The work includes grading, landscaping, and site lighting with an estimated value between $10-25 million. The contract completion period is 500 calendar days. The solicitation issued on February 14, 2023 and is set aside 100% for small businesses. The Navy Facilities Engineering Command is the contracting agency. Proposals are due on April 11, 2023 and will be evaluated on technical approach, experience, safety, and past performance on a best value tradeoff basis. An optional site visit is scheduled for March 08, 2023 for interested offerors to familiarize themselves with jobsite conditions. The solicitation and any amendments will be posted to SAM.gov.

Significant alteration means more than 10 new residential units, more than 200 feet of >/= 6” water line added to an existing system, or the addition of new drinking water processes and/or materials (includes reservoirs, wells, booster pumps, etc.). Does not include repair by replacement. All significant alterations require construction approval, and those that “increase the capacity of the existing PWS” also require siting approval.
“Projects that increase the capacity of the existing PWS” means improve or increase the capacity of the distribution system, transmission system, water storage, and/or source facilities in a new location OR location that will expand the boundaries of an existing site OR location with systems built prior to 1978.
Siting approval requirements Approval will be within 15 days of meeting with the Safe Drinking Water program and, if there is a source water project, with the Water Resource Program if there are no issues to address that require DoD to provide additional information.
Design approval requirements Basis of Design. Required at 30%, however for DoD Design/Build projects may not be available until 60%. If MILCON may be satisfied by the 1391.
Guam EPA wants to review specs prior to ordering of materials; option is to run the risk of unacceptable materials that cannot be used. DoD is developing specifications that meet all GEPA requirements and have them approved in advance.

WELLHEAD PROTECTION SUBMITTALS
FOR GUAM PROJECTS
1. APPLICABILITY
In accordance with 22 GAR-GEPA, Chapter 7, Section 7130, “…no person shall construct, utilize, operate, occupy or cause, allow or let, permit or suffer or to be constructed, utilized, operated or occupied any land use served or to be served by septic tank and leached field, sanitary sewer, storm water disposal method, or liquid waste storage, disposal or treatment method, and which is within the GWMPZ1 and within any 1,000 feet radius of any public utility potable water supply well, until the person has obtained the prior written approval of the Administrator…”
The intent of the regulation is to protect Guam’s Water Resource and avoid impairing drinking water quality. Therefore projects partially or entirely located within 1,000 feet radius of any public utility potable water supply well, DoD must obtain Guam EPA’s approval to construct such facilities. In the event that Guam EPA has specific supporting data that shows surface pollutant sources from activities located more than 1,000 feet away affecting the water quality of a given potable water well, Guam EPA may request DoD to submit that particular project for Guam EPA’s review.
2. HIGH RISK ACTIVITIES OR LAND USES TO BE APPROVED BY GEPA IN WELLHEAD
PROTECTION AREAS (WHPA) 2
The following land uses or activities located within the WHPA shall be submitted for GEPA’s approval since they generate or have a higher potential to generate pollutants:
A. Vehicle fueling stations B. Vehicle service and maintenance facilities C. Vehicle and equipment cleaning facilities D. Outdoor loading or unloading facilities (storage, warehouse, commercial) E. Facilities generating or storing liquid waste, solid waste, or hazardous waste F. Dining /food preparation facilities G. Engineering Training Pit (outdoor area to train operators using earthmoving or other large equipment.)
H. Stormwater disposal facilities (unlined stormwater basins).
In addition to the eight categories above, parking lots is a feature commonly found in many land uses, in addition to the eight above, and is recognized to be a generator of pollutants as well. The Revised Final Best Management Practices for Wellhead Protection dated December 2010 will be used as a guide to select BMPs for parking lots. Non-high risk projects with new exposed parking areas of greater than 12 stalls will be submitted for Guam EPA’s review and approval.
Use the flowchart shown in Attachment A to determine if your project is located within the wellhead protection area (WHPA) and if your project needs to be reviewed and approved by Guam EPA.
1 Ground Water Management Protection Zone 2 Wellhead Protection Area is defined in Guam regulations as, “the surface and subsurface area with a minimum of 1,000 ft radius around water well or wellfield, supplying a public water system through which contaminants are reasonably likely move towards and reach such water well or wellfield.”
Page 2 Rev 07/12/2012

Formal approval for the 90% Submittal or Final Submittal will be in the form of a letter from Guam EPA to DoD.
In the event the submittal is not complete, Guam EPA’s review period would restart upon receipt of additional, required information.
