(addressed in a question to the Government on 1/3/11 and answered on 1/5/11). The definition begins: "Items that become available through market advancements, and a) are used by the general public or by non-governmental entities, b) are sold in meaningful quantities to a diverse set of clients across multiple industries, c) where modifications of a type not customarily available in the commercial marketplace are made to meet Federal Government requirements." There is no conjunction between items "b" and "c" so it is unclear whether Commercially Available items meet "a," "b," and "c" or if Commercially Available items meet "a," "b," or "c." In response to a questions, the government responded on 5 Jan 11: "A, B, or C are applicable when buying commercial items." Unfortunately, we are still unclear on the definition. If an OTRS only had modifications of a type not customarily available in the commercial marketplace but was not used by the general public or non-governmental entities, and are not sold in meaningful quantities to a diverse set of clients across multiple industries, would it meet the definition of "Commercially Available?" In other words, if a tool meets only condition C but not A or B, would that suffice? Or does a tool need to meet all three criteria to be "Commercially Available?" | The definition remains as written. Item C of the definition is applicable when modifications are necessary to meet specific Federal laws, regulations, and policies. |
