About this file
This is a Trade Agreements Certificate provision (FAR 52.225-6) that establishes certification requirements for offerors regarding the country of origin for end products in federal procurements subject to trade agreements.
The provision requires offerors to certify that each end product is either U.S.-made or a designated country end product, except for those specifically listed as other end products. Offerors must identify any supplies that do not meet these criteria by line item number and country of origin. The Government will evaluate offers in accordance with Federal Acquisition Regulation Part 25 policies and procedures. For line items covered by the World Trade Organization Government Procurement Agreement, the Government will evaluate U.S.-made and designated country end product offers without regard to Buy American Act restrictions. The Government will consider non-compliant offers for award only if the Contracting Officer determines that no compliant offers exist or that compliant offers are insufficient to meet solicitation requirements. This provision applies to the VA CMOP National Office solicitation 36C77026Q0102 for Carboxymethylcellulose Sodium 1% ophthalmic gel, which involves monthly deliveries totaling approximately 27,326 units across seven line items over a three-month period, with a closing response date of March 13, 2026, and an estimated award date of March 18, 2026.
