About this file
This document is a Justification and Approval (J&A) for the use of other than full and open competition in Solicitation N4008524R2503 for the Design-Bid-Build, P1044 Pier 31 Extension at Naval Submarine Base New London, Connecticut.
The J&A authorizes the use of a single switchgear manufacturer, Kinney Electric, to provide new circuit breakers, cradles, trolley extension, controls, relays, electric meters, substation building enclosure additions, and switchgear housing. This is required to ensure compatibility with the existing electrical substations that will remain in use and be expanded to feed new power outlets on the pier extension. Market research efforts to identify alternative sources that could meet the requirements were unsuccessful. The estimated value of the electrical equipment is included in the solicitation, which will be funded by FY24 MILCON funds. The work is required to be completed within 803 days after award. The Contracting Officer will determine the price is fair and reasonable prior to contract award.

NAVAL FACILITIES ENGINEERING COMMAND, MID-ATLANTIC
9324 VIRGINIA AVENUE
NORFOLK, VIRGINIA 23511-3095
J&A No. ML-24-07
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Facilities Engineering Systems Command, Mid-Atlantic
2. Description of the Action Being Approved.
This Justification and Approval (J&A) authorizes and approves the use of a single switchgear manufacturer, Kinney Electric, to provide new circuit breakers, cradles, trolley extension, controls, relays, electric meters, substation building enclosure additions, and switchgear housing to be used in Solicitation N4008524R2503, Design Bid Build, P1044 Pier 31 Extension Naval Submarine Base New London, CT.
The existing electrical substations currently used at NLON will remain in use but be expanded to feed new power outlets and require that same manufacturer be used to avoid compatibility issues.
3. Description of Supplies/Services.
The intent of solicitation N4008524R2503 for Design Bid Build, P1044 Pier 31 Extension Naval Submarine Base New London, CT is a Submarine Pier extension used by NLON personnel to support berthing of Block V nuclear submarines. The project will fill an identified capability gap by allowing future Block V Virginia Class submarines to berth at NLON Subase. There are 2 existing electrical substations present on the pier. The northernmost substation will remain in place, the southernmost substation will be relocated onto the new pier extension. Both substations will be expanded for new power outlets located on the new pier extension.
This acquisition will solicit proposals as Unrestricted Full and Open on a Stand Alone Construction Project as authorized by the approved DD2579 on 17 November 2023. The estimated value of the work included in the construction solicitation is is estimated for the electrical equipment (800 Amp Frame Draw-Out Circuit Breakers: Schneider Electric Masterpact® NW Low- Voltage Power/Insulated Case Catalog #NW08L1F; Switchgear housing and trolley extension, misc.
relays and controls, and substation building enclosure additions; and Electric meters: Electro Industries / Nexus Model Shark 270).
The project will be funded by FY24 MILCON funds. The work under this contract is required to be completed within 803 days after award. The products listed are required to meet the readiness requirements for the Customer by meeting the equipment electrical connection requirements.
4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements.”
J&A No. ML-24-07
5. Rationale Justifying Use of Cited Statutory Authority.
NLON Subase requires an extension to existing Pier 31 that will meet the functional operational requirements for berthing of Block V Virginia Class Submarines. The expanded substations are required to provide the necessary power to properly service the nuclear submarines. The electrical transformers, meters, and substation enclosure will provide the necessary compatibility for the existing equipment to function properly. Previous similar pier expansions have demonstrated the need for seamless compatibility between new and existing electrical equipment as SUBASE has experienced power failures to nuclear submarines after prior pier expansions were performed. It is believed, therefore, that the specified equipment must be used in order to ensure complete compatibility between the newly installed electrical equipment and equipment already present on the existing pier.
If this Project does not include the required compatibility, the impact will be the potential loss of reliable power for berthing of nuclear submarines.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
A sources sought notice was published on Sam.gov on 9 November 2022 detailing the requirements of the Electro Industries/GaugeTech, Shark 270/250 Meters and Neptune T-10 with Riotronics Submersible Pulse Adapter model NT10-4P-CF-I to meet the ATO requirements. The notice sought commercially available products that could meet the same requirements. The response date was 24 November 2022, and no responses were received.
Additionally, a sources sought notice was published on Sam.gov on 16 October 2023 detailing the requirements of the 800 Amp Frame Draw-Out Circuit Breakers: Schneider Electric Masterpact® NW Low-Voltage Power/Insulated Case Catalog #NW08L1F and Switchgear housing and trolley extension, misc. relays and controls, and substation building enclosure additions to meet the readiness requirements for the Customer. The notice sought commercially available products that could meet the same requirements. The response date was 30 October 2023, and no responses were received.
A solicitation notice will be publicized on SAM.gov, in accordance with the requirements of FAR Part 5.
