About this file
This is a mandatory VA certification attachment for limitations on subcontracting compliance under VAAR Clause 852.219-76, applicable to Solicitation 36C79126R0011 for the Electro-Therapeutic Modalities for Pain Management (ETMPM) - Transcutaneous Electrical Nerve Stimulation (TENS) Procurement Program. The solicitation (NAICS 334510, small business size standard 1,250 employees) uses a tiered set-aside evaluation approach prioritizing Service-Disabled Veteran-Owned Small Businesses (SDVOSBs) in Tier-1, followed by Veteran-Owned Small Businesses (VOSBs) in Tier-2, with response due October 19, 2026, at 3:00 PM Central Daylight Time.
Offerors must complete and submit a fully executed, digitally signed Attachment 0003 as a standalone PDF document within their proposal package, certifying their compliance status as either a manufacturer/producer or nonmanufacturer. For manufacturers, offerors must certify they will not pay more than 50% of government payments to non-VIP-listed SDVOSB or VOSB firms, with subcontractor work counting toward this limitation and material costs excluded. For nonmanufacturers, offerors must certify compliance with 13 CFR 121.406(b) requirements, including not exceeding 500 employees (or 150 for IT Value Added Reseller exception), primary engagement in retail or wholesale trade of the item type, industry-appropriate ownership or possession of items, and domestic small business manufacturing sourcing or SBA waiver compliance. The certification requires the authorized signatory's printed name, title, legal business name, business address, and must be signed using compliant digital signature standards (Adobe, DocuSign, PKI, or federally recognized formats); incomplete, unsigned, or improperly signed submissions will render proposals ineligible for evaluation and award consideration. Offerors acknowledge the certification is subject to Title 18 U.S.C. Section 1001, exposing them to criminal, civil, or administrative penalties for false certifications, and VA may require documentation demonstrating compliance at any time during or after contract performance.
