About this file
This file is a Trade Agreements Certificate form that serves as a fillable template for FAR Provision 52.225-6, required as part of Solicitation 36C79126R0011. The document functions as a compliance attestation rather than a substantive statement of work or procurement requirement.
The Trade Agreements Certificate is a standard federal contracting compliance document that offerors must complete to certify their compliance with applicable trade agreement restrictions. Contractors completing this form for the ETMPM-TENS Procurement Program (NAICS 334510, electromedical and electrotherapeutic apparatus manufacturing) must attest to the country of origin for products and materials supplied under the contract. The form applies to this VA solicitation issued September 18, 2026, with responses due October 19, 2026, at 3:00 PM CDT. This tiered set-aside procurement prioritizes awards to Service-Disabled Veteran-Owned Small Businesses (SDVOSB) in Tier-1, followed by Veteran-Owned Small Businesses (VOSB) in Tier-2 if no Tier-1 awards are made. Offerors must complete the certificate to demonstrate products and services meet trade agreement requirements and domestic content restrictions applicable to Department of Veterans Affairs purchases.

Submission of a fully completed, signed, and dated Trade Agreements Certificate is a material condition of responsiveness. Any large business Offeror that fails to submit this attachment exactly as required will be deemed non‑responsive and will be eliminated from further evaluation and ineligible for award.
1. General Completion Requirements: Offerors must complete the fillable PDF document in its entirety. The following actions are required:
· Enter all information into the fillable PDF exactly as instructed.
· Insert check marks in all boxes where the Offeror must certify or indicate selections.
· Complete all fields identifying:
· CLINs and SLINs applicable to the Offeror’s proposed foreign end-products; and
· Enter the country‑of‑origin information for each CLIN/SLIN listed item.
· Ensure the document certificate contains a valid digital signature applied by an authorized representative of the Offeror. Typed signatures, inserted JPEG signatures, or hand written signatures without digital authentication are not acceptable. Only digital or electronic signatures compliant with federal acquisition standards (e.g., Adobe, DocuSign, PKI based signature) will be accepted.
· Enter the date signed in the designated field.
· Ensure all content is truthful, complete, and consistent with representations submitted in Attachment 0003 (FAR 52.212‑3), the Price Matrix, and the Offeror’s active SAM.gov registration.
2. Required Offeror Representations & Certifying Selections: Attachment 0005 requires Offerors to certify compliance with the requirements of FAR Provision 52.225‑6. The Offeror must:
a. U.S.-Made or Designated Country End-Products Certification: Certify that all end-products offered, except those listed as foreign are U.S.-made or designated country end-products as defined in the RFO Clause at 52.225-5, titled “Trade Agreements.”
b. Listing of Foreign End Products: For any end product that is not a U.S.-made or designated‑country item, the Offeror must list that product in the table provided under paragraph (b) of this provision. The Offeror must complete the table exactly as shown and include:
i. Enter CLIN or SLIN,
ii. Enter end-product Country of Origin.
All CLINs/SLINs listed must correspond to the Offeror’s proposal and must match information presented in the Price Matrix and Technical Capability Statement.
c. Required Offeror Information: The Offeror must complete the signature block of Attachment 0006, including:
i. Legal Business Name;
ii. Printed Name of Authorized Signee;
iii. Printed Title of Authorized Signee;
iv. Authorized Digital Signature;

vi. Full Company Address.
This information must be accurate and consistent with the Offeror’s representations elsewhere in the proposal package.
d. Digital Signature Requirements: Typed or handwritten signatures inserted without digital authentication will not be accepted. Attachment 0005 must be signed with a recognized digital or electronic signature, such as:
· Adobe digital signature;

· Ensure all entries within Attachment 0005 match the Offeror’s representations in its proposal, price matrix, technical submission, and SAM.gov registration.
· The completed Attachment 0006 shall be included in the Offeror’s final emailed proposal submission package to the VA’s Contract Specialist in accordance with the RFP.
f. Impact of Non‑Submission: Failure to submit a fully completed and signed Attachment 0006 will result in:
· Immediate rejection of the Offeror’s proposal as non‑responsive;
· No further evaluation under technical or price factors; and
· Ineligibility for award under Solicitation 36C79126R0011.
Policy Note: If any conflict exists between country‑of‑origin (COO) entries in Attachment 0002 - FAR Provision 52.212‑3 Offeror Representations and Certifications and Attachment 0005 - FAR Provision 52.225‑6 Trade Agreements Certificate, Attachment 0005 shall prevail, govern, and control for the sole purposes of end-product COO eligibility and evaluation under FAR Part 25 procurement restrictions. The VA will rely on the CLIN/SLINs‑level end-product COO declarations in Attachment 0005 when applying the Trade Agreements Act requirements.
As prescribed in 25.601(c)(2), insert the following provision:
