About this file
This document is a Prospective Proposer Inquiry (PPI) response excerpt addressing ambiguities regarding seismic assessment and structural modification requirements for a Design-Build (DB) contract.
The PPI seeks clarification on the scope and pricing approach for post-award seismic assessments (Tier 2 and Tier 3) and any resulting structural repairs. The inquiry notes a discrepancy between RFP Part 3, which offers general structural improvement scope, and Part 6, which explicitly details only limited structural work (three concrete footers and corridor framing). A Tier 1 Seismic Assessment has identified lateral force deficiencies and recommends further evaluation. The proposer requests confirmation on whether the DB Contractor must include costs for performing post-award Tier 2 and Tier 3 seismic assessments in their proposal, but explicitly exclude costs for any subsequent structural or seismic modifications not detailed in Part 6 documents. The inquiry further requests government clarification on how bidders should price undefined risks from potential physical repairs resulting from these assessments—whether through designated contingencies, government-specified allowances, or breakout Options/CLINs—to prevent inequitable risk shifting and inflated pricing. Additionally, the PPI asks whether masonry load-bearing wall repairs must be included in the base bid despite not being depicted in Part 6 documents and seeks confirmation that performing post-award seismic assessments is a mandatory contract requirement. The document indicates that a government response to this reworded PPI is anticipated in a forthcoming amendment.

Text version
The RFP Part 3 offers a general scope for structural improvements, while Part 6 explicitly details only limited structural work (three concrete footers and corridor framing).
However, the Tier 1 Seismic Assessment identifies lateral force deficiencies and recommends further evaluation. Based on the
Government's responses to PPIs 119, 121, and 122, please confirm that the DB Contractor's proposal is to include the cost to perform the post-award Tier 2 and Tier 3 seismic assessments, but is NOT to include the cost for any subsequent structural or seismic modifications/repairs that are not otherwise explicitly described and detailed in the Part 6 documents? If physical repairs/remediations resulting from those post-award assessments must be accounted for in the proposal, please clarify how the Government wants bidders to price these currently undefined risks (e.g., via a designated contingency, a Government-specified allowance, or a breakout
Option/CLIN) to avoid inequitable risk shifting and inflated pricing. Please confirm if any physical repairs, modifications, or reinforcement to the existing masonry load-bearing walls must be priced in the base bid, despite not being depicted in Part 6.
Please confirm that performing these post-award seismic assessments is a requirement of the contract. Please confirm if this assumption is correct, or clarify how the Government wants bidders to account for these risks (e.g., carrying a contingency, utilizing a Government-specified allowance, or establishing a breakout CLIN/Option).
This PPI has been reworded to fit this document. Please anticipate a response to this PPI in a forthcoming amendment.
