52.212-2 – EVALUATION CRITERIA:
(a) The Government will award a contract resulting from this solicitation using the Lowest Price Technically Acceptable (LPTA) Source Selection Process. Award will be made to the responsible contractor whose quotation conforming to the solicitation is the Lowest Total Price which clearly meets the technical specifications of the SOW, tradeoffs are not permitted. Additionally, the Government will evaluate the price to determine fairness, reasonableness, and realism by comparison to other competitive prices received history of prior procurements, and the Independent Government Estimate (IGE). If a price is disproportionately lower than other competitive quoted prices, the price may be deemed unrealistic.
The following non-factors shall be used to evaluate quotations:
Factor 1 – Technical Experience Factor 2 – Past Performance Evaluation Criteria:
Factor 1 - Technical Experience:
The Government will evaluate the technical quotations on an “Acceptable (PASS)”/”Unacceptable (FAIL)” basis to ensure the contractor’s ability to meet the requirements of the SOW and Solicitation. For a quotation to be determined technically acceptable, contractors must receive an “Acceptable” rating on the Technical Factor listed below:
i. Technical Experience: Contractor’s shall show Proof of Experience, Availability and Access to Parts, and Certification or Experience of Technical POC as follows:
1. The contractor shall provide contact information for at least two current customers that received preventive maintenance on a similar ASML stepper within the last two years, to serve as references and proof of experience.
2. The contractor shall detail access to and typical delivery time for ASML parts required to maintain the instrument.
3. The contractor shall provide the phone number and location of technical support staff that will be available to maintain this instrument.
Factor 2 - Past Performance:
Contractor’s recent/relevant past performance performing services of a similar type, scope, and magnitude of those described in the SOW.
i. The Past Performance rating will be based on an “Acceptable” / “Unacceptable” basis. The following definitions will be used in evaluating the degree the contractor will satisfactorily provide the required services based on past and current performance records. An acceptable or Unacceptable rating will be determined as follows:
a. “Acceptable” - Based on the contractor’s performance record, the Government has a reasonable expectation that the contractor shall be able to successfully perform the required effort, or the contractor’s performance record is unknown. (See note below).
b. “Unacceptable”- Based on the contractor’s performance record, the Government has no reasonable expectation that the contractor will be able to successfully perform the required effort.
ii. Past Performance Evaluation: The Government will consider the contractor’s previous and current record of contractual performance. The Government assessment will focus on recent contracts that are relevant to the effort required by this solicitation. Recent is defined for this action to be contracts that were awarded and performed within the last five (5) calendar years, from the date of RFQ issuance back. Relevant to this effort is defined in the following table:

Note: In the case of an contractor without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the contractor may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the contractor shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable” provided that the contractor’s proposal clearly indicates, as determined by the Government, that the contractor’s design and ability are sufficient to ensure a correctly functioning and reliable system.
ii. Past Performance Information: The primary source for past performance information will be the past performance information submitted with the quote; however, the Government reserves the right to validate the submitted information as well as evaluate any additional information obtained from other available sources other than those identified by the contractor (such as past performance information obtained from Federal, State and local Government agencies, better business bureaus, published media, and electronic data bases available to the Government) will be the basis for evaluation of this factor.
(b) Options. The Government will evaluate quotations for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a quotation is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of a quotation, to the successful contractor within the time for acceptance specified in the solicitation, shall result in a binding contract without further action by either party. Before the quotation’s specified expiration time, the Government may accept a quotation (or part of a quotation), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received by the contractor before award.
