FF&E NOTE

FF&E Furniture, Fixtures, and Equipment (FF&E) Note

1. The Estimated FF&E Budget for each project (P-100 and P-099) has been identified to provide offeror's with the projected magnitude of effort for each FF&E package. The Total Estimated FF&E Amount for each project includes the actual cost of the FF&E including freight and installation charges and the Prime Contractor's proposed Handling and Administration Rate (HAR). The Estimated FF&E Budget for each project shall be entered by the Government.

The Estimated FF&E Budget for each project is only an estimated amount. The contractor will be given the final budget amount for the FF&E package during the construction phase for the FF&E.

2. Offerors may propose a Handling and Administration Rate (HAR) for the FF&E not to exceed 5% for each project. This fee will account for all administrative costs, overhead, bonding fees, administration of subcontracts, profit, and any other costs associated with and related to the coordination and processing of the procurement and installation of FF&E. The proposed HAR percentage will be incorporated into the contract award and will not be adjusted regardless of fluctuations from the Estimated FF&E Budget for each project. The proposed HAR is a fixed percentage.

3. If awarded, FF&E will be issued as a planned modification and will be funded separately after completion of FF&E review, acceptance of FF&E package, and receipt of appropriate funding. See Specification Section 01 30

00.00 25 Section 1.14 of the RFP for details. Note: The Service Contract Act and the Buy American Act – Supplies applies to this section.

4. The Government is not obligated to award the FF&E line item. Should the Government choose to award the FF&E, the line item will be awarded as a negotiated modification to the contract. The contractor's proposed HAR will be applied to all vendor/supplier costs for the FF&E.

5. The FF&E modification shall be awarded at least six months prior to the completion date for each project. A minimum of six months is required for the contractor to purchase, deliver and install the FF&E without impacting the overall completion date of the project. The contractor’s schedule shall assume the award of the FF&E as a modification. No schedule extensions shall be granted if the modification is awarded at least six months prior to the contract completion date. If the Government decides to negotiate and award the furniture modification with less than six months prior to the contract completion date, the contractor may be entitled to a contract extension and extended field overhead. A contract extension and extended field overhead will only be granted in those cases where the prime contractor demonstrates that sufficient lead time for the FF&E is not available and the Government’s award of the modification is in the last six months of the contract.

III. EVALUATION

A. BASIS FOR AWARD

1. The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with offerors in the competitive range; and to award the contract to the offeror submitting the proposal determined to represent the best value—the proposal most advantageous to the Government, cost/price and other factors considered.

2. As stated in the solicitation, the Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In addition, if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

3. The tradeoff process is selected as appropriate for this acquisition. The Government considers it to be in its best interest to allow consideration of award to other than the lowest priced offeror or other than the highest technically rated offeror.

4. As stated in the solicitation, all technical factors when combined are of equal importance to the performance confidence assessment (past performance) rating; and all technical factors and the performance confidence assessment (past performance) rating, when combined are approximately equal to price.

5. Any proposal found to have a deficiency in meeting the stated solicitation requirements or performance objectives will be considered ineligible for award, unless the deficiency is corrected through discussions. Proposals may be found to have either a significant weakness or multiple weaknesses that impact either the individual factor rating or the overall rating for the proposal. The evaluation report must document the evaluation board’s assessment of the identified weakness(s) and the associated risk to successful contract performance resulting from the weakness(s). This assessment must provide the rationale for proceeding to award without discussions.

F. EVALUATION FACTORS FOR AWARD

1. The solicitation requires the evaluation of price and the following non-cost/price factors and subfactors:

Factor 1 – Experience Factor 2 – Technical Approach Factor 3 – Construction Schedule

Factor 4 – Safety Factor 5 – Small Business Utilization

Subfactor 5.A. – Past Performance in Utilization of Small Business Concerns Subfactor 5.B. – Small Business Participation

Factor 6 - Past Performance

The distinction between experience and past performance is experience pertains to the types of work and volume of work completed by a contractor that are comparable to the types of work covered by this requirement, in terms of size, scope, and complexity. Past performance pertains to both the relevance of recent efforts and how well a contractor has performed on the contracts.

2. The relative order of importance of the non-cost/price evaluation factors and subfactors is the technical factors (Factors 1, 2, 3, 4, and 5) and their respective subfactors are of equal importance to each other respectively and, when combined, are equal in importance to the past performance evaluation/performance confidence assessment factor (Factor 6). When the proposal is evaluated as a whole, the technical factors and past performance/performance confidence assessment factor combined (i.e., the non-cost/price evaluation factors) are approximately equal to price.

3. Basis of Evaluation and Submittal Requirements for Each Factor.

(b) Basis of Evaluation:

Projects that are not submitted on the mandatory Construction Experience Project Data Sheet (Attachment C) will not be evaluated. If a project form exceeds two pages, only the first two pages will be evaluated.

(1) General Construction Experience.

For general experience, the Government seeks to evaluate the relevant general construction experience of the offeror as a prime construction contractor directly responsible to the owner, managing multiple subcontractors, and coordinating with multiple stakeholders within a congested construction area and under a tight construction schedule. Projects completed by the offeror in any capacity other than a prime construction contractor, or completed by a proposed subcontractor, will be considered unacceptable. Projects not yet accepted by the owner as of the date of the issuance of the RFP, or projects completed more than seven years prior to the issuance of the RFP, will be considered unacceptable. Projects with a total value below $80M will be considered unacceptable. Projects with less than 170,000 square feet of work will be considered unacceptable. With regard to the significant features, not every single project needs to include every single feature, but the relevant projects collectively must demonstrate experience in all of the significant features for the general experience of the offeror to be considered acceptable or higher. The prime contractor does not have to self-perform the work identified as significant features; however the prime contractor must demonstrate that it has managed projects that included these features. If the offeror is a joint venture (JV), the JV must be the prime construction contractor on at least one of the relevant general experience projects or each member of the proposed JV must be the prime construction contractor on at least one relevant general experience project. If each member of the JV does not have at least one relevant general experience project then the offeror will be considered unacceptable. For multiple award contract (MAC) or indefinite delivery / indefinite quantity (ID/IQ) contracts, the specific relevant task order(s) that constitute a single project on the same site, not the entire MAC or ID/IQ contract, will be considered the project for evaluation purposes. Offerors who demonstrate projects that exceed general construction experience requirements may be rated higher.

(2) Specialized Construction Experience.

For specialized experience, the Government seeks to evaluate the experience of the offeror, or that of its teaming subcontractor, in performing the specialized work required by the RFP. Offerors who demonstrate their own experience on the specialized work may be rated higher. Offerors relying on the specialized experience of subcontractors must submit copies of the agreements or letters of commitment. The agreements or letters must be signed by officers with authority to bind the companies, and should clearly identify the company names, DUNS numbers, and point of contact information (address, email, phone, and fax). Offerors who demonstrate more or better specialized experience may be rated higher.

2(a) Pier / Wharf Facilities. Pier/Wharf facility projects that demonstrate construction experience of new piers with existing adjacent or nearby piers or demolition of existing piers may be rated higher.

2(b) Industrial Support Facilities. Industrial support facility projects for federal agencies, especially Naval Shipyards, that include experience with cleanliness inspections and certifications, may be rated higher.

2(c) Facility Security Outfitting. Security outfitting projects that demonstrate full integration with existing systems may be rated higher.

(2) Factor 2 – Technical Approach

(a) Submittal Requirements:

The Offeror shall submit the following information:

(1) Thickened Architectural Concrete Construction:

(4) Site Security:

Submit a concept level plan for how the security systems (e.g., perimeter fence, IDS, cameras, entrance facility, alarms, networks, etc.) will be established and maintained for the duration of the project. Plan should be in narrative form and include information on:

(i) phasing to maintain existing secure perimeter;

(ii) establishing temporary and final perimeters;

(iii) transitioning from existing security control station to new stations without loss of security throughout site; and

(iv) minimizing contractor activities within the site security perimeter.

Narrative shall be limited to three pages. In addition to the narrative, offerors may submit up to three 11x17 site plans, which will not count towards the page limit.

The Government will evaluate the information submitted for this factor to assess the offeror’s capability to meet the requirements of the RFP and the offeror’s approach and understanding of the specialized components of this project, especially with regards to how the prime contractor will manage specialized subcontractors or self-perform work to meet the stringent quality and security requirements of this project. Security plans that minimize contractor activities within the site security perimeter may be rated higher. Narratives that provide higher levels of detail and specificity, especially with regards to construction schedule and subcontractor management may be rated higher.
