About this file
This comprehensive file contains multiple environmental and permitting documents for the U.S. Coast Guard Offshore Patrol Cutters (OPC) Homeport Pier project at Naval Station Newport, Rhode Island, including a Stormwater Management Plan (SMP), Soil Erosion and Sediment Control (SESC) Plan, Operations and Maintenance Manual, regulatory permits, and a detailed Marine Mammal Protection Act (MMPA) Letter of Authorization (LOA) application.
The project involves demolition of the existing Navy Pier 1 and construction of a new 1,000-foot by 80-foot USCG OPC Pier with supporting infrastructure, along with replacement of the S45 South riprap revetment with a steel sheet pile bulkhead. In-water construction activities including vibratory and impact pile driving, down-the-hole (DTH) drilling, and auger drilling are scheduled from June 2027 to October 2028. The stormwater management design includes two bioretention filter basins providing water quality treatment, with bypass discharges to Coddington Cove via existing outfalls. The SESC Plan details erosion and sediment control measures including silt fencing, fiber rolls, sediment traps utilizing the bioretention basins, and construction pollution prevention practices. The project has obtained required federal and state permits including RIDEM Section 401 Water Quality Certification, CRMC Federal Consistency Concurrence, RIDEM Dredging Permit (approximately 12,000 cubic yards of sediment removal), and NOAA Fisheries Incidental Harassment Authorizations for Years 1 and 2, authorizing takes of seven marine mammal species including harbor seals (1,240 Level B takes in Year 2), gray seals (260 Level B takes in Year 2), harbor porpoises, dolphins, and harp and hooded seals. Mitigation measures include protected species observer monitoring, soft-start pile driving procedures, acoustic monitoring, and operational procedures to minimize impacts to marine mammals during construction activities.

NAVAL STATION NEWPORT
1.0 EXECUTIVE SUMMARY
1.1 PROJECT DESCRIPTION
This project will provide for the demolition of the existing USN Pier 1 in Coddington Cove to clear the site for a new USCG OPC Pier with all required utilities and supporting landside laydown space to support four (4) Offshore Patrol Cutters (OPCs). The project includes the construction of a modern pier capable of long-term sustainability and support of current and future USCG missions. The new OPC pier will be 1000-ft. long by approximately 80-ft. wide and will meet or exceed the requirements of the USCG. The project will also replace the existing riprap revetment at S45S with a new bulkhead consisting of an anchored steel sheet pile wall. Elevated levels of sediment beneath the pier will likely require dredging to meet minimum OPC draft requirements.
The project is located within Site 19 at NAVSTA Newport, an area identified by the US
Environmental Protection Agency (EPA) as having contamination from historic operations at former Derecktor Shipyard. excavated soil will either be handled per land use controls (LUCs) or be managed as RA construction-derived waste.
1.2 SITE CHARACTERISTICS
NAVSTA Newport is a deepwater port with access to open seas, protected moorings, space to maneuver vessels and requires limited dredging to accommodate the OPC moorages.
Water depths in the project area are generally 30 to 40 ft. Recent (summer 2024) bathymetric surveys of the project area, however, indicated shallower areas within the footprint of the existing Pier 1. The area beneath the existing Pier 1 will be the berthing location of the north side of the new pier structure and will require dredging to meet minimum draft requirements.
Subsurface conditions from historic and recent explorations performed for the adjacent projects indicate that the landside consists of fill material with underlying glacial till with cobbles and boulders. Existing borings show thick highly weathered bedrock on top of competent rock.
Subsurface conditions on the waterside primarily consist of estuarine deposits underlain by glacial till containing cobbles and boulders. The top of rock is deeper at the waterside end of the pier with a thick highly weathered bedrock overlay.
Landside topography within the area is generally sloped east to west toward the water.
Elevations in the immediate area along the pier and bulkhead vary between elevations +8 ft. to
+11 ft. (NAVD 88).
The existing pavement in the vicinity of the pier will be demolished and disposed of in order to install the new utility infrastructure which includes electric, data, sanitary sewer, potable water and fire protection water. To further support the new pier, selective demolition of existing utilities
NAVAL STATION NEWPORT
ii will be completed and capped, as necessary. These include existing telecommunication and electrical conduit, water service piping, and gas service.
In addition, stormwater infrastructure will be removed south of the new pier, between the bulkhead and access road to provide space for an OPC laydown area. Stormwater piping to be removed includes perforated underdrains, solid storm sewer piping, as well as 12-in. diameter yard drain basins.
The bioretention basin that was planned to be constructed in conjunction with bulkhead repair project S45 at NAVSTA was not constructed to accommodate this project.
The project is located within Site 19 at NAVSTA Newport, an area identified by the US
Environmental Protection Agency (EPA) as having contamination from historic operations at former Derecktor Shipyard. excavated soil will either be handled per LUCs or be managed as RA construction-derived waste. As such, stormwater infiltration practices at the site are prohibited.
Paving and site improvements will include roadways, curbs, fencing, and signs. Site improvements will provide a minimum of 2,000 sf per cutter (8,000 sf) of paved laydown space for the four (4) OPCs. New utility service lines including electrical, water, sewer, telecommunications, and compressed air will be constructed to support pier operations.
Due to restrictions prohibiting stormwater infiltration at the project site, stormwater management will consist of traditional catch basin and storm sewer collection networks, and two (2) bioretention filter basins, discharging directly to Covington Cove via existing stormwater outfalls. Without infiltration restrictions, multiple LID techniques would typically be utilized to mitigate the adverse impacts related to stormwater runoff and water quality degradation. To offset the lost opportunities traditional LID techniques utilizing stormwater infiltration offer, alternative methods will be utilized to the greatest extent possible, to improve water quality and detain flows, as close as possible, to pre-development levels. It should be noted that existing hydrodynamic separators within the project area will be maintained and reused as part of this project. The separators will work in series with the newly proposed bioretention areas, providing an effective stormwater quality treatment train.
As noted, two (2) new bioretention filter basins will be constructed to provide stormwater quality benefits for the project area and offset the benefits lost from BMPs proposed to be complete as part of bulkhead project (S45), but not constructed. All bioretention areas will be designed with impermeable liners and underdrains. The growing media within the bioretention areas will be designed to provide both high levels of permeability and effective filtering of runoff contaminants. Stormwater runoff will be directed to the bioretention areas via sheet flow. Each basin will include perforated underdrains and overflow basins to collect excessive runoff during high intensity storm events. Accumulated sediments within the bioretention filter basins will need to be periodically removed to maintain water quality effectiveness.
The Base Flood Elevation (BFE) is at EL.+16.0 ft. (NAVD88) at the current Pier 1.

2.1
2.0 RHODE ISLAND STORMWATER DESIGN STANDARDS
The proposed stormwater management system is designed to reduce the peak rate of runoff from pre-development conditions (as applicable), promote water quality improvements and protect groundwater quality. The stormwater management system includes bioretention filter basins, area drains and catch basins. The system is designed to meet the requirements of the Rhode Island
Stormwater Design and Installation Standards Manual (RISM) to the greatest extent practicable.
2.1 MINIMUM STANDARD 1: LID SITE PLANNING AND DESIGN
STRATEGIES
The Rhode Island Stormwater Manual requires that LID site planning and design strategies must be used to the maximum extent practicable. All development proposals must be accompanied by a completed Stormwater Management Plan Checklist and a Stormwater Management Plan to be reviewed by the approving agency to show compliance with this standard. If a redevelopment project site has 40% or more existing impervious surface coverage, Minimum
Standard 1: LID Site Planning and Design Strategies does not apply.
The proposed USCG OCR Homeport Initiative OPC Pier project is a redevelopment site with greater than 40% existing impervious surface coverage and therefore is exempt from complying with Standard 1.
2.2 MINIMUM STANDARD 2: GROUNDWATER RECHARGE
In order to comply with the Rhode Island Stormwater Design and Installation Standards Manual, stormwater must be recharged within the same sub-watershed to maintain baseflow at pre-development recharge levels to the maximum extent practicable in accordance with the requirements and exemptions described in Section 3.3.2 of the Rhode Island Stormwater Design and Installation Standards Manual.
2.2.1 REQUIRED RECHARGE VOLUME
In order to meet the state requirements, the recharge criterion (Rev,) which gives the volume of stormwater to be recharged based on the amount of impervious area on site, must be calculated.
Rev= (1”)(F)(I)/12
Where:
Rev= groundwater recharge volume (ac-ft)
NAVAL STATION NEWPORT
2.2
F= recharge factor, see Table 3-4 of the RISM
I= impervious area (acres)
Table 2.1 Recharge Factors Based on Hydrologic Soil Group (HSG), RISM
HSG Recharge Factor
(F)
A 0.60
B 0.35
C 0.25
D 0.10
As described above, the Pier site area is an Installation Restoration (IR) site, and as such, infiltration practices have been prohibited. Water Quality features are to be installed with impermeable liners to prevent infiltration. A waiver is requested to eliminate the groundwater recharge standard requirement for the Pier Landing site.
A waiver is required for Standard 2.
2.3 MINIMUM STANDARD 3: WATER QUALITY
Compliance with the Rhode Island Stormwater Design and Installation Standards Manual requires that stormwater runoff must be treated before it is discharged. The required water quality volume
(WQv) is to be calculated in accordance with Section 3.3.3 and will exclude LID credits allowed under Section 4.6 of the RISM.
2.3.1 Water Quality Volume (WQv)
A minimum WQv value of 1 inches times the impervious area is required.
WQv=(1”)(I)/12
Where:
WQv= water quality volume (in cubic-feet)
NAVAL STATION NEWPORT
NEWPORT, RI
2.3
I= impervious area (sf)
As the USCG Pier site meets the redevelopment standards (See Minimum Standard 6), the Water
Quality Volume Calculation Worksheet was utilized to determine the required impervious area required for stormwater treatment at each site, respectively. The results are as follows:
USCG OPC Pier: 0.9 acres
The water quality Volume is treated in the proposed bioretention filter basins at both sites. As noted previously, the USCG Pier site is designated as an IR site and infiltration of stormwater is prohibited. Therefore, the stormwater bioretention filter basins have been designed with an impervious liner and underdrain to collect filtered runoff at this site. Water quality benefits are provided as the stormwater runoff travels through the bioretention soil media filter bed. The areas of filter beds have been maximized to provide the most WQV possible at each site.
Stormwater from impervious areas at both sites travels via sheet flow to the proposed bioretention areas for treatment.
The required Water Quality Volumes are calculated to be:
Pier Landing: 1 inch x 0.9 acres x 1ft/12 inches= 0.075 ac-ft (3,267 CF)

2.4 MINIMUM STANDARD 4: CONVEYANCE AND NATURAL CHANNEL
PROTECTION
The Rhode Island Stormwater Manual requires that open drainage and pipe conveyance systems are designed to provide adequate passage for flows leading to, from and through stormwater management facilities for at least the peak flow from a 10-year, 24-Hour Type III design storm event runoff volume. Protection of natural channels downstream must be supplied by providing 24-hour extended detention of the 1-yr, 24-hour Type III storm event runoff volume.
NAVAL STATION NEWPORT
NEWPORT, RI
2.5
The new storm piping and water quality treatment facilities within this project has been designed to safely manage the peak flows associated with a 10-year, 24-Hour Type III storm event. This portion of the project directly discharges to the Coddington Cove portion of Narragansett Bay, a tidal waterbody >50.0 acres in surface area. Standard 4 is waived.
2.5 MINIMUM STANDARD 5: OVERBANK FLOOD PROTECTION
Downstream overbank flood protection must be provided by attenuating the post-development peak discharge rate to the pre-development levels for the 10-year and 100-year, 24 Hour Type III design storm events. Designers must demonstrate that runoff from the site for storms up to the 100-year, 24-hour Type III design storm events actually reach proposed structural practices designed to meet this criterion.
PIER LANDING SITE
This portion of the project directly discharges to the Coddington Cove portion of Narragansett
Bay, a tidal waterbody >50.0 acres in surface area. Standard 5 is waived.

2.6 MINIMUM STANDARD 6: REDEVELOPMENT AND INFILL PROJECTS
According to the Rhode Island Stormwater Manual construction of new impervious area is subject to the requirements of the Rhode Island Stormwater Manual unless the site meets the definition for an infill project.
2.6.1 Redevelopment
The RISDISM defines redevelopment as any construction, alteration, or improvement that disturbs a total of 10,000 square feet or more of existing impervious area where the existing land use is commercial, industrial, governmental, recreational, or multifamily residential. If the existing impervious area comprises at least 40% of the total project area, only 50% of the existing disturbed impervious area is subject to the recharge and water quality requirements. Any new impervious area in excess of the existing disturbed impervious area requires 100% treatment.
As the pre-construction impervious area is greater than 40% of the site size, this project meets the criteria for a redevelopment for the USCG OPC Pier Site.
2.7 MINIMUM STANDARD 7: POLLUTION PREVENTION
Source control and pollution prevention measures that minimize the impact that the land use may have on the stormwater runoff quality are required by the Rhode Island Stormwater Manual. These preventative measures are outlined in a stormwater pollution prevention plan provided in the
Appendix.
2.8 MINIMUM STANDARD 8: LAND USES WITH HIGHER POTENTIAL
POLLUTANT LOADS
Stormwater discharges from land uses with higher potential pollutant loads require the use of specific source control, pollution prevention measures as well as specific approved stormwater
BMPs according to the Rhode Island Stormwater Manual. This project is not classified as a LUHPPL and therefore this standard is not applicable.
2.9 MINIMUM STANDARD 9: ILLICIT DISCHARGES
The Rhode Island Stormwater Manual prohibits all illicit discharges to stormwater management systems. This includes discharges from OWTS as well as sub-drains and French drains near OWTs that do not meet the State’s OWTS rules. The State defines a stormwater management system as the system for conveying, treating, and infiltrating stormwater on site.
NAVAL STATION NEWPORT
NEWPORT, RI
2.7
No illicit stormwater discharges have been proposed as part of this project. This standard is met.
2.10 MINIMUM STANDARD 10: CONSTRUCTION ACTIVITY SOIL
EROSION, RUNOFF, SEDIMENTATION, AND POLLUTION
PREVENTION CONTROL MEASURE REQUIREMENTS
Soil Erosion and Sedimentation Control measures must be utilized during the construction phase as well as during any land disturbing activities according to the Rhode Island Stormwater Manual.
See section 3.3.7 of RISM.
A separate Soil Erosion and Sediment Control Plan has been prepared for this project to address practices to be used during construction to control Erosion and Sediment.
2.11 MINIMUM STANDARD 11: STORMWATER MANAGEMENT SYSTEM
OPERATION AND MAINTENANCE
All stormwater management systems must provide a operation and maintenance plan, including all structural stormwater controls and conveyances. The goal of the operation and maintenance plan is not only to protect resources on-site or nearby, but also to protect resources in the region that may be affected by the activities at the project area. An Operations and Maintenance Log is included in the attachments of this document. The minimum requirements of the operation and maintenance plan are outlined in section 3.2.11 of the Rhode Island Stormwater Manual.
