fill this out and send directly to the Contracting Officer, or does the subcontractor fill it out and send to the Prime Contractor bidding this project? Binder #2 – Volume 2, Past Performance Information makes it sound like we send it with our bid package. Where to Exhibit C states that the sub-contractor consent form goes directly to the Contracting Officer. Please let us know how to proceed with this one.
Answer: Exhibit B you submit with Binder 2 and just allows us to talk with the Prime submitting the bid about that subcontractor should we have questions. It gives us permission to discuss any good or bad performance experience they have had in the past.
Exhibit C is the PRIME’s past performance review that comes from other people. So the 6 projects that you list in your exhibit A, you send out an exhibit C to the owner of that project. The owner then fills out the review and sends it directly to the Contracting Officer.
If you are relying on a major subcontractors actual past performance because you lack the past performance yourself, then it would be best if you annotated that on the Exhibit A and on the Exhibit C. That way, when the Exhibit C comes into us, we will know that you are utilizing that subcontractor as your relevant past performance. And the sub-contractor will still need to fill out an Exhibit B so we can be allowed to use their past performance review.
3. The RFP states in 2.2.4. Offerors lacking relevant Past Performance experience may submit information regarding predecessor companies, key personnel who have relevant experience or subcontractors that will perform major or critical aspects of the requirement if such information is relevant to this acquisition In this case, offerors shall W912L9-13-R-0002 Page 27 of 139
Question 1: Can the predecessor company be a company that I was an executive and/or Key Personnel at, or does it have to be a company that I have once owned?
Answer: It can be any, executive, key personnel or a company you owned.
Question 2: Also if I had owned a company in the past that I have performed contracts of this nature can I utilize this past performance even though it has been more than 5 years, because this was a predecessor company?
Answer: The solicitation states in section 2.2.1 and again on Exhibit C the projects you use for past performance evaluations should not have been completed any earlier than 5 years prior to the solicitation issue date.
