About this file
This is a Price Schedule for Phase IV Barracks (BEQ) Repairs and related construction work. The solicitation covers repair and renovation services for three buildings: Building 1245, Building 1246, and Building 332, along with Furniture, Fixtures, and Equipment (FF&E) procurement.
The base contract CLINs (0001-0003) require firm fixed pricing for comprehensive repair work at each building, including furniture and appliance relocation services detailed in Attachment B. Building 1245 repairs (CLIN 0001) and Building 1246 repairs (CLIN 0002) are each subdivided into two line items covering the full scope of work and furniture moving services. Building 332 repairs (CLIN 0003) are priced as a single comprehensive item. Award will be made on the total sum of CLINs 0001-0003. Optional CLINs 0004-0021 include unit-priced or lump-sum options for both buildings covering shower wall repairs (11,000 SF each), gypsum wall work in kitchenettes (1,800 SF each), exterior guardrail replacement (1,960 LF each), metal roof deck replacement (28,000 SF each), ceiling repairs (800 SF each), door frame upgrades (72 EA each), fire alarm panel updates (2 EA each), window blind replacement (120 EA each), and parking lot/basketball court paving work (1 EA each). The Government reserves unilateral rights to award CLINs 0004-0021 within 180 calendar days of contract award at the proposed firm fixed price with no economic price adjustments. CLIN 0022 addresses FF&E with a Government estimated price of $360,500, allowing contractors to propose a Handling and Administration Rate (HAR) not to exceed five percent. Estimated quantities for CLINs 0004-0013 are subject to equitable adjustment if actual quantities vary more than 15 percent from estimates. The Performance Bond must reflect 100 percent of aggregate amounts if any optional CLINs are exercised, with additional bonding required at FF&E option award.

TOTAL PRICE FOR CLINs 0001 – 0022: $_________________
1.1. GENERAL BID NOTES:
1. Award will be made on the total sum of Contract Line Items (CLINs) 0001-0003. If there is a difference between a unit price and the extended total, the unit price will be held to be the intended bid and the total recomputed accordingly. If an Offeror provides a total but fails to enter a unit price, the total divided by the specified quantity will be held to be the intended unit price.
2. The Government reserves the unilateral right to award CLINs 0004 through 0021 to the Contractor at the proposed price within 180 calendar days after the contract award. A firm fixed proposed price is required for CLINs 0004 through 0021. No provision is made for economic price adjustment. If CLINs 0004 through 0021 are exercised, the contract completion date will remain unchanged.
3. Evaluation of Options (Jul 1990) - Except when it is determined in accordance with FAR 17.202(b) not to be in the Government’s best interest, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for CLINs 0001-0003 (base bids). In accordance with FAR 52.217-5, Evaluation of Options, the evaluation of options will not obligate the Government to exercise the option(s).
4. The Government may reject an offer as non-responsive if it is materially unbalanced as to prices for the basic requirement and the option quantities. An offer is unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated for other work.
5. If any of the CLIN(s) 0004 through 0021 are exercised, additional bonding and consent of surety is required. Consequently, the Performance Bond must reflect 100 percent of the aggregate amount of all Items.
6. Quantities on the bid schedule for CLINs 0004 through 00013 are followed by an asterisk (*) and represent estimated quantities. If the quantity of a unit-priced item in this contract is an estimated quantity and the actual quantity of the unit-priced item varies more than 15 percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party. The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 15 percent or below 85 percent of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the Contractor may request, in writing, an extension of time, to be received by the Contracting Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting Officer before the date of final settlement of the contract. Upon the receipt of a written request for an extension, the Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgement of the Contracting Officer, is justified.
1.2. FF&E BID NOTES
These notes apply to CLIN 0022 only.
1. The estimated amount for FF&E has been supplied by the Government, to provide offerors with the projected magnitude of effort. The estimated amount includes the actual cost of the FF&E including freight and installation charges. The Government FF&E Estimate is only an estimated amount.
2. If awarded, line items will be funded separately after completion of FF&E design package review by the
Government, and receipt of appropriate funding by the Government. Requirements and details are provided in E10, EQUIPMENT and E20, FURNISHINGS.
3. Bonding
i. No Bonding is required for FF&E at Time of Construction Contract Award
FAR 28.102-1(a) requires that performance and payment bonds be included in all construction contracts exceeding the SAT, except under the conditions listed. Since the FF&E is not part of the original contract award, the Construction Contractor must not be required to secure bond for the FF&E at the time the basic contract is awarded
ii. Additional Bond at FF&E Option Item Award
FAR 28.102-2(d) requires the Government to secure additional bond from the Construction Contractor for any contract price increases. Therefore, an increase to the original contract bond is required at the time of the FF&E Option Items award, to protect the Government against the Construction Contractor not providing FF&E ordered and to ensure that the vendor(s) receive payment if the Construction Contractor goes out of business. The increased cost of the bond must come from the FF&E funding source and is not a part of the Construction Contractor’s HAR.
iii. Bonds Required by the Construction Contractor
If the Construction Contractor requires bonding from the FF&E subcontractor(s), the cost must be covered in the Construction Contractor’s HAR.
4. Offerors may propose a Handling and Administration Rate (HAR) for the FF&E not to exceed five percent
(5%). This fee will account for all administrative costs, overhead, bonding fees, administration of subcontracts, profit, and any other costs associated with and related to the coordination and processing of the procurement and installation of FF&E. The Contractor’s proposed HAR percentage will be incorporated into the contract award and will not be adjusted regardless of fluctuations from the estimate amount for the FF&E. The proposed HAR is a fixed rate.
5. The Government is not obligated to award the FF&E line item (CLIN 0022). Should the Government choose to award the FF&E option, the line item will be awarded as a negotiated modification to the contract. The contractor's proposed HAR will be applied to all vendor/supplier costs for the FF&E.
6. The FF&E modification will be awarded at least six (6) months prior to the contract completion date. A minimum of six (6) months is required for the contractor to purchase, deliver and install the FF&E without impacting the overall completion date of the project. The contractor’s schedule should assume the award of the FF&E as a modification. No schedule extensions will be granted if the modification is awarded at least six (6) months prior to the contract completion date. If the Government decides to negotiate and award the furniture modification with less than six (6) months prior to the contract completion date, the contractor may be entitled to a contract extension and extended field overhead. A contract extension and extended field overhead will only be granted in those cases where the prime contractor demonstrates that accepted Final FF&E package was submitted within the approved schedule deadlines and sufficient lead time for the FF&E is not available and the Government’s award of the modification is in the last six months of the contract.
7. The Contractor and the Contractor's Designers must strictly adhere to the FF&E submittal schedule to ensure that the final FF&E package endorsement is completed at least nine (9) months prior to Beneficial Occupancy Date (BOD). If projected final FF&E package endorsement date falls between 15 July and 15 November, then endorsement must occur no later than 10 July for any given calendar year.
