About this file
This document contains questions and answers regarding a solicitation for Chemical Management Services and Third Party Logistics services in support of Fleet Readiness Centers for the Defense Logistics Agency Distribution. The services are required at multiple CONUS locations currently supported by an incumbent contractor. The solicitation seeks proposals for a five-year hybrid IDIQ contract with both fixed-price and cost-reimbursement CLINs. Proposals were initially due on February 9, 2021 but have been extended to February 26, 2021 per Amendment 0001. The work involves management and distribution of hazardous materials, inventory control, equipment and facility services. Questions clarify requirements for hazardous material inventories, government-furnished property maintenance, training responsibilities and small business subcontracting goals.

Government Response
1 Can the Government extend the date for receipt of offers by 60 days to 4/10/2021 or 30 days following the date of the last site visit whichever is later? Extending the proposal submission date is essential for ensuring adequate industry competition for this solicitation. This extension is needed to sufficiently analyze the voluminous data included with the solicitation, adequately develop a response to the solicitation’s lengthy and complex proposal submission requirements, the criticality of visiting each FRC site, and to allow sufficient time following each site visit to develop an accurate staffing and management plan.

3 (1) The Contractor may have multiple storage locations on the base to include warehouse, stockrooms, lockers, carts as well as private Contractor-managed warehouses near the base. Is the 30-day operational inventory requirement met by combining the quantity of each HM item stored at all locations at or near the installation, e.g. Contractor’s warehouse, Government’s warehouse, point of issue, point of use? Does it matter where material is stored to be counted toward the 30-day inventory requirement and if so where?

Attachment J.1 PWS -Page 22
SP330021R5002 Attachment J1 PWS 5.2.A The Contractor shall retain as a minimum, 30 days of operational inventory in sufficient quantities to support production. Levels of HM maintained on hand shall be established by historical demand data, seasonal variations, and known production schedules.
(1) The 30-day operational 3PL inventory requirement pertains to the Contractor’s inventory stored in the centralized hazardous materials facility identified in C-5.4, C-5.5, or C-5.6 provided by the Government only. It does not include Government- Owned hazardous material that may be stored in a Mega-Center, Issue Center, POU locker or on a HAZMAT cart.
(2) The only facilities where 3PL HM has been and will be stored is in the facilities identified in C-5.4, C-5.5, and C-5.6. No other storage space will be made available for 3PL HM.

(2) Through the history of the program, has the Government provided storage space on base to allow the Contractor to meet a 30-day operational inventory requirement?
4 What are the criteria or process for determining “readily available” for shipping and will meet the customer’s production schedules” in order to ensure the Contractor has made a good faith effort to acquire the HM from Government sources of supply and to prohibit the Contractor from circumventing existing Government sources of supply for
HM?
SP330021R5002
Attachment J.1 PWS -Page 25
PWS Section 5.2.5.A.7 Procure HM using Government Sources of Supply to the extent that material readily available for shipping and will meet the customer’s production schedules. To the extent that Government Sources of Supply cannot satisfy the customer’s requirements, the Contractor shall use its network of qualified manufacturers under its source selection system and such suppliers otherwise must meet all requirements for qualifications as a source of supply under Government contracts such as Qualified Products List (QPL), Qualified Suppliers List, or other quality assurance demonstration.
IAW C-5.2.5 A8, The Contractor’s procurement decision shall demonstrate the most advantageous combination of material availability, cost, quality, and sustainability to meet the customer’s requirements. Material availability should be considered first in the procurement decision.
Approximately 75% of the customers requirement is from commercial sources and not Government Sources of Supply.
5 The number and location of Incumbent Contractor MHE, delivery vehicles, personnel transport vehicles, and other equipment is not defined.
Can the Government provide the number, type, location of the equipment currently in use as Contractor Equipment?
Is the cost of Contractor provided equipment included in the Government’s ODC plug number?
Will the Contractor be permitted to invoice for the cost of Contractor Equipment purchased/leased for use on the contract and the cost for fuels, maintenance, and repair under a cost-reimbursable contract line item for ODCs in Section B of the solicitation?

Government Response
6 It is not clear in the chain of inventory movement where the “point of receipt” is: at receipt of HM in the Government warehouse, stockroom, carts, or lockers. It is further complicated by the unit of measure of the point of receipt: ordering a drum, but dispensing a quart, for example.
Can the Government clarify when and in what form material is considered delivered to the point of receipt and accepted by the Government, i.e. when HM ownership and title transfers to the Government?
SP330021R5002
Attachment J.1 PWS -Page 29
PWS Section 5.2.6.C The Contractor retains title and the associated risk of loss to the materials until the point of receipt by the customer in the Government’s designated POR. The Contractor shall retain title of all Contractor-Owned 3PL HM inventory defined as that inventory which has not been ordered by the customer.
IAW C-5.2.6.C, “The Contractor retains title and the associated risk of lost to the materials until the point of receipt by the customer in the Government’s designated POR.” In this case the program of record is HMMS. If a hazardous material is to be dispensed from a drum to smaller unit of measure, the drum is issued to the Government at which time the Government is charged for the drum, the drum becomes Government-Owned and any smaller units of measure dispensed from the drum are not charged.
7 The incumbent Contractor may not be the approved source of supply for HM per the QPL, QSL or QSLD. Can the Government guarantee the HM material meets the Government’s qualification and quality assurance requirements or will the Government waive those requirements for material purchased from the incumbent Contractor?
SP330021R5002
Attachment J.1 PWS – Page 9;
PWS Section 1.6.B The Contractor shall maximize the efforts to purchase demand supported 3PL HM from the incumbent Contractor.
PWS Section 5.2.5.A.7...must meet all requirements for qualifications as a source of supply under Government contracts such as Qualified Products List (QPL), Qualified Suppliers List, or other quality assurance demonstration.
The incumbent Contractor performs under the same requirements to procure HM from sources of supply approved per the QPL, QSL, QSLD and is required to ensure a Certificate of Conformance can be provided for HM procured commercially. The Government will not waive qualification and quality assurance requirements for material purchased from the incumbent Contractor.
8 It’s not clear when the Contractor needs to enter HM info into the Government’s POR.
When it reaches the Contractor’s facilities or when it reaches the Governments Warehouse?
The Government’s prohibition on interfacing with Government’s data systems increases the effort required to maintain duplicate systems and the likelihood of inaccuracy between systems. Many DLA contracts allow or require the Contractor to interface with systems like HMIRS via EDI transactions. Will the Government consider
Government total asset visibility of 3PL HM on hand in the Government’s designated
POR.
PWS Section 5.2.3.D The Inventory Management Tool will not be authorized to interface with Government’s data systems.
Please refer to C-5.3.2 Inventory Control. HM is received in the Government’s POR when it arrives at the Contractor’s operating facilities, is barcoded and stored or delivered to the ordering customer.
The Government understands the use of duplicate systems and the likelihood of inaccuracy between systems; however, it is the Contractor’s responsibility to ensure the accuracy between systems. The sites operate on the Navy Marine Corps Internet (NMCI) that has strict automation security requirements that prohibits a commercial business tool from interfacing with Government Data Systems.

10 The due date for submission of offers does not allow enough time to sufficiently analyze the voluminous data included with the solicitation, or adequately develop a basis of estimate and proposal in response to the solicitation’s lengthy and complex proposal submission requirements. 11 If it is the Government’s intention for possible multiple award contracts, will the Government consider altering requirements to allow for bids on individual sites?
If so, can an offeror submit a proposal for one or two sites versus all three FRC locations?

RFP Section B Instructions - The Government intends to award one or more contract(s) as a result of this solicitation. The resultant contract(s) will be hybrid Indefinite Delivery Indefinite Quantity (IDIQ) with Firm-Fixed-Price (FFP), Cost-Plus-Fixed-Fee (CPFF), and Cost Reimbursement (CR) No Fee line items. This requirement includes a five-year ordering period (inclusive of a 120-day Phase-In Period) for the CMS and 3PL services.
The Government will not consider a deviation from its intention as currently stated in the RFP. Offerors must propose to each location and CLIN in the RFP.
12 How are Government sources of supply counted in terms of small business goals and are they excluded from plan SubK dollars?
How much of the plug numbers can be assumed to be from SB sources?
SP3300-21-R-
5002, Attachment J.4
SP3300-21-R-5002, Attachment J.4 Calculations How the source is handled will depend on the source.
Contractors should assume that Government sources of supply will be large business but they cannot be excluded from the Small Business Commitment Document or the Subcontracting Plan since all dollars which are awarded must be considered for these areas (reference the various FAR 52.219
Conference OR Site Visits
RFP Para Reference (if question relates to RFP)
Government Response clauses in the solicitation). The Government understands that the large amount of dollars and uncertainty with procurement of material makes it very difficult to determine how to subcontract the dollars for these CLINs. Offerors should try to propose small business dollars based upon information available in the solicitation. This may make subcontracting percentages lower than other procurements; however, the Government understands the challenges this presents. While we understand the uncertainty, federal regulation requires all dollars in an award to be considered for subcontracting and reporting purposes and thus we cannot exclude the dollars from the proposal.
Offerors are encouraged to outline any challenges or assumptions as part of its Small Business Commitment Document submission so those are identified with proposal submission.
13 The solicitation provides overall dollar estimates for hazardous materials, material support, travel, and training, however does not describe supporting details for the estimates, such as the types and quantities of hazardous materials, if any, that are estimated to be commercially sourced.
Therefore, can the Government allow the small business participation commitment to be submitted after transition is complete in order to allow the Contractor time to develop realistic estimates of small business subcontract participation?
