| # in Attach 00XX | Question Reference (RFP #, PWS #, etc.) | RFP Text | Question | Response |
| ATT 0023 TD-02 | Amendment 0006 incorporated a revised TD-02 with changes to CLIN 5GA, Rail Operations. There is a note which states, "Note: Rail positions will not have an SCA labor category." Can you explain the thought process with excluding this from the Service Contract Act? The Service Contract Labor Standards statue indicates that only if published tariff rates are in effect would it be excluded. Further guidance from the DOL states that if the primary employees engaged in rail operations would be "service employees," performing maintenance support services or other types of services, they would be included and conformed positions should be submitted for DOL review. Are there conformed positions in place for these services? | The two rail positions are not listed as DOL recognized categories and are not on published lists of SCA labor Categories. They are Locomotive Operator/Engineer and brakeman/ switcher. This is why they cannot have SCA numbers in proposals, they are not DOL SCA categories. Offeror can propose positions that are reasonable and feasable to perform the requirement in the solicitation. | ||

B08-Attachment 0007- Department of Labor Wage Determination 31MAY2024 Note: Rail positions will not have an SCA labor category. The workload data for CLIN 0005GA Rail Operations was revised in Amendment 0006 and now includes a note that says, "Note: Rail positions will not have an SCA labor category".
| Question: will the Government please provide the labor category(ies) and SCA equivalent mapping it considers to be technically acceptable for the three positions (5,568 hours) required for Rail Operations? | The two rail positions are not listed as DOL recognized categories and are not on published lists of SCA labor Categories. They are Locomotive Operator/Engineer and brakeman/ switcher. This is why they cannot have SCA numbers in proposals, they are not DOL SCA categories. Offeror can propose positions that are reasonable and feasable to perform the requirement in the solicitation. | |

RFP, W519TC23R0102, L.5.2.1.1(c)(4) Note: Rail positions will not have an SCA labor category.
L.5.2.1.1(c)(4) COMPLIANCE REQUIREMENT: Failure to provide the Staffing/ Labor Mix Attachment 0002 in the Government provided format, in compliance with L.5.2.1.1(c)(3) and L.5.2.1.1(c)(3)(i), and to provide the following required information, shall render the Offeror's proposal non-compliant, and the proposal will not be evaluated and will not be further considered for award: proposed hours per FTE for both the base period and option periods 1-4; FLC1/FLC2; identification of SCA/Exempt; SCA Code; Offeror Position Title; and identification of Functional Area. The workload data for CLIN 0005GA Rail Operations was revised in Amendment 0006 and now includes a note that says, "Note: Rail positions will not have an SCA labor category". Also, there is an Attachment 0002 compliance requirement in L.5.2.1.1(c)(4) mandating Offerors include a designation of "SCA/Exempt" and provide an "SCA Code" when proposing an FLC1 position who will be performing the work scope.
| Question: Will the Government please clarify how Offerors are able to comply with the conflicting the conflicting compliance requirement and updated workload data explanations? | The two rail positions are not listed as DOL recognized categories and are not on published lists of SCA labor Categories. They are Locomotive Operator/Engineer and brakeman/ switcher. This is why they cannot have SCA numbers in proposals, they are not DOL SCA categories. Offeror can propose positions that are reasonable and feasable to perform the requirement in the solicitation. | ||||
| N/A | N/A | Are Offerors to submit only change pages or entire files with their updated proposal? | Due to requested updates/revisions on amendment 0007 offerors are to make all necessary revisions as applicable | ||
| N/A | N/A | Will the Government please provide guidance on how to make any changes in the documents (Excel and Word) as it relates to Amendment 0006. | Due to requested updates/revisions on amendment 0007 offerors are to make all necessary revisions as applicable | ||
| Amendment 0006, Conformed RFP Amendment 0003 - Section L.4.1.1 | Comment: Amendment 0006, Section A requests offerors to make revisions only to address those changes identified in Paragraph 1. The only changes identified in Paragraph 1 are updating Attachment 0023 TD-02 Workload Data and Density List. However, Amendment 0006 also provides an updated due date and the RFP Submission Instructions provide that all documents must contain the date of submission in the file header and/or footer. |
Question 1: Should offerors resubmit ALL documents in response to Amendment 6 with the updated submission date or only those files revised due to the changes in Paragraph 1?
| Question 2: If offerors are to only submit files affected by the changes identified in Paragraph 1, are offerors to continue to comply with the original Naming Conventions provided in the Submission Instructions or use an alternate Naming Convention to identify revised files? | Due to requested updates within AMD 0007 offerors are to make all necessary revisions as applicable. The alternate naming convention should utilize "Rev#" to clearly idenity the revised files. | ||
| Amendment 0006 | Question 1: Are offerors to use track changes or highlight changes made to clearly identify revisions made due to Amendment 0006? |
Question 2: If track changes are requested, will the Government provide additional page allocation for the SMP to accommodate the necessary space required for identifying both deleted and added text?
| Concern: if track changes are requested and the page count is not increased, there could be a need to alter content unrelated to Amendment 0006 simply to remain within the original page limit, which would appear to be in contradiction to the Amendment 0006 instructions for offerors to make revisions only to address those changes identified in Paragraph 1. | Tracked changes are not requested | |||
| Amendment 0006 | Question 1: If offerors have received meaningful past performance information from proposed subcontractors since the original submission date, are they permitted to provide such updated information with the Amendment 0006 response? | Due to requested updates/revisions on amendment 0007 offerors are to make all necessary revisions as applicable | ||
| Amendment 0006 incorporated a change to the TD-02. This change will affect all Proposal Submission Volumes (1, 2, 4, and 5), with the only exception being Volume 3 Past Performance. Due to the magnitude and complexity of this requirement as an unrestricted RFP, necessitating coordination with offerors' small business partners with respect to Volumes 4 & 5, and that the Government has not yet responded to Industry questions, would the Government please extend the proposal due date to ensure offerors have at least three (3) full weeks after receiving responses to any questions, and any additional/amended attachments? | Due to requested updates/revisions on amendment 0007 offerors are to make all necessary revisions as applicable | |||
| RFP W519TC23R0102-0006 | The post-submission Amendment 0006 provides bidders with a submission suspense date but does not include submission instructions. Traditionally, revisions provided after submission are handled as Evaluation Notices (EN) and include a full or partial resubmission of materials, with changes clearly identified. |
With the emphasis that EAGLE bids place on full compliance, bidders require guidance on how they are to respond to Amendment 0006. For example, are bidders to:
• Resubmit all files whether they have been updated or remain unchanged?
• Resubmit only files with content changes (excluding changes to header/footer updates)?
• Resubmit files with updated header submission dates, whether they contain Amendment 0006 content changes or are otherwise unchanged?
• Annotate changes to Word/PDF files, using the MS TrackChange feature?
• Revise Excel worksheets by highlighting in yellow the changed cells and coloring the font red?
| • Update the submission date on all file headers and title pages? QUESTION: Would the Government please provide Amendment 0006 response instructions? | Due to requested updates/revisions on amendment 0007 offerors are to make all necessary revisions as applicable | ||||
| RFP W519TC23R0102-0006, Section L.2.8 | Section L.2.8 states, "L.2.8 For the purposes of proposal preparation and evaluation only, the Offeror shall use 07 February 2025 as the Notice to Proceed (NTP) date. Proposal information shall reflect that NTP date." | QUESTION: Would the Government please confirm that the NTP date remains 07 Feb 2025, or provide a revised date? | NTP date has not changed at this time. | ||
| RFP W519TC23R0102-0006, | |||||
| Box 11 | Since the proposal documents are highly interconnected with one another, a revision in any one element of the bid has a ripple effect throughout multiple files. Revisions made in response to Government responses to bidder questions will need to be carefully flowed through multiple files throughout the proposal response. | REQUEST: We request the Government extend the submission date by seven calendar days from the date the Government provides Q&A responses. | Regarding extension of submission date, please see Amendment 0007 Section A. | ||
| Amendment 0006 | Page 2, Paragraph A.2 | Paragraph states that that “Proposal revisions are to address only those changes identified in paragraph 1. Above, on updated Attachment 0023 TD-02 Workload Data and Density List”; | The modifications resulting from Amend #6 will impact several of our Proposal documents. On other EAGLE proposals we have been directed to return a copy of all volumes impacted with changes in red. In this case, what is the Government’s preference for amending our proposal? Do you want a full new submission or a partial resubmittal of only changed sections? | Due to requested updates/revisions on amendment 0007 offerors are to make all necessary revisions as applicable | |
| 0001 PWS | PWS Paragraph 5.34 | Para 5.34, Rail Operations, is not consistent with the requirements directed by Amend #6. Requests the Government revise the PWS to remove the inconsistency. | The USG believes all requirements are addressed in the PWS 5.34 Rail Operations. | ||
| 001 PWS/ B08 Attachment 0023 | PWS Paragraph 5.34.1-3 Rail Operations page 61 / B08 Attachment 0023 TD-02 Workload Data and Density List V-8 | The PWS updated in Amendment 0002, B08 Attachment Jun 2024, Transportation, paragraph 5.34.1-3 Rail Operations, page 61, does not mention anything about having to operate, drive, or conduct switching operations as part of this requirement. However, in Amendment 0006 – B08 Attachment 0023 TD-02 Workload Data and Density List V-8 202408.xlsx under Transportation Workload Data, Line 30, ISR 908 RJT9 MOB/DEMOB – CLIN 0005GA Rail Operations in Lines 32-34 now list a requirement to manage safe operations of train and crew, drive a train and operate train switches, none of these tasks are listed in the PWS. | Will the government update the PWS with the new requirements provided in Amendment 0006 - B08 Attachment 0023 TD-02 Workload Data and Density List V-8 202408.xlsx? | The USG believes all requirements are addressed in the PWS 5.34 Rail Operations. |
