About this file

This is a federal contracting form provision regarding trade agreements compliance and country of origin certification for end products.

The provision requires offerors to certify that all end products included in their proposal are either U.S.-made or designated country end products, as defined in the solicitation's Trade Agreements clause. Offerors must identify and list any supplies that do not meet this requirement in a table specifying the line item number and country of origin for each non-compliant product. The Government will evaluate proposals according to Federal Acquisition Regulation Part 25 policies and procedures. For items covered by the World Trade Organization Government Procurement Agreement (WTO GPA), the Government will evaluate U.S.-made and designated country end products without applying Buy American statute restrictions. Award consideration will be limited to compliant products unless the Contracting Officer determines that no acceptable offers for such products exist or that available offers are insufficient to meet the solicitation requirements.
