About this file

This amendment to a solicitation from the Department of the Navy Naval Sea Systems Command provides revised requirements for a contract to perform work on U.S. Navy Barge YFNX-20. Key changes include updating pricing terms to add "Lot" as the unit of issue for contract line items, modifying liquidated damages from $7,000 to $9,423 per calendar day, removing various clauses, and requiring the place of performance be within 350 miles of Charleston, South Carolina. Offerors must now demonstrate ownership or committed access to a pier and dry dock sufficient to dock the barge, with the dry dock certified to MIL-STD-1625D. The amendment extends the response deadline to October 6, 2023.

SECTION M - EVALUATION FACTORS FOR AWARD

BASIS FOR AWARD

1. The Government will make a selection based on lowest price technically acceptable source selection in which competing offerors’ technical proposal shall be evaluated on an acceptable/unacceptable basis. All technically acceptable offers shall be treated equally except for their prices. The evaluation process shall proceed as follows:

Price: The Government will assess price proposals to determine reasonableness of proposed pricing based on the completed Section B and information contained in the Pricing Workbook (Attachment S-2). The Government will not conduct a price realism analysis on any aspect of an offeror’s price proposal. Although award will be made based on an offeror’s total price, a price proposal that is found unreasonable and/or unbalanced may be rejected.

Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated.

a. The total evaluated price for the availability will be calculated by adding:

i. Base CLINs/SLINs including all Option items (Section B shall match the S-2 totals)

ii. Evaluated price of the Growth and New Work Labor and Material Burden Rates (The evaluated price of notional growth and new work is determined by applying the labor and material Burden rates to the notional labor hours and material stated in the S-2.

b. Although award will be made based on an offeror’s total evaluated price, a price proposal that is found unfair and/or unreasonable may be rejected.

All other information submitted under the price proposal will be evaluated for completeness.

Technical: The Government shall review the lowest priced offeror’s proposal first. If the lowest priced offeror's technical proposal is deemed technically acceptable, that offeror shall be awarded the contract. If the lowest priced offeror's technical proposal is not deemed technically acceptable, the Government shall go to the next lowest offeror and determine if their technical proposal is deemed technically acceptable and so on until the offeror with the lowest price, technically acceptable proposal has been reached. The offeror's submission shall be deemed technically acceptable or unacceptable as defined in the chart below:

Rating Description Acceptable Proposal satisfactorily provides documentation that meets the requirements of Section L, Volume II Technical Proposal

Unacceptable Proposal does not satisfactorily provides documentation that meets the requirements of Section L, Volume II Technical Proposal

Competitive Range: All technically acceptable offers shall be included in the competitive range. A further evaluation of offers within the Competitive Range may occur in light of any additional information or data received during subsequent discussions and/or furnished with final proposal revisions.
